Ok I read somewhere recently that "out of status" persons are supposed to register. And he was out of status at 20. Neither of us had heard of that before

We're getting ready to file for my husband's naturalization soon. I'm not sure what he needs to do about the selective service. He came here at 19 on a tourist visa but overstayed it. He was 31 when he became a LPR. The wording is kinda tricky when I looked it up. Was he supposed to register when he fell out of status when he overstayed his visa? If so, what should we do now?

Got the EAD last week.
Our interview is scheduled April 25, 8:30 am.
Now to start getting the papers ready!
-
Did you already have a social to get the license? My husband has his EAD but has to wait 2 weeks to get his social security #, then he can get a license
-
That's awesome, congrats!

The removal proceedings may make it a little longer/ more difficult. But if it's a true marriage, you will eventually get through it. Also I've heard working illegally is forgiven if you're a US citizen so I wouldn't think that would hurt you much. But I'm just guessing?

My hubby completed his biometrics on Mar 14 & the USPS tracking said his should be delivered tomorrow, so 1 week for us! But the initial biometrics was scheduled Feb 4 so maybe that's why it's moved so fast?
-
Tracking info says EAD should be here tomorrow, yay!!! So what should hubby do once he gets it? I know he has to go to the social security administration 1st to get a SSN. Will they give him a paper or something immediately so he can go to the DMV & get a drivers license, or will he have to wait for the SS card to come in the mail before he can get a license?

My hubby finally got to do his biometrics today, over a month after his 1st scheduled appointment. Less than 30 min after his appointment, I got a text to check out status online. The card production has already been ordered! We'll be getting it within 30 days. After weeks & weeks of waiting, I can't believe it's happening so fast! Thank God!!

We finally got a new biometrics appointment for march 14. Over a month after the 1st one that hubby wasn't allowed to go to due to his expired ID. Hopefully he can get his EAD quickly after that. He's ready to drive & work!

I'll be happy just to finally do biometrics. Still waiting to reschedule the biometrics appointment. Congrats to all of you who are making progress. We're just a little jealous lol

I didn't know you could choose your ASC. We would have to go to another state.

Yes, you can do AOS with an expired passport. Like I said, some people are unable by the laws of their country to renew their passports abroad if they cannot show they are in that country legally. So, a visa overstay with an expired passport from one of those countries can still file for AOS.
Apparently not in New Orleans. We went today to attempt an early walk-in for my husband's biometrics. First they told us that they will not take walk-ins, appointment only. Then we asked if his ID would be ok. They said that an expired passport is unacceptable. So now we have to reschedule the biometrics & wait for his passport to become available before he will be allowed to do his biometrics.

He has his visa in the expired passport (visa is expired too). He didn't have the I-94 so we filed for a replacement one. We are definitely bringing the old one but were told by the lawyer he needed to take a current one to the interview as well. I guess he would've needed a current passport eventually anyway but he could've flown to the consul in the US & got his new passport with less hassle if we waited until after he was able to get a license (after EAD), but we wanted to make sure we had it in time for the interview. :/
-
I know this issue is resolved already, but are you saying you can do AOS with an expired passport? My husband's passport is expired & they only way to renew it is drive to his Consul (6+ hours away) on 2 separate occasions 2 months apart. We have spent time & $ doing this because an immigration lawyer told us he needed an unexpired passport for the interview. I hate to think we wasted the time & $ unnecessarily.

Second walk-in attempt unsuccessful. I was told on the phone that the office closed at 4. We got there at 3:30 & they told us they closed at 3:30. They said they wouldn't do a walk-in anyway, that it is by appointment only. I guess we will have to wait until Feb 4
-
The appointment is in Metairie, LA. We tried to go today but traffic was very bad & it took us an hour to get there & they were closed by the time we got there. Will have to try another day.
I thought my timeline was updated, not sure how to do a signature update. I'll go on my computer a little later & try to figure it out!

I just found out this office is closed on Fridays. It will have to be some other day :/
-
We finally received a biometrics appointment for Feb 4!! We may try to walk in today & see if they'll take my hubby. not sure if this location accepts walk-ins though.
-
@ Mrs gonzo: our paperwork was sent on Dec 27 & the 1st letters were dated Jan 4. I guess maybe it's different processing centers? I don't know much about how all this works :/ But glad to see other people are getting appointments!
-
You're so lucky! We haven't received our appointment letter yet My husband is anxiously awaiting the EAD so he can get a license & work too. (Here on a tourist visa, expired now, so can't get a license or ID in our state).
-
We just sent ours too! I'm hoping we don't get any RFE that delays the process

I don't know much about immigration law but would you be eligible for the DREAM act that was recently passed for people who came here illegally as children?
Didn't register with selective service
