  1. So this: https://www.gov.uk/check-uk-visa/y/usa/tourismseems to state my wife should be fine, we'll just bring the required documents!

    Still, feel free to confirm I am correct on all this, better to be safe than sorry! Also, does anyone know what line we'd go in to do this? Can we both go in the same line when entering the UK, and would it be for the uk passport holders or for foreign visitors? Thanks again guys!

  2. So, I'll be visiting my family in England next month for 2 weeks (super excited). I have my greencard, I plan to living in America with my wife forever, have a job and life here, etc.

    So as far as I'm aware, I'm all good? Right? My main question is more do I need anything for my wife? Obviously she's fine for going back to America, she's a US citizen, but does anyone know if we need anything entering the UK? Just so they know we're not planning on staying there and it's just so we can see my family? I know how picky immigration can be.

  3. So I said I would update you on my greencard when I got it.

    It arrived today (3 weeks? More like 3 days), and yes, it is in fact a 10 year green card, and my interview was waived (I've received a 10 year greencard without an interview). I'm very excited that my life can just be completely normal again from here on out, this was just to let you guys know since you seemed very interested by it before.

  4. Yes if they dont issue the GC before the 2 years is up then you get a 10 year GC, which probably happened in the case of the person who received the 10 year card. The only thing I didn't get about it was they had no interview to show they had been living together for 2 years, unless of course they sent a lot of evidence for AOS. They got lucky I guess and I am now wondering if they can apply for naturalisation?

    Wow, you guys are really interested in my case!

    To answer some questions, I arrived in Jan 2013 on a K-1 visa, married in March 2013. So yes, by the time they finished my case, I had been here 2 years of time (I believe 2 year vs 10 year is based on arrival date, not marriage date, but that's just something I remember reading awhile ago, I never thought it would apply to me!). I guess the unfortunate delay with the filling of my AOS did have an unexpected advantage in the end!

    I'll keep you guys update when the card arrives, if it is in-fact a 10 year card, or if it's a 2 year card, but all I can tell you is that the letter does state a 10 year card, so I presume it will be that, but I'm just happy to get my greencard no matter how long it is for. I wouldn't recommend anyone planning to wait 2 years on purpose though, it meant I was not able to reliably safely travel back to England, meaning I missed some important family events, and it would never guarantee a 10 year card or no interview, I think I just got rather lucky, my face must look very trustworthy and non threatening! Hahaha.

  5. congratulations! Im wondering why they skip and come back to cases they have skipped?! because almost all of the service centre processing times are past january 2014! can't relay on the USCIS processing time anymore!

    Too be somewhat fair, they did send me a RFE around January (my civil surgeon forgot to include an x-ray report =/), so in theory, it should have been 12 months or there about.

  6. Yes, the wait has been awhile, which is why I'm so excited. I also, unfortunately, wasn't able to file my AOS right away, which meant slight overstay, and me not wanting to risk travelling. With this, I'll be able to visit my family back home, I haven't seen them in 2 years :)

    The good news is, it did say I was getting a 10 year greencard, not the 2 year, which means my wife and I can pretty much have 10 years of normality, and not stressing over the waiting!

  7. Per Matter of Arrabally and Yerrabelly, a departure under AP is not considered to be one that invokes the overstay bars.

    There is no guarantee of readmission on AP, and you are rolling the dice that the CBP officer you see on that day is aware of the law and this recent BIA decision.

    If you do decide to travel, it might be helpful if you posted back here saying what ultimately happened.

    I do thank you for bringing the "Matter of Arrabally and Yerrabelly" to my attention. The original post bringing fear to me was made back in 2011, however, the "Matter of Arrabally and Yerrabelly" was a decision decided on in 2012, which seems to state that traveling with advance parole does no count as a "departure" and that people with pending adjustment applications and advance parole permission would NOT be considered to trigger any time bars where you would be denied entry.

    So, by that, since my AOS has been received and is processing, and that I have received my AP, they shouldn't legally be able to deny me entry based on this decision? (obviously I know that someone may not know and try to impose the ban, but I could fight the ban later with backing?).

    I'll wait for some more answers, I don't want to risk anything that will keep me away from my wife, she is my everything.

  8. Hello, so I have a really important question to ask regarding travelling outside the US, while waiting for our AOS to finish and receive my green card.

    I arrived in the US on Jan 2013 on a K1 Visa, got married on March 10th 2013. My I-94 expired around the end of April. Due to problems with my wife's taxes and a family issue, we never filled for AOS until around the beginning of January this year. My employment authorization and my advanced parole combo card arrived earlier this year.

    We received a letter in April or May saying that we were marked as a low risk and may not require an interview at all, however, due to heavy work load in their offices, the AOS will be delayed, and that if for any reason anything changed and I'm required at any point to attend an interview, they would let me know.

    Well, my father is getting married next weekend, and I was planning to attend, I'm all set and ready to leave, but I was looking around just to check if I should bring anything other than my passport and eployment auth/travel auth and started to read about overstay on the I-94 and I'm worried if that will be a problem for me since sending my AOS off in the first place got delayed for so long. I didn't know an overstay was an issue.

    I'm really worried because I need to be there for my dads wedding, but I don't want to be denied entry or to be banned from entering back into the US.

    If anyone could clarify how it works with the K1 visa, and what I should do, I would be eternally grateful.

  9. So we're finally applying our AOS after problems with my wife's tax return (Incorrect name at time of filling, online company we used losing her details etc), but I have a couple of questions

    1. I don't need to send in the I-485 becasue I send in the DS-3025 instead, correct (don't worry, it's not a year old, yet!)? Is that it? Just replace that form with the other and it is all fine?

    2. We're being co-sponsored, but I was wondering if this would make a difference to anything? My wife's mother easily earns enough to co-sponsor us, but on my wife's I-864, her annual income will far higher than her last 3 tax returns, due to these all being her working half a year (first tax return she started work for the first time, 2nd year she worked up until she went to college, and then the 3rd year she stopped going to college and started work again, all which ends up being half a years work or less each time), will this matter for her? I know on a sole sponsor this would be a big deal, but as we are being co-sponsored, this shouldn't matter correct? I also presume I won't need to put any assets, as again, the co-sponsor easily covers the necessary amount.

    And a 3rd question. For total household size, we listed 3 (Me, my wife, and her mother), and for her Mom we will list 4 (Me, my wife, her mother, and her sister, who is still a dependent child as she's under 21). Is this all fine and correct?

    Just thought I'd get some clarification. If this is all correct and everything, then once the copy of the tax return transcript comes back ,then we can FINALLY send everything off, and I can finally begin a normal life again!

  10. Not the perfect place for this, but I thought I'd ask here since many of you would have already gone through the whole K1 visa/AOS stuff.

    I've had my interview, visa approved. My fiancée and her family (who we will be living with at first) have just moved and have a new address, I'm flying out there next week, and I just thought I'd check to see if the new address would make a difference to anything? Will anything get sent to her old address? Or when applying for the AOS, will I just list the new address there with no problems?

  11. That would be scary to think you're all set and the document lady throws you a curve ball. Wonder why she said that? So did they have anything proving the sponsor's income or just the I -134? Does your fiancé have any income?

    Congratulations for making it through.

    Nothing proving the sponsors income. I had it all there to give, but they never asked for it, so just the I-134.

    My fiancée had a little bit of income, but not much at all, and I have about £8000 saved up (which the 2nd guy interview asked about). The 2nd interview guy seemed happy with what her mum was earning though, and took her I-134. Surprised they didn't want the tax returns or anything though.

    It's approved though, and that's all that really matters, so I'm happy.

  12. So, I just got back home from my interview... Visa approved :D:dance:

    Hated the interview though. Finally got called up to the first interview, the lady is just asking for forms, all good so far. She asks for the affidavit of support, so I mention about being co-sponsored (my fiancée and her mom) and the lady says that only my fiancée can be the co-sponsor.

    "Wait, I thought I could have a co-sponsor since..."

    "Only your fiancée can be your co-sponsor"

    "wha... okay"

    Thankfully, I had an affidavit of support for both my fiancée and my future mother in law! I give it to her, and at this point, she tells me to fill out the courier form and wait to be called for the 2nd interview. I'm sitting there, panicking, thinking what if they stopped co-sponsors. I was just hoping, praying, that when I had the 2nd interview, that whoever interviewed me would just say that they can take the co-sponsor.

    Come up to the 2nd interview, the guy starts asking how we met. Queue long explanation, then asks about how we plan to support ourselves, I explain about how her mum will help support us, and that she filled out the co-sponsor form, but the "lady in the first interview said she wouldn't take it yet" I don't know why I said yet, I meant to say she wouldn't take it at all! The guy seemed fine, a bit confused, but said he'd take the form.

    Queue more questions about our relationship, about her life, about her family, commented that we were both a bit young and asked how we knew the marriage was right, asked about what her mum does, which I knew her job title, but I didn't have a clue what she does on a day to day basis, and basically I said as much.

    Ready to show tax returns for her mum, ready to show proof that it's permanent employment, ready to show skype logs if he wanted to see them (he was very curious about us meeting online). Didn't ask or anything. Just said that the visa was approved, and to go pay the courier.

    Such a nerve-racking experience, but so happy at the end of it!

  13. So, my interview is on the 3rd on Jan.

    Couple of questions. 1st, payment. Do you just ring up any time before your interview and pay, or do you get a letter through the post first, then call and pay?

    2nd, bring to the interview all stuff they ask for passport/police certificate/visa photo etc, etc. Apart from them, is it just the copy of the previous package, the affidavit of support (with co-sponsor in my case), proof of (co)sponsors earning by way of tax returns/paystubs and proof of an on going relationship?

    Is that everything?

  14. Oh, and if that is okay for the AOS, then they are giving better, not perfect, but better advice at least. They said that they could send the form off to the embassy now, and I could take my GP proof of Flu Vac with me to the interview, but that it may mean "in some states" that when I apply for my AOS, I might need to get another vaccine form done, or that I could fax them the proof, they could update the form, and I wouldn't have to worry about it and could just keep and use the copy.

    Few other random notes. Was seen by a young blonde doctor, didn't really say much, but just seemed to be a not talkative person rather than cold, was nice enough when telling me that my BP was high (what?!) and that it was probably just nerves, she let me lie down a while and then she retook it. Also, according to their scales, I dropped 5kg in one day, which is pretty impressive.

    Overall, not a bad experience, apart from the cost of course. Everyone was nice and it went through pretty quick.

  15. Reading this, I think I'm fine, but I'll check.

    So I had my medical on the 24th, and the only thing I was missing was my Flu Vac, they offered me to either send it off now and just take a note that I've had the flu vac done by my doctor, or that I can fax the proof through to them, and they'll update the sheet then send it off.

    I said I'll get it done Thursday/Friday and fax it through to them, and am going to fax the proof tomorrow. So, I should be fine then? Since the flu jab will be on the form signed by knights bridge doctors?

  16. For the medical, you can use a UK-sized, but for the interview, yes, you will need US-sized photos. Good luck!

    Can they be different? I assumed they had to be the same? Edit: I mean, the actual picture, not the size of the photo.

  17. Correct, the photos go with you to the interview. Only mail the DS forms. Please be sure to read through the K1: NOA2 to Interview thread in the UK regional forum.

    I don't think my passport photos are correct, all of them are UK style passport photos, not US.

    However, I can send my forms off and get the passport pictures taken on my way to the medical I guess.
