  1. Hello VJ Friends,

    I would like to ask for your opinion on our issue.

    After almost 9 long months waiting for NOA2 we got a RFE and here it goes:

    "* Submit joint marital asset evidence described on page one."

    On the page one there is one box checked:

    "Submit copies of documents that will support your application for permanent residence which were filed based on your marriage.

    Documents to be submitted are lease/mortgage contracts showing joint occupancy/ownership of your communal residence,

    insurance policies(health, car/life), financial records showing joint ownership of assets or joint responsibility for liabilities, such

    as joint savings/checking accounts (bank statements should show the date the account was opened), joint tax returns,

    joint installments or other loans, utility bills. if you live with relatives or friends, a lease in their name(s) must be submitted

    with a notarized affidavit from them attesting to the living arrangements and your monthly rent obligations."

    Looks like whatever stated above does not apply to us unsure.png because:

    1. Our US home is in my USC spouse's name he owned it before we met, so there is no joint lease/mortgage/ownership.

    2. Insurance policies? Yeah, there is only a car insurance with both our names on it.

    3. We are filing taxes as married but separately because it works better for both us.

    4. We do not have any of financial records mentioned above as every home bill is on USC's name as it was before we got married,

    cars and other stuff has been leased on separate names way before we decided to marry.

    The reason we do not have any joint installments or joint bank accounts is because my spouse left the U.S. for business trip a 2 weeks after our wedding and got returned at POE on the way back crying.gif

    Of course we share our finances on a daily basis, shopping, airfare tickets (we travel a lot), gifts, restaurants, but that is it.

    How can we prove our joint marital assets without evidence but car insurance ?

    Just don't waste time and money like I did for applying for a B2 visa.

    Better get a ticket to your country for your hubby.

    This process got separated us for 9 months already but at least my spouse has visited me two times for 6 weeks total and we had our honeymoon and a honeymoon reloaded all over the Europe :D

    There were no questions at all as my papers were just perfect.

    The simple thing they got onto was like we cannot issue you a tourist/visitor visa as you have already applied for immigration visa,

    so you stated clearly by petitioning your intent is to immigrate to the US and this prohibits us to issue you a visitor's visa.

    You can preload it with documents showing you are attached to your country as much as you can at the interview,

    they just do not care. You are considered as a potential immigrant the way they do not like (applying from the US) so there is your denial.

  3. Unfortunately, it seems they are slowing down the speed again.

    In the last (almost) 4 weeks, they have approved total of 340 mid-December cases, making 67% of those cases approved in 187 days or less.

    Thank you again. I had this feeling they are slowing down and your graph shows exactly what is happening.

    Time to buckle up for longer journey, maybe we will see our spouses before Xmas...

    Are you pulling this data from VJ forum or USCIS website ?

  4. I don't know if anyone is still interested in following this line of approvals for mid-December filers, but here is the update for the last couple of weeks.

    They are still at a steady pace averaging about 300 approvals per week.

    55% of these petitions have been approved in 140 days or less.

    Sure, there are still people from mid-December waiting for their approvals.

    We are December filer too, so IO said to wait 50 more days, LOL it means 2 months again..

    Saying that they are currently working with Oct i thing not correct because in VJ you can see sooo many approved 2013 March, April filers, i think they are giving the wrong information

    Other December filers you see approved faster because they filed DCF, their application was sent to the local field offices that do not have a huge backlog and process faster or just got lucky. Mine I-130 is still at NBC and most probably will not be send off to local office until the NBC feels they are "overwhelmed" with processing. This is what the Tier 2 said.

    in Jan it had 2500 awaiting applications with processing speed of 350/month that gives you 7months, instead of that they decided to keep it at NBC for 8months or more. Now the whole CR1 process will take a year if there there is no AP involved. Great job NBC!

    December filer here, my NOA1 is dated 19th Dec 2012, in two weeks passing the 6months mark.

    Yesterday called USCIS, they said the case is still at NBC in the backlog and it will take at least 50 more days to look at it as they are currently processing Oct 2nd !!

    What a joke! Asked what about their "5months goal thing" they were keeping telling about everytime I called. Tier 2 responded it is still within "normal" processing time.

    Great! When you pass 5months mark the famous 5 months goal becomes 8 months goal, perfectly normal.

    Whoever got transferred to the local office got lucky.

  7. My NOA1 date is Dec. 21st .... we were at NBC. About 10 days ago I got the notice for a standard interview at our local office. I will go without my husband (since he is in England) but with my lawyer. Nervous and hopeful at the same time. Good luck to everyone who hasnt heard anything yet for their own case.

    How did you get notified ? Do they send it by mail or email ?

    Have you checked online status if your case has been touched?

  8. Also make sure to get 2 police certificate. One is "casellario giudiziario" and the other one is "carichi pendenti". What's the difference? I have no idea but that's what they ask.

    The Certificato Generale del Casellario Giudiziale is a certified national record of final court convictions and decisions regarding mental incompetency and bankruptcy or a statement that no such record exists (Nulla).

    The Certificato dei Carichi Pendenti is a certified record of pending criminal charges, or a statement that no such charges exist, from the office of the Procura della Repubblica in the applicant's place of residence.

    Both certificates can be obtained from Procura Della Repubblica local offices in beneficiary's residence.

    Note: you need to be at least 3 months registered resident in the that place to request "Certificato dei Carichi Pendenti" from local office.

    First option is fastest one.

    It takes only one week but who requests it must show up in person with personal ID, one photocopy of id, one office stamp for 14,62E and one for 3,54E FOR EACH CERTIFIED COPY.

    So for NVC stage you need 2 stamps (marche da bollo) for 14,62E and 2 for 3,54E and two photocopies of same photo id.

    I guess you will need to have additional set of these certified copies for an interview, but I am not sure. (please correct me if I am wrong).

    The second option is handy if one resides abroad.

    The written request letter is required to request both certificates, you can find template somewhere in other posts.

    You will need these stamps in the envelope or equivalent value in cash (Euro only) to cover all fees along with photocopy of a photo id and with a stamped self-addressed envelope.

    I got mine 6 weeks after NOA1 hoping they will not expire before NVC gets them :whistle:
