    My file was transferred to the NBC too, and I got my NOA2 today, 72 days after my NOA1. I am so relieved. Now on to the NVC processing. Good luck September people!

  2. Most likely an error message. "fat fingers" entered a wrong case number. This is one of the few cases where a phone call may help. Even the phone operators can answer this one. Call and ask them the address they show on file. If it is correct, then this is just an error, ignore it. If it is wrong, then you can change it. Call the number on the NOA1 notice you have.

    Thanks. I just got off the phone. The tier 1 person repeated the same info from the website, "your address has been changed, please don't call us if your case is within normal processing times." I then asked to be transferred to the tier 2 person, who said my address hadn't been changed and that the last action was from when I was transferred to NBC in September. He couldn't see any action since September... So, I guess I'm OK, though a bit strange the tier 1 rep can see an address change that doesn't show up on the tier 2 rep's computer.

    I was sort of hoping the fat finger error was they approved it but entered it into the system wrong! :)

    I looked at my case status today and it said the following:

    Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

    Your Case Status: Initial Review

    On December 5, 2012, your address was changed relating to the I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN that you filed.

    I didn't change my address, so wondering if this is either an error or if it means the address of where my petition is being processed was changed? I'm abroad and mail takes about a month, so it will be awhile before I see the paper confirmation. My NOA 1 was Sept 15 from CSC, then transfered to NBC on Sept 22. Nothing since... If anyone knows that the address change means, please let me know.

While understandbly very difficult for you given your situation, it is not surprising he was refused given how long he stayed in the USA during his prior visit and how long you say he planned to stay on this visit. Yes, you can technically stay for 6 months at each entry, but anyone staying months at a time is reasonably going to be suspected of no longer being a visitor but of being an intending immigrant.

Incorrect, it's perfectly fine to apply for a B2 visa with the intention to come to the US and get married. there are thousands of weddings that take place in the US every year where one of the parties is a foreign citizen and they had every intention of coming and getting married, and then returning to their country when their authorized stay was over.

    What is fraudulent is using a B2 visa the intent to come, get married, and then stay and adjust status. Even though the burden of proof is on the government to prove fraud, people should never go down the path that could lead a finding fraud since the consequences of fraud are severe.

    OP, it is perfectly fine for you to marry your fiancee now and you can immediately file the paperwork after you marry. She can remain in the US after her filing until her authorized stay ends (which you have indicated as February 3rd).

    Ryan H is correct. Marrying someone on a B1/B2 (or B2) visa is perfectly fine. What's not OK is the spouse staying past the authorized and then adjusting status... yes, you may likely succeed, but it's not worth the risk. It might even impact family members of your spouse when applying for visas to visit your spouse in the future, since the Embassy might think this person will do the same (use a B1/B2 visa for immigration purposes)

    8. Did you send I-130 package from abroad? No. Brother mailed from the USA.

    9. Did you include evidence of your residence abroad in the I-130 package? Yes.

    10. Did you mention the fact you reside abroad in the cover letter or write a letter describing your current situation and the evolution of your relationship with your spouse (mentioning your residence abroad)? Yes, though explained that beneficiary and petitioner live in different countries abroad.

    11. Has your case been "auto-expedited"? Doesn't seem like it. NOA-1 on September 15... no word on NOA-2. When look-up case, it says "initial review."

    12. Service Center? CSC

    Would anyone be able to tell me how to see that a case has been "touched", etc? When I look it up, all it says is "initial review" without any other information about when various things, such as NOA-1, happened. Thank you.

    I'm a US citizen living abroad with a DPO address (similar to FPO/APO). I had my brother mail the petition on September 12 to the Chicago lockbox. Delivery confirmation shows it was received September 13. My bank posted the $420 check on September 18 via an ACH withdrawal.

    I've yet to receive a receipt number, though I filled out the form for email confirmation. Mail is very slow here, so if they sent it by mail and forgot to send electronically, it wouldn't be unusual not to receive it yet. However, what was a bit worrying was that I called today to the National Customer Service Center asking if they could tell me my receipt number, but the (friendly) representative could find no record of the case searching by social security number, my name, or the beneficiary's name. He gave me an email for the Chicago lockbox and told me to contact them, which I did.

    Anyone else have a similar situation or have suggestions for additional action on my part?
