  1. Hi! We are starting to file a CR2 for my daughter. I came here with a CR1 visa ( my husband is a USC). He will file for my daughter (his stepdaughter).

We're stuck on question number 2 on part D. "Have you ever before filed a petition for this or any other alien? Our answer is Yes.

If "Yes" give name, place and date of filing and result..

The place and date of filing - where can we find this? is it on the NOA 1? the date receipt that is listed on the NOA1? and for the place, does that mean the USCIS office where the petition is being processed?

I have copies of my NOA 1 and 2.. We are confused what to use for the date of filing. is that when they received my I-130 or when we sent it...

    Thank you so much.

  2. Hi!

I'm Sarah's husband and Sarah has asked me to check some information for her before she flies out to the U.S. from Tacloban City, Philippines on December 15th. It appears that everything's in order as far as I can tell (her visa was approved in October). She has her visa info, medical info, passport and CFO sticker. Sarah's currently in Tacloban and assessing the damage to their home as well as the never ending task of trying to clean up after Yolanda. Our communication is extremely limited each day....basically down to a handful of texts which makes it difficult to relay important information as we prep for her to leave.

She's asked me to ask if there might be any more information or documents that she'll need either for her flight from Manila or once she arrives at her port of entry in the U.S. other than the things I mentioned previously. She has relied heavily on info in the past from VJ and has been so very appreciative of the info she's received and speaks very highly of how willing people are here on this site to help so this was the first place i wanted to come.

I appreciate any and all information you can provide and I'll pass it on to her so she can make the final preparations for her trip here.

    Thanks!

    Randy

  3. HI VJ!

I already had my interview and I received a 221g for evidence of current sustained income (from the Petitioner) and to find another co sponsor. I wanna ask about the evidence of current sustained income cuz i still don't understand if we need to resubmit copies of his taxes for the past 3 years and bank statements. We already submitted this when we submit our documents to NVC and i understand that the embassy also has copies of this.

My husband just recently started working last June 2013, so when we submit our documents for NVC we only submitted the offer letter and 1 pay stub for proof of his employment (along with the past 3 years tax, bank statement).

Next week we will be submitting the evidence of current sustained income. We now have his certificate of employment (that states his salary for 20/ hour or $41,600 annual), certificate of employment history from the same employer cuz he was employed with them since 1992 until he got laid off in 2009. But now he's back with them as a regular employee. Also we will be able to submit 8 pay stubs since June 2013. Are these sufficient enough for the evidence of current sustained income? Or we need to submit again the income tax returns and bank statement.

We also found a new cosponsor for us.

    Thank you VJ

  4. Did you provide a letter from his employer stating when h I menaced working with the company how much he earns pe year?

We need to know what evidence you provided so we can better help answer your question.

We submitted these ff documents to NVC: cetificate of employment stating his $20 per hour and gross income of $41,600 and he's full time. Offer letter stating the same, 6 pay stubs. But he didn't file for Income tax return of 2012 cuz he didn;t make an income that year and he travelled here in the Philippines 3 times last year using his own savings... I asked my husband a letter explaining why he didn;t file the ITR on 2012 and i gave it to the pre screener..

WE submitted his 2010, 2011 income tax, bank statement $34k, equity for his real estate $19k.

He just started with his job this June 2013. They said this was the problem cuz he's just new in his job. But he'll be making $41,600 for gross income now. Isn't it big enough? i mean we'll qualify esp that it's just me and him. We didn;t inform the embassy though that isn;t really a new job, he worked for this company for 17 years from 1993- 2009 when he got laid off due to recession..

Also on the afiidavit of support our lawyer didn;t include his bank statement and assets on it.Should he have this information included on the I-864 forms? .. He just stated the income he'll be making now. But we provided bank statement and like i said the document for the equity on his house..

  5. Hi! i just wanna share my experience from my interview last Sept 4, 2013 at USEM. I got a 221 g that requires me to provide them with 1. Evidence of Current Sustained Income from the Petitioner and 2.) Find a qualified Joint sponsor.

Let me explain our situation better. My husband just started working with his job of 17 years last June 2013. He got laid off 4 years ago in 2009 due to recession. So he was unemployed for almost 4 years. But now his back with them and is making $20.00 per hour/ $41,600 per annum. We provided the embassy with his certificate of employment, offer letter that both states his current income and that he's a regular employee, along with these are his pay stubs since June. My husband did not file for an income tax in 2012 since he didn't make enough money. His tax adviser told him not to file for an income tax that year and I had my husband made a letter explaining why he didn't file. I've given this letter to the pre screener during the interview. And also my husband visited me 3 times last year here in the Philippines and he used his own savings for the trips.

My question is that what other evidence of sustained income are they asking from us? Why is his income now of $20.00 per hour didn't qualify.

And about the Joint Sponsor, we had a joint sponsor when we applied for my visa cuz he was still unemployed last year. We had his sister as our co sponsor who's making $22,600 gross income, but this only comes from her pension (Social Security). She didn't qualify as well. So now they're asking as to look for a qualified sponsor...

Now we'll have my sister as our co sponsor. She'd been in the US for almost 11 years now and working as a full time LPN (licensed Practical Nurse) and she's making $20.50 per hour.. She's married to an american who's making $500 per month cuz he's only working part time. And they have 2 kids.

Does anyone here who can help me and tell me if they will qualify as joint sponsor? My sister gave me her past 3 years income tax returns. Both my sister and her husband income tax return for 2012 was $37,820 (total income). Then for the 2011 it was for $46,272 (total income). She filed for a leave from work back in 2011 for 2 months that's why her income for 2012 was a little lower. I hope this info will help...

I wanna ask if anyone here can help us figure out if they will qualify as co sponsor.. THANK YOU IN ADVANCE.... I'd realllly appreciate all the help.

    Sarah

  6. Just turned in my joint sponsors (sister) I864. She also files jointly...this is what the embassy told me over the phone....If she is filing as the joint sponsor and her income alone is enough, there is no need to file the I-864a from the husband as joint filer. Just put her income only in the corresponding questions. With the new form that would be part 6 line 5....and then in part 6 line 10 as no other person is counted in the household for income purposes. In line 13a.1,13b.1,and 13c.1 for total adjusted income she put the total adjusted income from her w2's. Now this is how I was instructed. We shall see how it works out. biggrin.png

Quote from Manila Visa unit...."The contract between Sponsor and Household member (Form I864a) is used in conjunction with the sponsor's Affidavit of Support (I-864) when a sponsor is using the income or assets of household members in order to meet the statutory income requirements of INA Section 213A".

"If the joint sponsor"s income meets financial support requirements, he/she need not provide a Form I-864a".

I think in your case, because he added in the wife's income, they are now requiring the I-864a from the wife, or his name and income was added in Part 6 line 6a

I should find out soon if what they said over the phone and email is going to fly.

Good luck to you on your visa.

Hi Sir! I just wanna ask since you're case is now approved after being given 221g. My husband and I are going through the same problem with the 221g, they're asking for evidence of sustained income, and to find another joint sponsor since our sponsor (his sister) did not qualify cuz her income of $21k was based through her pension. So now on my interview they asked me to look for another joint sponsor, and now my sister (who's married to an american too, and she's working as an LPN) will be our joint sponsor..

I wanna ask you based on your experience on how long does it take for you to be approved soon as you submitted the documents? And will there be a big chance of still being denied?

I just wanna make my case clear on why I got a 221g.. My husband had been unemployed for the past 3 years and was now rehired by his previous office by 17 years for the same position, he started just last June 2013, and we thought that based on his salary we will be okay of being approved since he will be getting at least $41, 600 per annum. But i guess the consul was not happy with that. And along with this new job, we also had to have a joint sponsor when we applied for my visa last year cuz of his unemployment status.

So now we got this 221g and we are wondering as to why since he already has a job and his salary actuallly qualified on the 125% poverty guidelines.

I told the releasing in the embassy that I got all the evidence for a sustained income with me that day, his cert of employment, offer letter, and 6 pay stubs... But the guy just told me to just comply with what the consul was asking.

Thank you! i hope to hear from you, I really wanna know how long this will take for us soon as we submit the requirements they are asking.

    Sarah

  7. I had my interview last April 18, 2013 and shockingly I was given a 221g form asking for a joint sponsor.

    They needed the ff documents:

from a qualified joint sponsor ANYONE

    * Affidavit of support with original signture

    * U.S Federal income tax return(s) for year(s)

    * W2 form(s) for year(s)

    * Form 1-864A from joint sponsor and spouse/co-resident with original signatures

    * Evidence of U.S citizenship or status as lawful permanent resident

    * Evidence of current sustained income

Do you think it's fine if I will be sending them scanned copies only of i-864, i-864a, w2, itr and stuffs? Should my husband needs to fill out another i-1864? because it'll take a week if my husband will send it via mail and I already have my ticket..date of departure will be on May 31, 2013. We're both really worried. I hope to get a fast reply from here. Thank you so much in advance

Hi ! I just wanna ask cuz I had my interview last Sept. 4, and i got the same 221 g and same reason with you. How did your case went so far? how long did it take you for you to get your visa soon as you submitted the documents they're asking? And did they approve your visa? I;m wondering how long it'll take too. Thank you

  10. Hello everyone here in VJ!

my husband and I are currently waiting for our case to be complete at NVC and I have a few questions that I hope you guys can help us, i;ll just list it here:

*We wanna know how we'll get an interview/ medical date here at the US EM in Manila. Do they send the packet 4/ appointment letter through our local post office here? or they use private courier like 2go, air21 or dhl.

*And will NVC notify you that you'll be getting your schedule via mail and that will they let you know as well once your case is complete with them?

    Thank you in advance!

  11. Yes they really asked that. It makes no sense to normal humans but CFO doesn't seem to apply logic to what they are doing there.....

I can understand how you feel. And we appreciate you sharing your fiance's experience with CFO. But I'd like to ask again, cuz my husband and I are confuse about what to present to them with regards to the financial documentation or affidavit of support, is there any kind of form that he needs to fill out for this?

Thanks so much again for being informative on this.

  12. They can really ask for anything they want to ask for at CFO. And CFO in Cebu is very bad from what I've heard. My fiance went 1 day a couple of weeks ago and wasn't early enough to get 1 of the 12 spots. Then she went back a 2nd day with all her papers and they asked for a bunch but there was no copy machine. She said the 1 on 1 counseling sessions are an hour now and the lady asked her all sorts of silly questions. What was she wearing when she met me? Things like that. The lady doing her 1 on 1 counseling also tried to do the job that USEM is doing - verify my income and ability to support my fiance. So she wanted all of my financial documententation haha. Goofy.:bonk:

They wanted her to come back a week and a half later with a lot of papers copied but she was able to negotiate an earlier appointment and return for the _third_ time to finally get through the CFO requirement. She said there were people reduced to tears at CFO Cebu.

The CENOMAR I'm almost certain they will want by the way.....but you might as well bring your entire Visa packet and every paper you have.

thanks!! i was suppose to go tomorrow and attend the counseling on Thursday, but I decided to check more about CFO here on VJ, cuz i was really concerned bout the CENOMAR, if i'll need that or not.. but i might wait till Monday next week to go, and just check thoroughly on the requirements cuz i don't wanna go on a wasted trip and spend a lot on the fare and expenses there. .... THANKS SO MUCH FOR THE HELP,,,

But did they really ask your fiance to show them a copy of your financial documentation? or anything related to that, like the affidavit of support or the i-394 (not sure of that 394 though)?

  13. Hi! i'm new here, i just wanna ask more bout the CFO counseling, will they need a copy of CENOMAR? we're already married i have that copy when we applied for our marriage license, but i wasn't able to make a copy of that for us. SHOULD i really need to get a copy of that from NSO for the counselling?

    Thanks so much !!

  14. Hi! can anyone help me about some "other supporting documents" that cfo lists on their website for the requirements.. We're applying for a CR-1 visa, and i;m currently on the process of applying for my passport. But DFA here says to get/attend a GCP at CFO. I wanna know too if i'll still need a copy of our CENOMAR, i had this document but i had submitted it for our marriage license and i was not able to make a copy of that. SHOULD i be needing this document for CFO counseling? We're already married, and i have with me our NSO marriage certificate already.. This CENOMAR is the only document that confuses me with regards to this. But if there's anything else that you guys can suggest, I would really appreciate it.. THANKS so much !!!
