  1. The other comments are correct. There is no correlation between the expiration date of the K-1 Visa and the AOS. My fiance received her visa Nov 3, 2013 and it expired May 3, 2014. She arrived here in the USA Feb 12 and we married April 12 so only 60 days for the marriage. I sent her I-485 app and her EAD to Chicago on Sat 26 by express mail with signature confirmation. It was received on April 28 (Monday) and I got a copy of the receivers signature by email from the USPS. However, it is now May 8 and still no confirmation that the documents have been received nor have they cashed my check for payment. The UCSIS site says Chicago receives 1000 apps for I-485 per week so I guess it takes a bit. The same site also says right now its taking 10 month to complete the process. They are just completing apps from July 1, 2013.

    Id be curious if you get a faster reply than I have so far. Oh and BTW we did the electronic notification form too but so far nothing.

    On August 27, 2013, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

    For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

    Congrats! Mine I-129F for my fiance in Peru was approved in 62 days. One month is amazing!!

    I originally submitted to Texas but I think it got transferred to California but Im not sure. The NOA2 stated California and said our petition for fiance visa had been approved and was being forwarded to the consulate. So Im thinking that means it has left California. BTW it was dated August 14 so we are anxiously awaiting word of her Interview date.

  3. Can anyone tell me if Im allowed to attend the interview in Lima, Peru with my fiance? Seems like Ive read a few post where the petitioner has attended with his fiance but some sites Ive looked at say no. Also does anyone know how long it takes to get your visa once you have passed the interview with the consulate in Lima? This would be helpful to know so I can start thinking about when I will travel from US to Lima to bring my fiance back with me and if it can all be done in one trip (interview and travel). Thanks and good luck to all.

  4. Hi everyone. My gf who is 42 and lives in Lima, Peru was denied a tourist visa based on the 214(b). Seems she didnt prove she had strong ties to Peru. She had letter from her employer who she has been with for 15 years and I wrote letter saying I would be responsible for all her travel expenses on my company letter head and had it notarized. She took photos of us together and copies of her pay checks. She does not have a bank account (and they didnt say one was required). She rents a small apartment with her 70 year old mother. She has one brother, 2 nieces (32 and 30) and no children, no real assets.

    My question is would we be wasting our time with a new application if she were to try harder to convince the consulate officer of her family ties, and really emphasized her 15 years of employment? She doesnt make alot of money compared to US standards but im guessing most in Peru dont.

    Here are some of the questions she was asked:

    Why do you want to tavel to US? to vacation

    How long will you be in the US? 2 weeks

    Who do you know in the US? my boyfriend

    How long have you known him? Since June this year.

    Have you met him before now? Yes in August here in Lima

    How did you meet him? Internet

    What kind of work does he do? Engineering

    What kind of work do you do? Graphic designer for 15 years with same company

    How much money do you make? ( i am withholding that answer here for privacy but its not alot in terms of US dollars)

    At this point she was told she was being denied. So, has anyone got any suggestions and/or experiences with getting approved the 2nd time around in Lima?
