  1. Hello everyone,

    I've been married with my wife who came with a K1 visa for over one and a half year. She currently holds a green card that will expire in 6 months. Unfortunatelly we have decided to divorce, this is our situation: We have no kids, no assets and she wants to leave the U.S. as soon as possible, so does she has to wait until the marriage is granted by the court? and, do I need to fill up any specific paperwork for this kind of situation with the USCIS? or jut leave the green card expire?

  2. Hello Everyone,

    After applying for AOS and waiting for more than 3 months to get the interview letter, we received a letter stating that "USCIS has identified your application as a potential interview waiver case". That's the good news, the bad news is "Due to workload factors not related to your case, USCIS anticipates a delay to be approximately 6 months from the date of this letter"

    Does it mean, we already waited for 3 months, plus 6 more = 9 months??

    Does anybody received this notification? Could you tell in your experience what can I expect during the rest of this process and timeframe?

    I recently married my fiancee who entered with a K1 visa. I already submitted all the paperwork required for the AOS and we have appointment date for biometrics. My question is, before arriving into the U.S. she was in the middle of a litigation process she started due to a medical malpractice in her country of origin and se may need to go back to testify soon. Is any chance she can leave the country to address this matter? or does she has to wait until the green card is issued? I know there are exceptions, but that is for family emergencies and don't know if a lawsuit can be considered an emergency.

    I'd appreciate any feedback on this matter.

    I'm preparing the AOS package and just want to confirm whether I need to send two checks: one for the amount of $1070 for the I-485 fee and a second one for the amount of $380 to cover the I-765 fees for Employment authorization.

    Asking because in the past the I-485 fee used to cover also the I-765, but looks like this is no longer the case.

    Any input would be appreciated.

    I'd like to tahk you all for the help provided in this long and winding road. My fiancee got her K1 visa approved and she is comming to the states on September 30th. Wish luck to all my fellow petitioners and I hope your case gets solved soon, I waited from November 20th, 2012 (date when I-129 package was sent) to September 9, 2013 when the interview took place and the visa was approved. Fortunatelly, all those waiting months paid off.

    We are preparing the forms to be sent to the embassy. My fiance was married and then she divorced. I realized that the DS156K form requires to attach the marriage decree and the Marriage certificate. She has the divorce decree but not the marriage certificate. Is the marriage certificate absolutely needed even if she produces a divorce decree?

    After 6 and a half months, NOA-2 received just yesterday!!!!!! WooHoo!!

    Now thinking on the interview, I would like to know what kind of documents should I include to probe financial status. I have a checking account, a brockerage account, a roth IRA and a traditional IRA. Can I just include the latest monthly statements of these accounts or do I need a letter from these institutions stating amounts, date when the accounts were opened, etc. etc?

    Also, since I have a good credit score I was thinking on including a copy of the last score, so do you think that would help or that's irrelevant?

    I tried the USCIS change of address website but looks like the AR-11 form is used for someone in the U.S. that is changing address within the U.S. (the petitioner). In my case, my fiancee (the beneficiary) is changing address in the country she is living (Spain), that is the change of address I need to declare as the I-129F was filled with her now former Spain address. However the AR-11 form in the USCIS is tailored for US addresses.

    Please correct me if I am wrong.

    My fiancee is ending her lease on the apartment she's currently living and the address of that apartment was stated on the I-129F form. By now, we already received NOA1 and we are wondering whether starting a change of address procedure with the USCIS will delay the next step (NOA2) and the visa whole process. Since the apartment is on her friend's name who will be living there, she will be able to receive any mailing sent to that address. Alternatively, we were thinking about requesting a change of address service from the postal office so that all mail sent the current address would be forwarded to her new mailing address.

    We would like to hear about people who faced a similar experience or who may know what would be the best thing to do.

    I'm filling up the G-325A form posted in both the USCIS.GOV web site and this forum, but at the upper right corner of the form it reads "Expires 08/31/2012". I'm afraid of sending it today (11/4/12) just to find out that it's already obsolete. Could you please advise on whether this is the right form or where I can find the latest one?

    I'm a bit confused with something that may be quite simple. I read in a government web site (http://travel.state.gov/visa/immigrants/types/types_2994.html)that for the interview at the embassy, the beneficiary should bring forms DS-156, DS-156K and DS-230.

    However, the K1 guide provided here (http://www.visajourney.com/content/k1guide) doesn't mention any of these form at all. Could you please clarify whether these forms are needed? If so, at which stage of the process should they be filled out?

    I'm preparing the first set of forms required for the K1 visa and I'd like some advise on how to fill the Applicant's employment last five years in the G-325A form. My fiancée lives in Spain and most of the time she has been a self-employee. My question is, should I fill the form stating that from X to Y years she was a self-employee? If so, should I give details on where or for whom she worked? Is it required to prove every single place where she worked in the past even though she may not have a written proof of past jobs?. Or, could it be better to just state that she was unemployed? I'd like to take the approach that better describes her employment situation and avoid statements that may jeopardize the process.

    Your kind feedback would be appreciated.
