  1. Hi, good luck! so your husband is bringing your kids? are they your children both? that's no problem if they are both your kids. just bring the documents that he is the father bringing the children to the USA.

    But if the 2 kids are from your first marriage you have to get from DSWD a permit, bringing minors to the US.

    Hello Everyone,

    I'm a K1 visa holder living in the US for 10 months. My children in the Philippines just received their US visa. My husband is planning on going to the Philippines and bringing them back to the US. He will travel without me. Is he allowed to pick them up and bring them back to the US without me? Are there any US or Philippine requirements for doing this? My children are 12 and 8 yrs old. Thank you for all your help.

  3. There is another couple that just recently posted on VJ also about not having their certificate of finality before filing the 129f petition. And there is another couple that got there petition returned to USCIS by the embassy in Manila because her annulment was not completed before they started the 129f petition, which is a denial by USEM. Free to marry means just that, if you were to re-marry in the Phils and needed a CENOMAR from NSO would you be able to get one before the certificate of finality? Therein is your answer, and I think it is NO. If you were NOT free to marry BEFORE filing the 129f petition and USCIS approves the petition odds are USEM will deny and return the petition to USCIS.

  4. The United States Embassy in Manila recently launched a "Walang Sikreto" (No Secret) campaign to let Filipinos know that there is no secret formula to getting a US visa.

    In an email to GMA News Online, Tina Malone, Information Officer of the US Embassy, said: "There really is no secret or special formula to getting a US visa."

    The "Walang Sikreto" campaign, launched on October 16, aims to deter fraudulent individuals who are preying on Filipinos applying for a US visa.

    The campaign aims to make Filipinos aware that the official and best source of information about US visas is the website of the US Embassy.

    Malone said the embassy launched the campaign because Filipinos fall prey to scammers as they try to get a US visa.

    "Too many Filipinos get scammed by sending money to individuals whom they have never met, who promise to arrange visa interviews, but the visa interview never materializes," she said.

    Visa fixers

    Malone said in the past, the US Embassy focused its efforts on catching visa applicants who have used visa fixers.

    In most of the cases, the applicants borrowed money to pay visa fixers but did not receive a visa.

    However, the US Embassy realized that it was better to get to the root of the problem.

    "[W]e have decided to emphasize greater prevention in protecting Filipino applicants from losing their money and becoming permanently barred from traveling to the United States by using visa fixers or being scammed," Malone explained.

    "Walang Sikreto"

    In an earlier news release, the US Embassy said the "Walang Sikreto" campaign has four goals:

    To encourage "honest application" when it comes to seeking a US visa;

    To warn against "visa fixers" who charge illegal fees;

    To urge the public to be more aware of fraud, and

    To send a call of action to the public to seek more information and report any anomalies in visa operations.

    Most of the targets of visa scams are tourists, students, and aspiring temporary workers who are usually gullible to "surefire formulas," the US Embassy noted.

    What to avoid

    Malone warned the public that if something "sounds too good to be true, it isn't true."

    She said there several scamming styles but one stands out as the most common modus operandi.

    "An individual, "a friend of a friend," or a travel agent promises or guarantees to get someone a U.S. visa. The visa fixer charges the individual 20,000 to 100,000 pesos or more to help the individual," she said.

    "In many of the visa scams you will never meet the person. All contact will be through the phone or e-mail," she added.

    Malone also mentioned that visa fixers usually claim to have a contact inside the Embassy who will help you get your visa.

    "Don't believe them!" she warned.

    "In the end, the visa applicant [who trusts scammers] loses all of his or her money and ends up being banned permanently from traveling to the United States," she said.

    To prevent being scammed, Malone said applicants should go to the embassy website and use the information and resources there to apply for a visa.

    "The US Embassy wants to help you in this process. Use our Embassy website manila.usembassy.gov to apply for your visa," she said.

    "Help us help you by being honest in applying for your visa," she added.

    "Do not use an agency or individual who makes special promises or guarantees to get you a visa or encourages you to lie or misrepresent yourself," she said.

    can i asked you some question maybe u know somebody had the same situation like mine... :) I am so worried about our petition.. I just wanna ask if there's someone here who got a RFE from VSC for NSO annotated MC? I was annuled, i included my court decision on our petition and we had NOA1 april 23. Court decision dated March 20,2012, Certificate of Finality July 2, 2012 and Annotated Marriage Certificate from NSO they put the court decision March 20,2012.. They never put the date of Certificate of Finality on NSO annotated MC... Do you know of a situation where someone from the philippines was denied because their certificate of finality was after the NOA1 date? I posted here on Vj a week ago and everybody was keep telling me that my application is subject to denial because im not free to marry yet.. Makes me stressed out, depressed and so sad after all the waiting, i'm just expecting the denial from the USCIS.. Court decision declared my previous marriage as null and void and signed by presiding judge. We thought that was fine and i just have to bring all other required documents (Certificate of Finality and NSO Annotated Marriage Certificate) to the interview. Please any help info would be greatly appreciated... Thank you.. :)

    How are ou and your wife? i hope your wife is feeling better now.im doing fine,getting used to their culture here hahahaha,well,my in laws also lives here in Florida,10 minutes drive from our house here,they are very nice,but im kind of shy at times hehehehe.my daughter continues here Taekwondo martial arts training here in Florida,i am glad the master likes her performance and she is going to compete in Orlando next week.my only complain is the tuition is so expensive compare in our country...here am i again,converting dollars into peso and complain how expensive here in the U.s. :rofl: ,my husband always tells me don't compare peso into peso hahaha..

    Oh,we are waiting for our marriage cert.in mail,then that's the time my husband will file for my AOS,he will talk to his atty.my question is,once we got married,i don't need to worry for my 90 days period visa no more right?? or needs to file AOS before the expiration of visa? confused :unsure: , well!!! We filed k-1 visa and got NOA1 april 23, the nbi clearance that i included to application and the name i used to my passport is my full real name since i never use my x-husbands last name even when we are married and i put single since i am processing my annulment that time and soon to be as single.. You think i will get deny because of putting my civil status as single? Was thinking that it was okay since i am applying for K-1 visa and needs to be single.. I also included my court decision w/o certificate of finality. They say i'm not free to marry yet.. But the date on my Annotated Marriage Certificate from NSO is the court decision date, though the certificate of finality is july 2.. Do you know of a situation where someone from the philippines was denied because their certificate of finality was after the NOA1 date? or because the passport is single and the nbi clearance is single?   7. sorry for not being clear with the AKA, my fiance's birth certificate have different last name from the NBI, example. on her Birth her name is this "jenny lyn d**** eva***" then on her NBI "jenny lyn d**** bal******", she is now leaving with step dad. on her birth cert she have the real dad last name and she is a late register, and on nbi she have the step dad last name, we received the 221g NBI WITH AKA, they just wanted a new NBI WITH HER 2 names, jenny lyn d e aka jenny lyn d b...

    does this make sense??

  8. In your case I would say give USCIS what they ask for - the NSO annotated MC, then cross your fingers and wait. Not sure they will go by the court date of the NSO date when determining "free to marry".

  10. Just recieved a request for evidence (RFE). My fillipina fiance was previously married and we hired a lawyer and recieved a judgement of annullment. I sent the court judgement with my application.

    The RFE says they recieved the judgement and it is ok, however they are asking for a document from the National Statistics Office (NSO) substantiating the annullment. They are also saying the document must have a "Court documents and Legal Instruments endorsment"

    Has anybody had to get one of these? It sounds like it should be easy but I don't know.

    Any advice would be appreciated

    Dean_De has correct answer! :thumbs: Having a court judgement / finality of the annulment is not enough. It has to be annotated in the previous marriage contract. Also, this must be printed out in security paper issued by NSO.

    Correct. The annulment is not complete until you receive the annotated marriage contract from the NSO. Until duly registered, the person is neither free nor legal to re-marry, which is one of the requirements of filing for a K1 or spousal petition.

    Most attorneys consider their work finished when the Decree of Annulment is issued by the court. The registration of the Decree with the LCR's and NSO is typically left up to the client to accomplish on their own, as it basically involves the transportation of documents from one place to the other. (and about 6-8 months)

    Often times these final "do it by yourself" steps are not completely understood by the client and immigration petitions are filed prematurely, and even civil marriages have known to have been performed prior to receiving the annotated NSO. In the later case, overlapping dates of marriage appear on the CEMAR/CENOMAR which causes big trouble at the Embassy, more delay and attorney fees to straighten out.

    NANCY & DAVEY: RTC = Regional Trial Court. equivalent to County Civil Court in the US of Ache.

  11. Your petition will be denied. You were not free to marry at the time you sent in the I-129F, and that is a requirement. You could withdraw the petition now and file a new one now instead of waiting for the denial before starting again.

My fiancee and i decided to just wait until next week since its almost 6 months and see if we get RFE for certification of finality or get denied, its not that long to know about it anyway... Good news/Bad news my fiancee will go to our attorney and we look at options.. We never found it easy to be in a long-distance relationship...but when we've found each other and we wanted to spend the rest of our life with, never :no: felt that we had any choice except to find a way to be together, and stay together. :)

  13. Yes, Finality or Entry of Judgment states marriage is Void ab Initio (will be last docs you'll get from the court). They'll also annoted your original Marriage Certificate with Null and Void. Then you'll take to the Local Civil Registry to get the Certified Copy. It doesn't end there, you'll need to take those docs to NSO where they transfer the Marriage Certificate to a special paper. These will take up to a month or more to process. If you haven't done all that or if you've hired an Atty to do it for you then techically you're not free to marry and you're not eligible to file I-129F

    Good luck, USCIS and NVC might overlooked it but USEM will catch up (I've seen it happened to a couple of members here recently) and will give you automatic denial even after you've paid your visa and medical fees.

    I got my Certificate of finality and annotated MC from NSO done last july 2012.. Our application accepted April 23. So sad to think that our application might be subject to a denial.. after all the waiting :(

  14. We just got our Petition approved and we sent

    1) Court Decision (signed by judge)

    2) Certificate of finality

    and

    3) annotated MC from NSO

    and got no RFE's.

    Keep in mind that hopefully the date of Certificate of finality is dated before the date of the petition. There have been some cases where people have run into problems because they were not free to marry because their Certificate of finality was issued after they filed the petition.

    Example my loved one's decision was issued Oct 10th,2011 but her Certificate of Finality was issued Jan 29th,2012 so we filed in Feb. Because the court decision is just that a court decision. The annulment is not final until the Certificate of Finality is issued.

I was annuled, i only included my court decision on our petition just to save some months waiting while processing the other annulment papers that i need. Our application accepted April 23. I got my Certificate of finality and annotated MC from NSO.. Just wondering is that the final paper that USCIS need? :help: I kinda worried that i will get RFE for that. :unsure:

I myself was annuled we only included my finality and court decision on our petition now i get worried we will get the same RFE..but anyways if she has already her finality she can go to LCR where she got married to register it will take around a week, then bring those documents from LCR to NSO east avenue quezon city it will take three weeks from there, then bring the NSO annotated MC to RTC for the final decree, approximately will take a month to complete everything...goodluck!
