Hi! Thanks, that's what I thought too! But, for which Visa is I-485 designed then? Only for K3's?

One thing I noticed is that most of the immigration lawyer websites use form I-485 rather than consular filing when filing for a green card. I'm an LPR myself and have plans to file I-130 for my (foreign) spouse, but am debating how I could get her in the US so we'd have to spend less time apart (even if not allowed to work). It says that the requirements for using I-485 are that you entered the US legally, but I think entering using an ESTA might look very sketchy and might get us denied. What would be the correct visa to enter the US that form I-485 is designed for? That is the part that confuses me.

So H1b is an option, I read there's only 65k of them a year and there's 250k applications. Does that mean that his chance would be roughly 25%? Is there any way to increase that?

How about an EB2, would he be eligible for that?

Is it correct to say that the first thing to do for my company would be to hire an immigration lawyer? I've only done an CR-1 so far and I've done all the work of it myself. I assume that's not possible with an H1b/EB2?

I immigrated from The Netherlands to the USA a few years ago and started working at an IT company. We are constantly hiring new people so I recommended one of my old classmates to my boss. My boss was interested after reading his resume, since we have a high level of skill. The position within our company would be a Project System Administrator level III. Some information about him:

• He has a bachelor of science in Network Infrastructure Design.
• He started working in IT around 2009, but didn't graduate his major until January 2013
• He has been working full time in IT since he graduated.

He would be willing to relocate here, permanently. IS this possible? Which category of visa should be we thinking of? What would be an estimated timeline?

I got the exact same RFE today, planning on calling the NVC this afternoon to ask for clarification. Hope we get a supervisor to look at it aswell. I'm glad I found this post, because I was getting a little worried.

I wanted to add 2011 - Not required to file, 2010 - Not required to file, 2009 - Not required to file. But that didn't fit. So I just added 0.00, and will add a written explaination as attachment to the document.

I'm currently filing out the I-864 and my wife doesn't have tax returns. She has been a student and working on the side for her dad in 2010 and 2011. She lived abroad with me, as an exchange student, in 2012. The accountant of her dads business said that she doesnt have tax returns because she was claimed as a dependant in 2010 and 2011, and because she didnt work in 2012. So, her dad filed out a I-864 to sign a co-sponsor.

But we still need to fill a I-864 for her right? So we're filling that out right now, but now I'm wondering what I should enter at question #25 Federal income tax return information? Do I fill in the years 2012, 2011 and 2010 with $0? Or do I just skip it all together? I certainly don't have to check any of the checkboxes right?

I'm going to add a letter to explain it, but I'm really wondering what I should do on the form. On the one hand, it's asking for Federal income tax return information so I'm thinking I should skip it. On the other hand I've read that you should never skip a question. I really don't want to get an RFE over this. What do you advice?

I got one too, I was a bit worried at first as well! But now I see that everybody got it, and I read on the NVC website that it was regarding a new rule I'm guessing we can safely disregard it.

I just made the portfolio too, and guess what? Apparently my case had been transferred to NVC on 12/12/12! Somehow I never got a NOA2 by e-mail though, that's weird. When I added my case number it said "N" at e-mail notification, while I did receive NOA1 by e-mail. Oh well, I'm just glad it got transferred to NVC. I got a weird e-mail from NVC though, don't really think it applies to me.

I haven't been to the US since I started the visa application (and before that I haven't been there unlawfully). My wife went back for a week over xmas, but since she's the USC she was obviously there lawfully. She's back with me in Holland now. Can I just disregard this message?

I see now that the VJ timeline calculation also predicted the NOA2 dates (19 Dec. - 26 Dec. for me, as opposed to 21 Dec. - 2 Jan.) Difference is that the VJ timeline takes an average of all NBC cases where I stripped out the special cases. Also, I increased the range for later filers because the further you predict the less chanse you have of predicting it right. So for now I'm gonna go with mine instead of the VJ one

Hi fellow VJ'ers,

I calculated a rough NOA2 date for September and Oktober filers who got handled by the NBC (normal cases, no expediting). The dates are based on the information in the VJ timelines. Please note that this is just for fun, it might not even come close to the actual dates. Let me know what you're calculated date range is! Then we can see if the calculations were correct.

September filers: NOA1 date + 76-82 days

October filers: NOA1 date + 72-86 days

My NOA1 date is 10 October, so its:

10 October + 72-86 = 21 December - 2 January.

So that would be the range in which I would receive my NOA2 according to this calculation. Again, it's just for fun cuz I like playing with numbers Have fun!

Same boat, except I did get the e-mail. No text though.

What I was thinking is combine things to make specific situations. For example:

1 question: What is your situation?

- USC abroad, NBC right away, No field office

- USC not abroad, NBC right away, No field office

- USC abroad, Field office

- USC not abroad, field office

Just an example, but then with all the possible options there are. It will be a long list, but we can see which combinations will go together and which ones won't.

Good idea! Because I'm quite confused about it right now. Seems like we're in the same boat, my wife (USC petitioner living abroad) applied from Holland and we got the same message:

Your case has been accepted and routed to the USCIS National Benefits Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number MSCXXXXXXXXXX. With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your case using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.

We received I-797 about 3 weeks ago. My Case Status doesn't work for us. Did your case number also start with MSC?
