    I was also wondering will it be ok to file 2010, 2011, and 2012 as "Married Filing Separately" as getting an ITIN for the foreign spouse seems to have become so hard these days since june this year (2012). IRS wants you to send the original passport for foreign spouse. And I'm worried if the passport is lost, it will create lot of issues down the line to get the visa.

  2. Hi Board, I'm kindoff worried about my recent income for sponsoring my wife. Here is my situation:

    I was not here in USA for 2010 and 2011 for some family reasons.I got married on 2010 and a child was born (CRBA) on 2011.While being with my family I worked there for 2010 and 2011 and made almost $7000 and $5000 respectively (Also mentioned the job in filing I 130).I came back to usa on 2012 and so far made little over $24000.

    Do you think I need to file for 2010 and 2011? In case I'm required to file, can I do "Married Filing Separately". The reason I am asking this is getting an ITIN for my wife seems to be a big hassle now.Also can I do the same for year 2012?

    Will filing taxes as "married Filing Separately" create any issue for getting the visa for her?

    And the last question, with my situation do u think I need to get a co-sponsor?

  3. Hi Board, just a quick question. After I 130 is approved, looks like NVC contacts you through e-mail. Where do they get the e-mail ID from?

    Do they get it when USCIS transfers the file to them after I 130 approval that was provided in the I 130 package?

    Or I've to give it to them by filling out some other form first?

  4. I'm a USC. Recently I applied I-130 for my wife. While the application is in pending, I'm trying to get prepared for the next step.

    For family reasons I had to stay outside usa for a while (more than two years).I got married there and also a Child is born.The child was approved US citizenship. I just came back middle of this year and started a job which will help me make more than the poverty level income for a family of three for this whole year.For last two years I made around $7000 a year back in my native country.

    I'm kinda hesitant taking someone's help as a co-sponsor if I don't have to.

    My question is, does immigration care for last three years income or the most recent one?

  5. I recently applied I-130 along with G325A for my wife. After almost two months I got a RFE. It has two pages..

    The top is a Blue page that says my name, receipt#, beneficiary's name etc and says a deadline to send the RFE back to Laguna Niguel, California.On the other side of this blue page, it has some additional Information for Applicant and Petitioner.

    The second is a white page that has writing on one side only. It says:

    REQUEST FOR EVIDENCE

    *Each petition must have its own set of supporting documents in the event that multiple petitions become separated. Also, each response to a USCIS request must be accompanied by its blue I-797.

    *All foreign language documents must be submitted with complete word-for-word English translations. The translator must certify that the translation is complete and accurate, and that he or she is competent to translate. Do not submit the English translation without the foreign language.

    Then there is a solid line __________________________________________________________ and underneath the line it says:

    FOREIGN DOCUMENT : The petitioner submitted an English version of the Nikah Nama. As such, he must submit a legible copy of the Nikah Nama in its original language.

    My question is , so I just submit the copy of the Nikah Nama in my native language with the top blue page?

    By the way, they also included an white envelope inside (with return address marked in RED). Looks like I need to send my evidence in that envelope. Is the postage already paid for this? Or I need to add postage to that?

    I greatly appreciate your help on this...

  6. Hi all, great discussion board.

    I recently applied for my wife (I130 and both G325A, mine and hers). I just got an text message on my mobile mentioning an Update has occurred on my application. When I called USCIS, they told me they just sent me an letter requiring additional evidence or documents but the representative was unable to tell the contents of the letter.This has put me in great concern not only for the RFE but also because I'm out of town for job reasons.

    Can anybody tell me what should the letter look like, so that I can tell the person who checks my mail. I greatly appreciate your help on this.
