  1. This is a very old post, but I think I need updated info on this... Anyone can offer their comment, please?

    I have a name discrepancy on my passport vs my GC...

    I was married to a USC when I applied for GC, now when all that was done (thankfully didn't encounter problems), I had to renew my PH passport with my married name (conveniently, it was expired). Apparently the Philippine law states you HAVE to use your old surname as your new middle name, and that's what the PH consulate emphasized when I applied for my new PH passport. I wasn't aware of that when me and my husband signed our marriage registration forms - I didn't move my surname to become my new middle name (I kept my middle name as is).

    Here's a representation:

    1) Maiden Name: Name MidName Surname
    2) Name on GC: Name MidName Surname2
    3) Name on Passport: Name Surname Surname2

    In hindsight, I know I should've thought of that more, but I'm concerned about my travels from PH back to US (to visit my family in PH) - what do I have to present to the US immigration officers when you re-enter the US, besides the GC? Will they fuss about why my PH passport name is different from my name on the GC?

  2. Does the Middle Name in GC need to match Middle Name in passport when travelling during a conditional LPR status? I think I've posted about this mismatch problem before. Was never resolved though I tried to contact USCIS...

    So long story short, I'm travelling for work this Spetember and these 2 ID's don't match. It is the same pre-marriage middle name on my GC, and my maiden lastname on my passport. Will there be issues in re-entering?

  3. Hi-

    So my conditional GC is valid until November 2015. I am just about to submit my I-751 application with waiver due to divorce. Depending on how efficient my lawyer is, I am guessing USCIS will officially get my complete application before the end of July.

    Just learned that I need to travel abroad for business for a week this September. Will there be any issues if I don't receive my NOA or have my biometrics by this time?

    Also, my divorce decree includes a name change order. Will this affect the validity of my GC?

    Any advise is greatly appreciated.

  4. I am considering keeping my passport in my maiden name instead of either traditional Filipino married name format or the ill-advised USCIS format.

    My question:

    Do I still need the ROM if not changing to married name? If no, can I declare my civil status as "Single"? (Just for the convenience of maiden name = SINGLE).

    I plan to file for ROM and new passport in the traditional married name format eventually, after USCIS corrects my Greencard.

I had all of those (SS, Drivers License, insurance, grad school registration records, etc) in my traditional Filipino married name format until the USCIS said it was "not allowed" (which confused me given that my EAD and AP co-filed with my AOS were approved weeks prior without issues). Upon Greencard issuance, I changed my name on all those documents so they are consistent with Greencard. Now I am pulling my hair out learning that my passport cannot bear my name as shown in Greencard.

  6. With regard to Question #4, all documents (AOS, EAD, AP) were filed using traditional Filipino change of name. No issues/RFE's prior to Greencard issuance etc, all of my NOA receipts (even EAD and AP, which came before my AOS interview) were approved and I have my new married name on them the traditional Filipino format. However, the USCIS officer who interviewed us made a comment as soon as he signed the AOS approval that I shall continue to use my old middle name, and that will be on my Greencard. He said without giving us really any chance to argue that I am only allowed to change my last name and not the given or middle name. For this reason I had inconsistent names on my SS, drivers license, insurance, etc but didn't feel like the officer was making a mistake until today.

    UGGGH.

  7. Hi all, I have a few questions.

    Background info:

    -Married in AZ last year (LA Consulate's jurisdiction)

    -Both with no prior marriage

    -Planning to file ROM and passport renewal application simultaneously in person

    1) I read that if filing after 30 days of marriage it is more complicated? How exactly is it different/more complicated?

    2) In the ROM form, should wife's signature be her maiden or married signature?

    I ask because the other particulars asked in the form are pre-marriage info (like premarriage civil status, address, etc) plus they might want to compare signature on the form and on marriage certificate. On the other hand, they might want the married signature as it just makes sense to sign the present signature.

    3) Which passport application forms to use: http://www.philippineslosangeles.org/uploads/pdfs/passport.pdf OR http://www.philippineconsulatela.org/Forms/epassport.pdf ?

    4) In the passport renewal application form, I am putting my full married name as it appears on my Greencard. The format is <First name, Old middle name, Husband's lastname>. I was not allowed by USCIS to use my maiden last name as my new middle name as that requires a court order. Will there be any issues with Philippine embassy? Is there anyone here who successfully got their passport in the format <First name, Old middlename, Husband's lastname> ? I ask because another thread here says the Philippine Consulate only follows their traditional format <First name, Maiden lastname, Husband's lastname> but that will cause a lot of problem keeping differing ID names.

    5) Philippine consulate website says no need for appointment, walk-ins only. When is the best day and time to go? How many hours/days should the ROM and passport application take? I just want to know what to expect, so I can plan the trip better.

    6) What documents need to be notarized?

    7) How will they return original documents presented, on-the-spot or by mail? Please tell me it is on-the-spot! Mail services aren't very reliable in my experience!

    I guess they overlooked it somehow and proceeded to approve it... EAD card in production now. Funny thing is I got multiple e-notifications re my case status update for EAD and AP last week with my I-131 being approved and co-filed I-765 getting a "name update" only, whatever thst means. Long story short I was not expectinh the EAD approval but of course I'm so glad and relieved that I got it.

  9. Btw I filed this I-765 concurrently with my AoS and AP. I just got another text saying the AP was approved. My understanding is that they issue a combo card for EAD and AP when you filed them together unless one of them was not approved.

    In case my EAD is denied, is it advisable to reapply if my AOS interview is already scheduled for 11/13 or just wait for GC?

  11. Glad to see there are already a lot of EAP approvals from mid-August filers. Congrats!

    Anxious to hear about my work permit application status... Done with biometrics and no RFE so far, but I made a serious error in the application form (stupid typo on critical Question#16 of I-765) which will most likely cause a denial. If that's the case then I wish I get the denial confirmation ASAP, so that I could re-file while my AOS is pending and avoid the fees. AOS interview is on Nov 13th.

    Anyone in a similar case? Any thoughts?

  12. Hey guys, my son and I (K1/K2 adjustees) just got our ASC Appointment Notice informing us of our biometrics schedule on 9/13/2013 at the Phoenix ASC. Unfortunately we are all going to be away visiting family in the east coast and my husband suggested we reschedule. I followed the instructions on filing the request for rescheduling-- mailed the original notice letter which has the request form to the ff address:

    BPU, ALexandria ASC, Suite 100, 8850 Richmond Hwy, Alexandria VA, 22309-1586

    I put the forms for me and my son on separate envelopes, correctly labeled and addressed. However I went ahead and put the 2 envelopes in just one USPS Express mail thinking it would be helpful if both requests are received together.

    My questions:

    1. Will joining them in one main envelope cause a problem?

    2. USPS said the mail will be there by noon tomorrow 8/31/2013 Saturday. Hopefully it will be on someone's desk by Tuesday after labor day Monday. When should I expect to receive my new appointment date?

    3. If I call USCIS for rescheduling, will that make it faster to get a new date or will it mess it up further since I already mailed the request form?

  13. Hi guys, anyone got an I-94 error recently on the new automated electronic I-94 system by CBP?

    My son and I did not have a hardcopy I-94 form when we entered via LAX last June. When I applied for SSN 3 weeks ago I retrieved my arrival info including I-94 number from CBP website by inputting my full name (two given names, middle name, and surname), passport number, arrival date and PoE, etc. It retrieves my admission record and I was able to print the I-94 retrieval document with all my correct info. The lady at SSA, however, advised me that when they checked my admission records they were not seeing my second given name on the system, just my first given name. No big deal, they still issued my SS card.

    Now I am just about to send my AoS packet and had used all my copies of that I-94 retrieval document. I wanted to make more copies but instead of photocopying, I went back to the CBP website to have the prints and to my surprise it now won't retrieve my admission record under my fullname (just my first given name instead of two given names) !!! Apparently this is a CBP error.

    My questions are:

    1. I plan to go ahead and submit copies of my I-94 that reflected my fullname correctly, and just have CBP fix it later. Do you think this is alright?

    2. Any advise from people who have gone through the procedure of requesting correction from CBP Deferred Inspection?

    Sigh. Hate the hassles they cause.

  14. Hi we are in the process of filing our AoS, need help re: fees...

    For K1: $985 filing fee + $85 biometrics fee

    For K2 (9 yrs old): $635

    No fees for EAD and AP

    1. Do we send separate checks/money orders for $985, $85, and $635, or just one check for the total amount?

    2. Is there a standard fee for civil surgeon consultation to complete I-693?

    (Note: We had our medical exams in the Philippines last May prior to coming to the US. DS-3025 given to both K1&K2, and a sealed CD to K1. Vaccine results: Incomplete; applicants eligible for blanket waiver because vaccines not age appropriate / insufficient time interval / not flu season)

    Any insights?

  15. Hi! We just received our K1/K2 visas yesterday. In the bottom annotation of my son's K2 visa they put "PA:" and then my name. My surname is misspelled. All other info on his K2 visa are correct, and my K1 visa info are good as well. Anyone knows how I should go about requesting the USEM for correction of his annotation info? Is it necessary? Need some advise! I'm flying to Manila and may have to request reprinting if this will cause me trouble @POE. Can I just walk-in at USEM? Anyone had the same experience?
