    My husband's duty station is in Okinawa, and he'll be there until August 2014. He went there unaccompanied (since August 2012) because I'm finishing my pre-requisites for masters here in California.

    We've been married since Feb 2010, and my 3rd year LPR anniversary will be on August 2013, and I could file for citizenship 90 days before that.

    I called USCIS and the guy on the other line told me that I can't file as a military spouse (expedite) because it's not a deployment, and I can't file as a "regular civilian" spouse because I'm not with him.

    Boggled!

    Any ideas?

    You CAN expedite an n-400 application early due to a PCS, it's from s 319(b) of the Immigration Naturalization Act, and I already did it.

    Unfortunately for you though, your husband has to have either the OCONUS orders in hand, OR, have at least 18 months of his tour left (and I believe you would have to be command sponsored and over there with him on his orders, too - which is why the guy said you are theoretically a regular civilian spouse).

    I know a few ladies over here in Germany who left it too late in their husband's tour to make use of 319(b) once they found out about it, so they had to renew their green card over here.

    However, if he ends up going to another OCONUS location and you get added to those orders, then you can use it. The whole process for me only took 3 months from start to finish and that was with some mistakes happening!

    Either way, since you are a military spouse (assuming you have a military ID etc.) then your application will be sent to the Nebraska office and they are always quick! Another military spouse (not going under s319(b) and with no special circumstances) when I filed back in February had her oath only a week after me.

  2. Hi Melissa,

    PCS orders generally take awhile to come through - there's a process they have to go through which involves medicals etc. My husband got his orders in September and we didn't arrive in Germany until the following April! In that time I went to being his gf, to getting married, to doing an I-130 AND getting citizenship in that time frame.

    If you do get orders, then you can call them and ask them to hurry with the green card production. I got mine within 2 weeks since it was urgent.

    Secondly, once you are here you will be able to remove your conditions no problem. It will be through the embassy that's local to you - probably Frankfurt. There are loads of foreign wives over here so don't worry - there will be other people in the same situation.

    Also, you will get a stamp in your passport when you arrive here - a NATO visa. They will probably ask to see your temporary green card (but I expect you will have your actual green card by then) to give the stamp to you. Then you don't have to live on base. Plus, if you are Belgian then you are part of the EU right? So you will be allowed to be in Europe anyway!

    No problem!

    Possibly- my appointment time was 1.30 and everyone around me had been told the Wednesday at 12pm.

    I'm sure that if our date for travel had been more urgent (i.e. the next day or whatever) that we probably could have picked it up the same day, but it wasn't an emergency as compared to what others may have dealt with :)

    Just thought I'd let everyone know about my experience with getting a passport using the passport agency emergency walk in (San Francisco office).

    I made an appointment for April 1. We went in at the allotted time, passed through security and waited about 20 minutes. I went up to the counter where the woman took the filled out application, passport photo, my naturalization certificate and checked our tickets that were for booked for April 13.

    She verified my application, checking everything matched. My second ID (military ID) name didn't match my naturalization certificate as I chose to change to my married name at the oath. That was fine - she made a note on my paperwork and everything was fine. She then took the payment and said that it would be ready for pick up on April 3 at 12pm.

    We went in on April 3 at 3pm (the second phase available for pick up). There was a line waiting, but we managed to avoid it as the security guard recognised us from Monday. We took the lift up and waited in line for about 10 minutes. The man checked my ID and gave me my passport, which was all accurate and in my married name.

    Nothing to worry about and all went smoothly, apart from the fact we had to go into the city twice and parking there was ridiculous! We ended up going with the parking two buildings down from Hawthorne Street, which was $2.50 every 15 minutes.

  5. Aww ECG19, that sucks. It sounds as though your parents maybe suffering from a bit of daughter withdrawal. Maybe you can give them a bit of tough love?? They have to realize that this is difficult for you being so homesick and that they as parents, should cut you a little bit of slack as you have enough of your plate as it is (away from home, new country, new husband).

    You may have to have a stern but loving talk with them and just let them know that when you communicate with them that you don't want to be reprimanded or made to feel guilty because you haven't been in contact for awhile. You may also have to be honest and let them know that when this does happen, that their guilt makes you hesitant to call them. Hence, less contact.

    Thanks, I ended up messaging my mum yesterday. Her initial response was to get victimised, and claim that I am acting like I don't love or care for them, but in the end she explained that she feels that she needs to hear from me to know that I am ok and safe and happy. When she said that, it made me realise I guess why she needs to hear from me, and if I don't contact them that she thinks something is wrong. I did explain though that her random attacks at me for not being in touch won't help our relationship, and that if I don't contact them that it is because I am feeling homesick, not unhappy!

    My wife has the same coping mechanism as you do. She misses her family and every time she talks with them its a crying jag afterwards. It's worse after a skyping with cams with them, and she's quit the cam chat totally lately. She claims its because of the poor internet signal there and the difficulty in keeping the connection going, but I'm well aware that's only an excuse. She has been here and year and half now, and I see this as slowly getting better, but still there. Her family at least doesn't push on this, as they know when she's feeling bad she'll just pull back, and trying to talk won't do any good. She does text a lot though, and that seems to give her the distance from her emotions while still staying in touch. Then the occasional phone call to, which appear to be getting a bit closer together now and are not followed by a crying jag normally. I'll know she's really over it when she asks them to get back on the computer and skype again. When she gets a batch of letters and cards from home, you should see the faucet works! I'll just hold her until she she's done crying and slowly get her back to smiling again. Last batch the tears only lasted a minute or two.

    My only advice is to tell your parents how hard it is for you after you talk and use other methods to keep in contact that also allow you a bit of emotional distance. Text, email or even letters. I'm not sure how long you've been here, but it will get better with time and the phone calls and skyping can resume.

    Haha oh dear, your wife sounds like me! I say that the internet connection is too bad to skype because I can't handle it ;)

    I've been here for 3 months, but we're about to up and move to Germany for 3 or 4 years so I have another move to cope with too, which I don't think is helping things! I definitely agree that for now messaging is the best thing for me to keep focused and keep from getting homesick everyday. I am sure it will start getting better..!

  6. Hello everyone new to this site! Hopefully I can get some help on the current situation that is stressing my wife and I out.

    My wife is a Kazakh citizen, came here on a K-1 this past October. I am active duty military and this past January we got an assignment to Spangdahlem Germany. We did her Biometrics in January and are currently awaiting interview for GC. We are scheduled to leave at the end of June/ July timeframe and we are confused on what to do exactly. We are working on getting her medically cleared right now so we don't have orders yet. Since she might not get her greencard before we leave can she still get a sofa passport? If she can't, can she just get a normal visa for Germany? I don't wont to leave her here behind at all if I can, I can't imagine it...can someone shed light on our situation? Thank you all so much

    Her greencard should be through in time - call, ask for tier 2, and explain the situation. Or, call the military hotline.

    Either way, the SOFA visa will go into her foreign (Kazak) passport on arrival in Germany. The question will be whether she can be command sponsored prior to being a legal resident. If she's going through the medical clearance right now then it probably isn't an issue yet. My husband had to provide a photocopy of my NZ passport as proof that I had a passport to travel on to Germany. The only difference I guess is that if you are a US citizen, your no fee passport would arrive to you with the SOFA visa already in it, whereas a foreign spouse receives the SOFA visa on arrival.

    Hope that makes sense. Either way, talk to someone and get the K1 hurried up. It will make life easier in the long run!

  7. So, not really sure how to start this post...

    Prior to meeting my husband, I lived in a different country from my family, but I was really great at staying in touch. I'd call every week, for an hour at a time, Skype, email etc. and just generally was good at staying in touch because I really relied on my family being there for me since I was away on my own.

    Now, since I moved to the USA, I am the first to admit the contact hasn't been as frequent. I what's app my mum, but I don't call them anymore because I've been pretty badly homesick and every time I hear their voice, I feel so so far from home now because there are no other kiwis around me.

    My mum and dad have started getting really upset with me for never being in touch, but this really is a coping mechanism. They think now I'm married that I don't need them anymore, which is NOT the case. I've told them these things, but my mum is still making me feel guilty for being so far away. We are trying to plan a trip to NZ next year but that will be funds dependent, and I can't promise it yet.

    I'm really not sure what else I can do to keep everyone happy. I love my husband, and he's willing to move back to my home country but only when his retirement from the military rolls around in around ten years.

    I'm not really sure what I'm asking, but has anyone else had this problem, and how have you dealt with it? I know I'm blessed to have such loving parents but I also can't deal with the guilt.

  8. My husband's interview letter arrived today. His interview is scheduled on Monday May 6th at 9:27 AM at the San Diego Federal Office. That 9:27 is a bit odd, not sure why it isn't 9:30 or 9:25, but we won't question anything. :lol:

    The only issue is that I may not be able to accompany him to the interview, as I am a teacher and that is the week we begin the state and federal mandated testing, so it may be difficult for me to take time off. I have to check with my principal next week and see what she thinks. I don't want my possible absence at my husband's interview create an obstacle for his citizenship.

    Your husband will be fine going alone.

    All he has to do is explain the above and they will understand. It really isn't practical that everyone can go along with their spouse. I went without my husband, explained he was in training that he couldn't get out of and it wasn't questioned.

    Thank you all for your support after my news yesterday!

    I had my interview this morning in the Sacramento, CA office. My experience was very smooth and painless. I waited for about an hour as I'd been slotted in between people who had had appointments scheduled for weeks, so I didn't mind waiting at all. I people watched and saw a lot of people go in and out of that office! You didn't need an appointment letter to get through security as the building was used for a lot of government organizations.

    I was asked how I met my husband, and we talked about the military a little. He did the English test oral & writing which I thought was funny since I am a native English speaker, so that was painless. I was asked 6 of the questions which I got all right, so he didn't bother asking me any more than that. I don't remember all of the questions I was asked, but I remember I was asked 'who vetoes bills?' 'who wrote the Declaration of Independence' 'who is the Commander in Chief of the military'. I can't remember the other 3. I had managed to get 100% in the practice tests late last night though so I was feeling confident about those!

    He then went through my file with me, asked if I wanted my maiden or married name on my naturalization certificate, and I went with my married name. I also had to write a statement saying that after my husband's tour is over in Germany that I will return to the USA to live. He said I was approved and printed off a letter saying such, and asked me to wait out in the foyer.

    About half an hour later, I was called into a filing room with a tiny US flag and a man read the oath to me, to which I was to respond with 'I do' and he handed me my certificate and 'Welcome to the USA' pack. They don't usually do same-day oaths in the Sacramento office, so it was all pretty casual and unofficial.

    I'm now about to make an appointment to get my passport rushed. I'm so glad that it all went smoothly after the finger print issues!!

    Good luck for everyone else!! I saw A LOT of people with big archive boxes going into the interviews, lawyers, interpreters, all sorts. In the end he didn't even look at my packet of evidence!

  10. Hello all,

    Received notification today that my interview would be 1 May, then got a call from the Sacramento office saying that I would need to have my interview tomorrow as it's expedited and they had one available space for me.

    Wish me luck- I'm now sitting down cramming all the questions & answers- definitely didn't think I'd have only half a day to study! Definitely better than the alternative however of having to fly back from Germany!

  11. Well here is an update. Thanks to all your guys/gals suggestions to call USCIS, the tier 2 agent requested my paperwork be expedited, as no comment was in the system. She told me I would have to wait to see if the expedite request would be authorized/processed with whoever was holding my case. She told me I should hear something back from them before April 6th. She also said, most likely I would hear something before this date however. So we are keeping our fingers crossed.

    For those of you who had your I-130 expedited, how long was it from the time of your phone request until you were notified your petition was being expedited?

    We never got any official notification that the expedite was accepted, but 10 days after, we checked my case status online and it was approved and was already on its way to NVC.

    Up until then, the online case status hadn't been working for me (I had an MSC number). This was in October 2012.

    We then called and requested an expedite at the NVC stage, once we had been assigned an embassy case number. This also was approved by being sent directly to the embassy in Auckland. I sent all the rest of the information directly to the embassy after that, rather than NVC.

    You will probably be different if filing from overseas though, so that will probably be a different process in terms of NVC (I think if you are overseas, you deal direct with the embassy? I don't have any knowledge of that though so someone else please advise on that!)

    We are moving to Ramstein Air Force base, which is about 1 1/2 hours south of Frankfurt and an hour from Mannheim. Conveniently, we can cross the borders to France and Luxembourg within an hour too! I'm super excited to see that part of the world.

    My husband actually really wants to visit Finland while we are there (we both have a 'to do' list in the 3-4 years that he has orders there, and we have each picked a country that we want to visit that isn't as tourist-laden as other places in Europe and his choice was Finland). Any tips? Feel free to PM :)

  14. Did you send a copy of your orders?

    I would call, speak to a tier 2 and request an expedite over the phone. They'll probably get you to email a supervisor with details of your deployment.

    We also sent a letter with our i-130 requesting an expedite, but it wasn't until we called that they actually looked at our file.. which makes sense, it's just part of a package otherwise.

  15. I've started studying for the civics test, but have a question.

    When there are questions, like for example, 'what does the consitution do' there are three answers for it. This is not a question where it says 'give ONE' etc.

    Is it sufficient to answer one of these answers? (i.e. are they simply alternatives) or must you answer all three listed?

    I've noticed in other questions that they are definitely alternatives (i.e. it says Joe Biden, or Biden) but with these three-pronged answers I'm not completely sure.

  16. Fingerprint appointment round 2 was today.

    The woman doing my finger prints said they were too weak due to my 'soft skin' and that they would be rejected by FBI (2 of the fingerprints couldn't get a clear reading at all, let alone the others that 'passed' but the two were rejected).

    She said I'd get a letter requiring me to get police clearances from any place I'd lived in since arriving in the USA.

    We're thinking of abandoning it now, we don't need this stress before we move to Germany with the military, and no way will it be through before we leave now despite being expedited. We might just take the normal course of ROC and citizenship while in Germany, which would mean I can do it all over there and not have to fly back to the USA for the oath etc.

    Pretty disappointing, but such is life and trying to realise that it must mean something.

  17. I started my visa process in Australia and the doctor suggested getting blood tests to prove my immunity.

    The bloods were free through medicare and showed I was positive for varicella. I rathered that than having to pay for a vaccine I didn't need! That same blood test also proved that I didn't need MMR etc. because I'd already had them. All I ended up needing was the Tdap booster.

  18. That really sucks! do you know why they weren't readable? The machine usually says accepted or not for the fingers, if they were accepted and then they said unreadable that would be odd!

    I'm not sure, she didn't say! Just that they came back from the FBI as unreadable and that they'd need to be done again.

    Sorry to hear that. :( Have you had issues with fingerprinting before or was this the first time they were "unreadable"?

    I hope it all gets resolved soon.

    And you are right, it is always a good idea to call and check on our cases, if we feel there is a need to do so.

    I hadn't had fingerprints taken by a service center before, this was a first. I had them taken manually by police in Australia when I needed my police check run, and by the embassy in NZ, and also obviously at border control and there were never any issues.

    Just was unlucky this time I guess!

  19. Well, bad news for me.

    My fingerprints were unreadable. I apparently had a letter sent to have my fingerprints retaken to my old address - which I never got.

    Now I have to wait for another fingerprint notice to be sent out, doesn't look like it will be through before we leave the USA now.

    The worst part is I would never have known had I not called to check up on my case because my online status is stuck on initial review!

    So - lesson learned, call to check up if things aren't moving as they should!

  20. I had major stomach problems for the first month after arriving here!

    Now we cook at home every day and that's the only time my tummy is okay, and it has to be completely clean food.

    By the way, high fructose corn syrup products gave me an upset stomach every time, and the other day it was in a 'light' yoghurt(!!!!). I could taste it, it was a ridiculously unnatural flavour.

    If we weren't moving to Germany with the military then we would definitely be just shopping at farmers markets etc.

  21. never mind, I think I found the answer I'm looking for, basically, to apply I need to be here in the US, not to worry, if by some miracle I get it next week or something, I might do just that, otherwise I'm ok with taking the long road. :)

    for Spouses of Members of the U.S. Armed Forces

    319(b)

    Must be LPR but no specified period of residence or physical presence is required

    Must complete interview and oath in United States

    The law permits expedited naturalization in the United States for eligible spouses of U.S. citizen service members who are or will be stationed or deployed abroad.[11] This provision does not require any prior period of residence or specified period of physical presence within the United States for any LPR spouse of a U.S. citizen who is an employee of the United States Government (including a member of the U.S. armed forces) or recognized nonprofit organization who is stationed abroad in such employment for at least one year.[12]

    So, you could actually apply for expedited citizenship while in Korea (another member here, Shellz, applied from overseas) as long as your hubby ends up with a two year tour, not a one year.

    The only thing is, as stated above, you'd have to fly back to Hawaii or somewhere that does same day interview/oath. Could be worth it for more job options though, which is why I'm doing it!

  22. Well, I had my interview and oath on the 21st of Feb 2013 without any issues whatsoever. So with my My priority date/filing date was Dec 4th and completely finished Feb 21st! YAY!!

    That is excellent news!!! Congratulations :)) Did you find somewhere to get your passport done same day?

    I'm just waiting to be in line for an interview - I did my biometrics early so we will wait and see. Hoping to get it all done before we leave on April 21!

  23. I thought you could do the oath ceremony overseas (I swear there is someone on this board that did it) ... didn't realise you would have to fly all the way back to the US for that!

    Under section 319(b) (Expedited naturalization section of the Immigration Naturalization Act) - the applicant MUST be present in the USA for the oath.

    I guess it is the trade off for not requiring any specific physical residence. To be honest, flying back to the USA is not much that they are asking for considering I have only had my green card for 2 months!

    Of course, I'm sure there are oaths overseas for people not under that section!
