  1. If the USCIS recognize my baptizm letter, do you think it will be okay?. If USCIS can issue my greencard with my new name, do you think i still need to go to the court to change my name?. I want to change my name as i always have trouble with paperworks asking for my first and last name, i just has one single name (in one word,no last or first name). I hope my new name is acceptable *fingers cross*

    If uscis recognizes baptism letter and they don't see any issue means its legal. Then you can happily use your new name. I am not sure if baptism letter is valid for a legal name change. Uscis won't approve anything until its legal.

I have a question about AOS too, i came by k1 n married within 90 days, my marriage certificate just has my single name as the recorder didn't ask for name change after married and we didn't know about that. I sent my AOS papers by using my new name, i used my christian name as my first name (i sent my baptizm letter as the only evidence), my single name as my middle name and my husband last name as my last name ( i sent my marriage certificate). I also sent my DoD card copy as my husband is active member in military and it has my new name. Do you think it will be okay?

    If you didn't opt for a name change during your marriage then keep your original name during application. I am not sure if USCIS recognizes baptizm letter, if not then you will get RFE and you will have to explain all these. Name change will cost you a lot if you haven't changed it during marriage.

    Keeping your older name won't create any issue. You need not change your name after marriage, that's optional.

  3. Quick question please, we are in the process of filing for AOS, I came in on the K-1 visa. I am confused about what last name to use in the forms, do I use the same last name (my maiden name) in my Passport & K-1 visa, or should I use my now married (husband's) last name? worried if there'll be any clash/confusion on the USCIS side. My Social Security Card has my husband's last name. Thanks for any help I can get.

    use your new name and provide your marriage certificate. All your documents including passport can be in any name as long as those names are mentioned on your marriage certificate.

I'm stressed!i'm only one step away my green card for permanent status was approved on Oct.26 2012 but it always flagged undelivered because they messed up with my address instead of putting Apt.B they put Apt.D.So i changed it but still they didn't changed it and yesterday it was the 3rd times that my G.C is still undelivered and find out that they still put Apt.D.Hopefully they fixed it this time. :(

  5. Hi everyone. My wife and i married november 2, 2012. Her visa in her passport was stamped upon entry to the usa. Do we need to apply for aos before the 90 day period is over? Also what is the biometrics portion? Is that the part performed by the civil surgon? Also where can we get the medical done hete in seattle washington and how much is it?

    Biometric is different, that is done by the USCIS and they won't charge you anything extra for that.

    I-693 is something where you need a Civil Surgeon. I-693 should be completed before you file your application. If you have all your vaccination record then you can find some CS who can fill the form at very less cost otherwise vaccination will cost you a lot.

    I got all my required vaccinations through my Insurance and went to Surgeon with the records. He charged 200 his fee + 70 for TV Xray. In many cities Surgeons dont charge much.

  6. Hey everyone, I just have a question. I am a US Citizen and my girlfriend is from France, we have been dating for about 2 years now. She is currently here until May on a B-1 Business Visa with her job. I was planning on surprising her around Xmas and Proposing. I was wondering if we were to be married before her 6 Month B-1 is up can I just apply for Adjustment of status? Does she have to return to France at all? Of course this all depends on on if she says Yes!

    I would suggest - propose her during Thanksgiving itself, if you get married then getting marriage license and then certified copy will take atleast 2-3 weeks.

    Arranging all the documents and filing will again take time based on availability of all the documents (she might have to bring documents from france).

    One last thing - do whatever but don't let her leave USA, otherwise your AOS will be dismissed and it will take a lot of time to bring her back.

    My mom and dad were here on tourist Visa I am a US citizen. My mom and dad does not want me to petition them while they are on the Philippines since they dont really wanna stay here in US and they said they are too old and phil is their home(74 and 76). But I was able to convince them to visit me and my kids since its I havent seen them in 5 yrs and they havent seen my youngerst baby. Now that they are here they are enjoying their grandkids and same thing with my boys. I was able to convince them to stay with me (although my dad still alittle hesitant ) I was reading the forum and blog and learned about the adjustment of status I am trying to submit it on their 5th month of stay but I have problems. My mothers maiden name is different from my birthcertificate and hers by 1 letter will it matter since its only her moms middle name also my mom and dad were married twice civil and church. My birthcertificate shows their church wedding although I know we normally use the ceivil wedding but I got both paper works although the church is not NSO copy. But my mom has an atty.certification would that work? thanks everyone God bless

    I think you don't need Marriage certificate, even if you need it 1 letter will not be a difference. In many non english speaking countries we have different words which are pronounced as same so this is an obvious confusion and it always happens.

    In my birthplace whether u keep A in the middle or not, it is pronounced the same way, so my lawyer asked me to submit my passport copy and birth certificate without changing them...

    So don't worry 1 letter doesn't make a difference if it belongs to same person.

    Although you may attach a notarized copy stating this issue...

  8. The most important thing is that you use an address YOU can receive mail at. If that's at your apartment, use that. The last thing you want is to have USCIS mail get returned.

    I don't think an attorney is necessary in most cases. I've seen plenty stories here where they did more harm than good. But if you think you might have trouble getting approved, for some reason, then an attorney might be a good idea.

    Attorney is the last thing I wanted as I have a lot of expenses in near future. I dont see any issue but my Fiancee doesn't want to take any chances...

  9. You can go ahead and use your married name. Your marriage certificate will provide the required documentation of your name change.

    EDIT: Sorry, I just read the rest of your question and realized I didn't answer it.

    I would use whatever address will be permanent, and one you're sure you can receive mail at without issues.

    As for if it will be an issue with your AOS interview - maybe, maybe not. You'll want to make sure you have very strong evidence of your bona fide marriage prior to your interview. But you'll want to be sure of that anyway.

    My wife (USC) has a permanent address but I stay in a different city. So, you mean I should also use her address ? Ppl are asking to get help of an attorney I am not sure if I should spend huge money for these type of questions.

    I want to know the precautions I need to keep as I will apply for name change in my ssn and will apply for my husband's AOS almost at the same time.

    We will stay at our current address in different cities until either one of us gets transferred to other's city. Will it be an issue?Whose address I should use?

    I have a permanent home but my spouse will live in a temporary apartment.

    Read carefully, I only used this guide and did it myself with no problems.

    If you make mistake, they will give you chance to fix it.

    But I don't know what kind of mistakes you are talking about.

    Just remember always be honest with them.

    BTW you can file I131 and not use it, not a problem.

    This guide is really very very helpful. I will check out how much time does i 131 will take. I have one more problem, my wife will work in Minneapolis (she is facing difficulty in finding a job in my city) until I get my EAD and try for a job at some common location where she can work. So our addresses will be different. i hope it shouldn't be an issue.

    Let's hope for the best.

    Any idea if we can postpone the schedule green card interview (in case if I am out of country at that time)?

    I have found some information online and seems like I can manage forms and processing. But some of the friends are saying that if there is any mistake then i am gone if attorney is not there. I am not sure what are the chances and scope of a mistake.

    If I am filling I 131 and don't want to use it as I have a valid L1, is it fine?

  15. I am in USA currently on L1 visa. I will marry a US citizen next month. I want to apply for a permanent residency and seek your help.

    I have few questions:

    Should I go for an Attorney ? How much will they charge?

    I am not willing to go to an attroney due to their high fees, but i will go thru them in case if it is very difficult to file by myself.

    If I am out of country during I 485 processing, will it be an issue? I might go for a vacation in January. I have a valid L1 so I can re enter usa.

  16. L-1 is a dual intent visa so you shouldn't have an issue. However, it's possible you could be scheduled for an interview in that time so make sure you have someone checking your mail while away and be prepared to return for it if needed.

    I don't have any issue if i get my EAD by feb but I want all other documentation and proceeding (ex: biometric test) done before January.

    Please suggest what should be my timeline?

    Can't I postpone my interview date if it is scheduled during my vacation?
