  1. That is the whole reason I am staying there for an extended period of time to create evidence. I really can't stand staying here any longer I miss my wife so much. I've heard stories of many young couples being supported by there family. I have a large family that lives well enough for me to have many sponser's. I am actually joining the military and will be in the Delayed Entry Program so basically sitting around until I go to boot camp. I have lots of family in the Philippines that is supporting me as well. Its really a cultural thing in which Filipino families really support one another to a large extent

  2. I filed my I-130 in October and I am currently scheduled to leave the country to stay with my spouse until she can come back with me. I'm still waiting for my NOA2 but I am praying that I will not receive any RFES. If that does happen may I mail my RFE response from the Philippines? Should I notify the USCIS that I am staying in the Philippines for an extended period. As of now I know I incorrectly filled out one section of the G325 and put my wife's last name as her first name and on the I-130 for question 22 I did not put the Manila Embassy I just put none. For my evidence I sent only recent chat logs, pictures of our wedding, a money remmitance attached to my bank account with a short history and a plane ticket for my stay which my grandmother paid for. I met her and married her on my first meeting the only previous history we have is adding each other on facebook and 3 messages I never thought I would fall in love with her and marry her. Should I expect a RFE, I've been rather paranoid reading heavy RFE's received requesting a large amount of information regarding the marriage but I haven't seen any from the Philippines so I am sort of tugging inside on being worried or not. I am only 21 and essentially my grandmother paid for everything, my plane ticket, marriage, and is supporting my marriage. I have other family members supporting me as well so I was wondering should I create affidavits from each family member supporting me for the NVC stage? I am extremely worried and just want to be prepared before I leave.

    The error on the G325a might result in an RFE. Technically, her legal name would need to be stated, but this is easily fixed by you sending in another G-325a form. They might get you to fix it. They might not. I think they will. Wait for them to ask, though.

    Being a student with no job, you'll need a family member to assist in the affidavit of support. Otherwise, you'll need to actually get a job before you can file the affidavit of support, and you'll need to earn at least the required minimum amount. A job offer is not good enough. A promise to get a job isn't good enough. Only an employment verification letter or pay stubs prove that you are working and can meet the minimum eligibility requirements. Else, if you had 3x the minimum income required in assets (stocks, real estate, etc) you could use that. Good news on this is that the requirements for those who enter the armed forces are less than those who are not in the armed forces. :thumbs:

    Affidavits received are affidavits no matter when they were signed, but I would think that someone in law or someone else could answer your question as to whether they would expire with USCIS or not.

    A misdemeanor probably won't be an issue, as long as she doesn't have anything on her record. If the US citizen has the misdemeanor and the foreign national does not, then I don't foresee any issues. Others could chime in on that.

    Thanks for input? In my case do you think they would send an RFE? I know there is many other things that factor in but I felt I had a pretty decent packet although I am just worried they will be suspicious because of my age.

    I am a considerably young fellow at the age of 21. I met my wife on a two week stay in the Philippines and got married the day before I left the country. I recently filed an I-130 Spousal Visa application and I have some concerns. First, for my G325a has a slight mistake on me (the petitioners) form. I just noticed I put her maiden name both on her first name and maiden name box. Will this cause me any troubl? I have read that they do not take the G325a into much consideration until the NVC process, and I know I filled out the I-130 perfectly. Second, since I have gotten married I currently am a student with no job, but recently have inquired to joined the armed forces and will most likely enlist soon, should I notify the USCIS? Next, since I just met her on my visit we had no previous history with virtually no evidence to provide with the I130. I included 3 pictures from our wedding day which wasn't much, a letter from the bank stating the link between my bank account to hers with only 3 transactions made, my flight itinerary for a 3 month visit in December, and seven pages of skype messenger showing we have communicated considerably. This brings me up to my next point, during my stay in the Philippines I wanted to be prepared for an RFE so I can send it as soon as possible if necessary. I was wondering what sort of evidence I should expect if it does come. Is it a problem if I get Affidavits of Bona fide marriage before I leave with a considerable date difference from the RFE if recieved? Finally, I have blemish on my record, I got into some trouble in with the law two years ago and received a misdemeanor will that create a problem for me? This site has provided with so much help and I hope to continue to look for advice. Thank you!

  5. I'm almost at the completion of my I-130 petition although I have am torn on one part of the form. My wife and I got married in a different city she actually lived in the Philippines. The problem is with this in order for her to gain clearance for Marriage we had to use the Address we stayed at. Do I have to have the address match up with the Marriage certificate or do I just use the address she currently resides?

  6. I am filling out my I-130 and I have a dilemma with the address of my spouse in the Philippines. She lives in another city in which we got married so we had to use the address of the house we stayed at for 2 weeks' address in order to get married. Do I use the address on the marriage certificate or should I just use her home address? Also I am a college student and I do not really have any property or anything to use as evidence of a bonifide marriage. I can acquire sworn affidavits but will this suffice?

  7. You will only file the I-130 to begin the process, carefully read the instructions for that form and also read this VJ guide.

    Regarding financial situation, if your current income is less than 125% of the poverty line for your household size, then you will require a joint sponsor (you have stated that several of your family members are willing). The I-864P shows the required numbers. You won't be dealing with that until after the file arrives at the NVC.

    The criminal offense should not be an issue as long is it was not a conviction for an offense covered by the Adam Walsh Act. Be sure that your wife knows the circumstances surrounding it in case she is asked about it by a CO during the interview.

  8. Hello I am new to VJ and I hope to gain a little knowledge through everyone's ones experiences!

    I have a very unique story and I hope I can gain some sort of comfort and direction through this forum! My story starts about 24 days ago. I went to visit my great grandma with my grandma in the Philippines cause she's sick. My newlywed wife (The one I am petitioning) is my grandmas friends granddaughter and they introduced me to her. I didn't leave her side after that. I decided I wanted to marry her. I asked my grandma and she let me have her engagement ring to propose to her on my cousins birthday. Got married the day before I left (10 days ago). She got my grandmas band to. I got a stainless ring until I got back and my grandpa gave me his. Now here comes the complicated part, I am only 21 years old, I am a college student with no job at the moment and not the greatest financial situation. I am reading all these stories and instructions with I-130's or I-129's and I'm at complete loss. On top of that I have a slight blemish on my criminal record that occurred almost 3 years ago but it is quite minor although I am still afraid the bumps it may cause. I want to petition her now but I am afraid it will be denied because of all this and lack of history. I have great support with all of my family and even had offers of AOS from several family members. I'm looking for any advice, and guidance! I hope to share my journey with everyone and hopefully it is a successful one! :)
