  1. Thank you for the reply...

Yesterday night I was doing all my research and pulling back all the emails, mails and documents I have. From that I found out that I applied I-751 in 1st week of September 2014. I have my emails and biometrics appointment letter received in September 2nd week. The petty theft incident happened in July 2014, When that incident happened the police questioned me, took my identification. I told that I was innocent and I can prove it. I don't remember much but all they said was I have to go to court and talk to the judge. Meanwhile I was busy with my school, and collecting documents for applying I-751. While I was filing for I-751, I am sure that I never received any information about this petty theft case. I concentrated on my I-751 because I was applying through divorce. So I think for the question ("Have been arrested, detained...") I mentioned "No" because I never had any document or court papers or police documents. I remember that I did not mention "Yes" because if I said "Yes" then I am accepting that I have did the crime and also I dont have any documents to sent to the USCIS.

Anyways after filing I-751, I got a call from police about the case for hearing is on Sep 19th, and told me to contact an attorney. In the court on first hearing I told the judge and attorney that I was innocent and I didn't do any crime. I adjourned case 3 times to prove innocent, but lack of evidence and my poor communication skills, I was very naive and scared... because this was the first time and I don't know anything about US laws... my attorney scared me that I have to go jail because there is no evidence or video recording from the store to prove that I am innocent and also I have wasted courts valuable time adjourning the case 3 times. I think in Feb 2015, I pleaded guilty and the case was finally dismissed in July 2015. It took whole 1 year.

Meanwhile I didn't get chance to tell this to USCIS, because it took whole 1 year to get the case dismissed and before that I received my green card in April 2015 without an interview.

Sorry... if this is too much of information, but I want be honest.

    Thanks

So you answered No in the I-751, but said yes for the N-400 application?

In I-751 application, I don't remember if I had mentioned yes or no. I am 70% sure I have mentioned yes but I didn't send any court case documents. If USCIS had arranged an Interview I would have remembered, but they have sent 10yr green card without an Interview.

    Now I am really scared.

  3. Hello,

Please forgive me for my english.

Long story short, I have my N400 interview coming up next week and I am worried that I made a mistake.

In November 2014 I applied for i-751 removal of conditions through divorce. I got approved with out an Interview and I received 10yrs green card in April 2015. In July 2014, I was charged with petty theft case(Misdemeanor) and I was going through court process till June 2015. When I applied for i-751 in Nov 2014, I am not sure if I have answered yes or no for the question ("Have you been arrested, detained...") and I dont remember that I have sent the court documents). Honestly that time I didnt even know good english or vocabulary.

Now in my N400 form I have mentioned yes to all the question for ("Have you been arrested or detained,...") and I have all the court forms which I am taking to the interview.

My question is what happens if I go the N400 interview and ask me about my old case? I am not sure if I have mentioned yes or no! What should I do? please help me... will I get deported because I lied to them? I didnt save the form i-751 when I sent to USCIS in 2014.

  4. Hi,

I think whatever you are thinking might be correct, but think from other side.

If she want to get a permanant residency, she might given you a divorce earlier and got the 10yr GC and spent the life easier. I think she would not spare that 2yrs of life treating you as her Husband. If your wife has a BF then no BF tells her GF to play this drama as a wife to other person.

I just want to tell you to think twice. May be the facebook and chat logs are not created by her, it might be the fake ones.

If you really suspect her then Divorce her ASAP and consult the authorities ASAP and Deport her.

    Goodluck.
