  1. Hi,

    I had my interview in Montreal in Sept. 2012.I am in AP for the past 7 months. I am a Canadian citizen with pakistani background. My wife is a US citizen. Am i allowed to visit her in US? How long can i stay with her? I heard i can stay in US for six months being a Canadian. Not sure how long AP is going to take plus i lost my job recently and wife wants me to live with her for a while.

    Also can anyone tell me how much longer it could take for them to finish AP? i know it varies based on individual circumstances but any rough idea?. DOS doesnt give much info and involving Senator didnt help much either. my interview was literally 10 minutes and they only asked basic questions..nothing unusual. i am confused and frustrated.. Life is on hold. pls help. Thank you so much.

    Did Montreal tell you at the interview that you are in AP or did you get an email later on stating that you are in AP. How long after the interview did they let you know that you are in AP? Did you also get a "welcome" letter?

    We were given the "Welcome to USA" letter at the interview, but as we did not have our Canadian Passport with us (we have dual citizenship) they told us to send our Canadian passports for visa. We send them our passports about a month ago and have not heard anything from Montreal.

  2. I am a Canadian citizen and my wife is a US citizen. I had my CR-1 Immigrant visa interview at Montreal consulate in September 2012. My interview was 10 minutes long and the interviewing officer asked me basic questions about our relationship etc. Once the interview was done, he handed me a welcome letter and told me I should get my visa within 4 to 5 days.

    Instead, I received a letter from the embassy in mail saying that my case has been put into administrative processing. It has been five months but no update. I involved congressman but they couldn't do much. their response is "the case is still undergoing administrative processing".

    They told me my case is documentarily complete and didnt ask for any further documentation.

    Can someone tell me why the case is in AP and how much longer it can take? Is this normal..This is really frustrating.

    Also I was born in Pakistan...not sure if this has anything to do with this. Please help.

    How about contacting the Montreal consulate directly and ask them - the case officer is the only one in a position to tell you. I have contacted Montreal many times when I was not sure how to proceed, and they always helped.

    I don't think it has anything to do with where you were born. Clear your mind from suspicions. I can only imagine that they are conducting the usual investigations in your home country to satisfy any discrepancies.

    You have mentioned that "Once the interview was done, he handed me a welcome letter and told me I should get my visa within 4 to 5 days" - did they keep your passport for visa ?

    As far as involving congressman, senators etc. are concerned, I wouldn't even bother going that way.....

    If you are still at the VSC stage you can also wait till your case gets to the NVC stage and then you can give them your new address when you fill out your DS230

    For those who have to change address at the NVC stage send NVC an email exactly as it is above on the "quote" with your case nr, petitioners name, address, date of birth etc and then the beneficiary's name,adress, date of birth etc.

    You really have to be very precisie with them - as an extra precaution what I wrote in the email was :

    Beneficiary's OR Petitioners NEW Address

    your name

    your new address

    Beneficiary's OR Petitioners OLD Address

    your name

    your old address

    PLEASE CONFIRM CHANGE OF ADDRESS

  5. Wondering if it's possible that when you get your Visa and Passports back from the consulate that you go to any border crossing, do your POE and come back to Toronto the same/next day.

    I want to do my POE first, then come back, sell house, quit job, pack and go California...plan to do the move/drive myself with UHaul or through any mover because I have a lot of stuff which I don't want to sell.

    Anyone done this move/drive themselves with UHaul etc. to LA - I know it's a long trip - have done quite some trips before. :help:

  6. You need the confirmation page with your DHL location and reference number for your interview. If not, you're not allowed inside.

    This isn't given with the interview letter. You have to sign up yourself on the CSC website. Follow the instructions here: http://usvisa-info.com/en-CA/selfservice/us_courier_information (click the fourth option).

    Thanks Saylin. Here's what I have on my CSC appointment confirmation printout " You have successfully scheduled an appointment bla bla bla...and then

    in the 1st section - Appointment information - there's a Confirmation Nr : Can Mo 06 03 13 08 00 XXXXXXXXX

    in the 2nd section - Applicant Details - my name and then Reference ID:XXXXXXXX

    in the 4th section - Loomis Information - Loomis Branch : Burlington

    As you said (click the 4th option) Register for Courier services - when I clicked there it changed to "cancel appointment" which scared the #$%& out of me.

    I am completely confused...so do I have this number or...

  7. Can anyone clarify about DHL Registry nr. Are you supposed to have this number before you go for your Interview or is this number assigned by consulate/DHL automatically after your interview to send your passports/documents.

    I do not have any DHL registry number on my interview appointment letter. Some people who've been to their interviews in Montreal mention that they check your DHL registry nr before they let you in and that people have been turned

    away who did not have them.

    The appointment confirmation letter that I have is a print out from the VIS official website - there is no barcode or anything there, just a confirmation nr. and at the end the Loomis branch name.

  8. A family's PD was current and they got their visas. One visa was printed wrong and had to be returned to the embassy. The rest of the family left except that one family member. The retrogression happened and this person had to wait to be current but now has his visa. Can he enter the US by himself? Does he need to show any documents (besides his visas package) at the US airport for him to enter? His father now has a greencard and returned to India but won't be leaving with his son, does that affect the situation?

    Please print out any correspondence related to the (visa printed wrong and had to be returned to the embassy) case between you and consulate and take it with you. The consulate knows what happened and has surely mentioned it in his "DO NOT OPEN" visa package. Also in the original DS230 the names of all family members are mentioned who will be accompanying the beneficiary (I assume the father, mother etc. and the "stranded" son). Now the son has his own Visa Package and a Visa in his passport, so he should be OK to travel on his own. I would recommend that his family members who are already in the US, that when they go to pick him up at the airport to take along their documents in case they are called out. But I am sure he should not have any problems. And Good Luck!!!

    just wanted to post my question.

    PC: F4, PD is August 5, 2010, country: Kazakhstan, Received approval of the petition and NVC case number March 14, 2011.

    Is the wait really up to 10 years (for most countries or is it possible to find out how long people wait in different countries)? I was born in Kazakhstan but live in a different country now (doe it matter?)

    Yes, the wait is between 10 - 12 years. In my case F4 my PD is Feb 2001. I was scheduled for visa interview in June 2011 which was cancelled a week before the interview date due to retrogession.

    Waited another year for PD to get current again which was in August 2012. Now scheduled for visa interview in March 2013. My total wait would then be about 12 years if everything goes OK and

    there is no retrogession again. :o

    About the long waiting time, it doesn't make a difference where you were born and where you are living now.

  10. Anybody in F4 category waiting for Montreal interview appointment. I have been trying to schedule an interview appointment since a month now and all I ever see is "there are no available appointments at this time".

    Waited 10 years for category F4 to get current. In June 2011 just ten days before visa interview was informed by Montreal that interview has been cancelled due to visa regression. Had already done medicals and all. Have to pay and do medicals all over again (just not fair).

    Waited another year for F4 to get current. Now waiting again to schedule appointment where none are available!!! :help:

    PD is 7th February 2001

    ATLAST !!! After waiting nearly two months since my PD got current again I could schedule an appointment - March 2013 - total waiting time would be 12 YEARS :o

    my PD is March29 2001 almost there but this one week movement twice already killed me,no we don't have that many cases our country is small

    I know firsthand how frustrating that can be. :angry:

    Just imagine, I had my medicals and everything done - 1 week before interview I was told my interview appointment is cancelled due to retrogession. :bonk:

    There are also people who even had their interviews done but were not given visa and had to wait due to this retrogession. :wacko:

    I assume that you will get good news in about a months time too, maybe sooner.

    Probably you don't have so many people applying for immigration to US as compared to here in Canada.

    We have a lot of F1, R's etc. here and they all have a shorter wait time and priority over the F4 category

    On top of that this retrogession put everybody 1.5 years longer on hold.

  13. GOOD NEWS AT LAST !!! went to CSC website and was able to schedule my F4 visa interview appointment today local time 10.30 PM :dance:

    Unfortunately they are so booked up that the earliest available appointments are in March 2013

    PD 7.Feb 2001

    Ist interview appointment was on 10. June 2011 - got cancelled due to retrogession (I hope and wish that there is no more retrogession, ever...)

    waited another year for PD to get current again - August 2012 PD got current - but could not schedule interview till today.

    Always got the message "your priority date is not current, you are not eligible to schedule an appointment", even though my priority date was current since 1st week of August.

    TOTAL WAIT till Interview will be 12 years

    DON'T LOOSE HOPE GUYS, THERE IS LIGHT VISIBLE AT THE END OF THE TUNNEL :thumbs:

  14. When case is completed USCIS will send it to national visa center(NVC) until visa bacoms available and NVC forwards them to consulate ... Go look at your first interview letter it came from NVC look at the bottom address and head tittle!!!

    I'm sorry to say that but u are quiet mistaken and you need to contact a good immigration lawer...

    I don't want to scar u but they usually lose or misplace a file,

    Yes, it's correct the first time when you receive your interview appointment - it's from the NVC - BUT - it says further in the letter "The national Visa center has completed its processing of this case and any further inquiries should be addressed to : Embassy....

    I just called NVC a while ago - and she confirmed - the file is at the consulate.

    The consulate confirmed last week by email that my priority date is current again and I should schedule my appointment through CSC.

    Thanks for your kind help and answer. By the way the last place I would look for help would be a "good immigration lawyer".

  15. This delay is upsetting for all of us. being stuck with F4, does anyone know if category can be switched? Actually now my son who is a US citizen turned 21 and i am not sure if i should go with a new petition from him or stay in waiting line for crawling movement of F4. Anyone has any idea? PD April 16, 2001.

    I would recommend that you stick to your F4 - you are nearly there - your PD is current in about a month. Worldwide visa allocations begin in October. Probably you will be processed before June 2013.

    I don't know if it's worth all the hassle. I would not do it so near the finishing line...I know it's very frustrating, but instead invest your time in research as to what you will be doing in US once you are there...

    PS she says consulate did send all cases back to NVC until their PD becomes available again!!!

    I just called NVC 5 minutes ago - and she confirmed - when NVC forwards your file to consulate for visa processing/interview, then all communication/dealing is in the hands of the consulate.

    If consulate has to send files back - then only to USCIS - no more NVC

  17. If you write to NVCInquiry@state.gov explaining your case, they will give you an answer in no more than 5-10 days. You lose nothing by trying.

    I already wrote to NVC in another matter concerning my son who is 21 years old. They said "any further inquiries should be directed to the assigned US Embassy or Consulate General".

    When your file "physically" leaves NVC that's it - No more NVC and from then onwards you have to deal with the consulate/embassy - CSC - USCIS etc.

    The consulate does not send cases back to NVC but to State Dept - USCIS - when there is retrogession etc. until PD becomes current again.

    I already called USCIS and they will only talk to petitioner (person in USA) as compared to someone calling from another country.

    The consulate was very helpful because they send me an email confirming that my priority date is current again and I should go ahead and schedule appointment. (this shows it's not in their hand)

    But when I go to schedule appointment on CSC website - it says "next available appointment is in 130 days" and " your PD is not current at the moment, you are not permitted to schedule appointment...

    It's usually in October when they start allotting visas worldwide. Hope next week brings good news!!!

  18. You need to call NVC and have them schedual u an appointment not consulate !

    I am past the NVC processing stage...

    NVC processes your case nr./file and when your paperwork is completed and all fees paid then it forwards it to consulate for consular processing and visa issuance.

    You will receive notice to go to CSC website and schedule your appointment, I don't know about your country, but anyway that's the procedure here.

    My file is no longer at NVC as I have already been scheduled an appointment (June 2011) which was cancelled due to retrogession.

    I have to re-schedule my appointment because of the retrogession and my PD getting current again (for 2nd time).

    My case/file is already at the consulate stage.

    I don't want you guys to get discouraged, after all most of us F4's have waited 10+years and that's a lot of patience... :blink:

  19. I assume they have a huge backlog of people waiting who came under retrogession in January 2011 and those cases have to be cleared out first too.

  20. Even I have not received any I/L although my priority date is 7 Feb 2001 :help:

    Interview letters are sent by the date on your case nr.

    If you see your case Nr. for eg. XYZ 2010 77 0001 - XYZ is for embassy/consulate - 2010 is the year your case was created by NVC - 77 is the day of the year case created and

    0001 is total number of cases assigned to consulate on that day.

    Accordingly this is how you are standing in line and receive your I/L

    My PD is 7 February 2001 - My interview was scheduled for 10. June 2011. I had my medicals and everything completed. Just one week before interview received email about cancellation of interview due to retrogession.

    Now after waiting nearly a year PD is current again and was informed by consulate to schedule interview. Since August I have been going to CSC to schedule appointment but it always says "no appointments available at this moment". :(

  22. thank u so much 4 the reply. i also want to ask this that our police certificate and medical is expired so do they ask again for these documents and if me and my daughter wants our passports so do they give us as our police certificate and medical are expired? my daughter has given interview along with me n my husband

    You have mentioned that you have already attended your interview but still waiting for your passports/visas. I see from your earlier post that your interview was on 18. January 2011. Somewhere around that time F4 category went into retrogession.

    People who already had their medicals/interviews were put on hold until further notice. I assume that's what happened to your case. As far as your daughter is concerned, if she would have aged out, the CO would have informed you at the interview that she is not eligible. So she should be OK

    Savy.boy mentioned "If you and your daughter are clear , you both can go to USA. but your husband have to stay in Pakistan , until he gets his clearance." Be careful here - For F4 category - Application Form DS230 - line 31,a - "Persons who will accompany you to US..". if you mentioned there that you will accompany (husband and daughters name) then you all have to enter the US together.

    You mentioned that DOS cleared you and daughter but husband is till in AP - that delay could be due to fingerprint check.

    I am not sure about the police cert. and medicals, if they have to be valid at the time of entry to US. I suppose they have to be valid at time of interview because I have to do them again as I am waiting for my interview due to retrogession.
