  1. Hello everybody..! I'm not very new, I follow this forum every once in a while and I'm in love with this forum and the great ideas from all kind of people.

    To cut my story short, I received this email from the uscis on February 22 2013 around 11:30am. Before i can paste the message i would love to know what they normally mail when your vawa/i360 gets approved? Is it a i797 receipt because i called the uscis office and the automated machine said i should be getting an i797 receipt in the mail........and 2)Does the below email suggest that my 360 was approved or i should wait for the receipt in the mail which has all the details?. .Ok the email stated as follows................

    count me too, we applied vawa at the same time, but you got appproved, I wait for my RFE reply for one year no any result, so far i wait for my vawa for 20 months!

    Young seattle you are not alone, i filed my i360 in april 2011 but no response as yet. My attorney told me all i gotta do is wait, im surprised to learn that the word expedite exists which is contrary to what my attorney told me. im glad VJ gives us the knowledge.

  3. No, it's here in California and Texas.

    One friend called in California and was told by San Bernadino Sherrifs that they couldn't compel him to vacate his residence.

    I personally called in Texas and was told by the slack jawed yokel local Costabulary basically the same thing. I'v eseen it also on Cops hence my understadning.

    On the other hand, in Nigeria for $20 they will not only help you get her out but will also put her in jail for making them have to come out.

    I concur with you gowon, in ohio they also wont compel the other party to leave unless one consents, whether its a significant other or a roommate. As long as the person has their clothes in that residence u cant make em leave. But it would be possible in case of abuse or something of the sort. I remember i called the cops on my husband one time cz he was yelling and cursing me out, i told the cops i wanted him to leave for the night but they told me as long as he didnt touch or threaten me they couldnt ask him to leave, instead they told me if i didnt feel safe then i should call a friend to pick me up or drive to a friend and spend the night....and that was that.

  4. Im glad that this question was raised. I too was married in 2010 and filed my taxes as married but separately. SO when i filed my i360 or vawa, they sent me an RFE for joint taxes. So is it ok to send in the 1040 showing that or do i need to make any ammendments or audits on it??? what if they ask me why i filed separately? thats something thats bothering me too and i still havent send in my RFE. i know it would look suspicious with the USCIS but i honestly had to do it.

  5. Hi sandranj, I do appreciate for your info. I do have another question, Ok My RFE also requested for my 2010 Joint tax, the problem is i filed my taxes as married but separately and the reason i did that is because my then husband had never filed his taxes for atleast 10 years and that was before him and i even met. We were going to try to solve that whole issue in 2010 but unfortunately thats when things between us got even worse. IS that a red flag on my part or how could i explain on my affidavit that i was married but filed my taxes separately? plus he never even filed his taxes that year too. Can someone advise me on what to to or how to go about it??

  6. sync78, I agree. Unlike your case, I have mountain of official evidence. I'm spending a few months on this forum, and putting the entire packet in order - before I even see my pro-bono attorney for the first time (now scheduled mid-Sept). Hopefully, all attorney will have to do then is just submit it the way attorney knows best

    Good luck singledad2usc. Knowledge is power and power can save your life. With my little evidence, i just hope ad pray for the best cz at times less is more. :-)

    Congrats Palmbeach. Were you able to expedite your I-360? If yes, for what reason? would appreciate if you can share this with us.

  7. Oh ok sandranj, thanks for the info. its funny cz i asked my attorney about that and he told me there was nothing they could do about it but just wait. Some just dont give their best shots with their clients, i think theres quite a few that treat cases like its their last & one and only case, some just care about the money. There too many things i had to learn and do on my own due to the fact that my attorney wouldnt tell me all i need to know. Sad truth.

    Hi Lorphelpme, I thought the same way since i was already in the removal proceedings before i filed for my i360, but thats not the case , they take just as much time as they would with a normal vawa, no preferential treatment or expediting :). I am a living example. Filed my vawa in may2011 and the only time i heard from them is last week when they sent a RFE. Good luck with your case.

  9. Thanks Jihana, i do gave the evidences and affidavits that my friends and family wrote, but his side of family especially the cousin wont help cz he thinks im trying to have his cousin arrested. My RFE stated that they wanted affidavits from people that actually saw the abuse not per hearsay, as in what i told them or how they saw me swollen or whatever. i didnt have police reports cz he was always threatening me with ICE from the getgo so i would never do anything to harm him. Moreso im in the removal proceedings because he called ICE on me. I dont have any pictures but i do have a doctor's record, but unfrtuately when i went to the doctor with a fractured tooth they coded it as a normal fracture due to decay but the reason why i got it pulled is cz he pushed me to the ground and my decayed molar fractured and started hurting, so i had to get it pulled out. my situation is so complicated. my attorney tried to talk to the dentist but there was nothing the dentist could do since i didn't tell them that during the visit, all i aid to them is i fell down and fractured my tooth.

  10. sync78 are you asking about the J1 two-year rule?.Yes there is a waiver to have the two-requirement waived.

    No, u earlier mentioned to me that during removal proceedings if i remarry, the new husband cannot petition for me based on a marriage formed unless i left the U.S. for two years. So thats y i asked about having like a waiver for that 2 year period you earlier talked about. Thank U.

  11. sync78 it's possible to have the vawa approved even if you didn't get a prima facie.You opened two threads an posted here your case (03)please keep one thread about your case ok.I answered your question before.

    If you get married now your Vawa case will be canceled. During removal proceedings your husband cannot petition for you based on a marriage formed unless you leave the U.S. for two years (INA § 204(g)).

    .There is an automatic presumption that the marriage is fraudulent when it happens during removal proceedings. If you are living with your boyfriend for a while, and you have a genuine relationship then you may have a chance to get married and adjust your status in the USA,or if you made plans before the removal proceedings to get married and you were already taking care of things such as organizing the party, church etc...you will be able to prove a bonafide marriage or if you have a child with him as well. Besides these circumstances i don't recommend you get married with him, because you won't be able to stay here based in your marriage with him.

    You have a Vawa case pending then the judge won't decide anything regarding your removal next month, but do not go alone to the Court.Are you living in the USA more than 3 years? if yes then your lawyer can ask for "VAWA Cancellation".You can apply for VAWA cancellation only if you are in removal proceedings.Vawa is decided by USCIS, but vawa cancelations is decided by an Immigration Judge. If you arrived in USA more than 3 years ago the you can apply for this kind of relief,otherwise you will keep your Vawa.

    You can have your I-360 approved if you received an RFE, no problem at all. Ask your lawyer to call USCIS because you got the RFE more than 1 year ago. He can ask USCIS to expedite your vawa because you are in removal proceedings. Good luck.

    So basically you are saying i can apply for vawa cancellation and get married to my fiance??? This situation is so overwhelming to my fiance, he is so scared on my behalf and fears for the worst, he tried to make me cancel my vawa so we can just get married but i feel like thats the only revenge i can have against my abusive ex. I have been in the US fr 8 years and counting...So is vawa cancellation some type of relief or what??? Im so confused at this point, idk what to do and my lawyer isnt giving me much info. The first time i went for my master hearing to see an IJ i went by myself and i had a few of my paperwork which i presented to the judge but after that i have been going with an attorney. At times i think i should have done all this by myself, maybe it would be faster coz it only me that knows what i need and how it feels to be abused, in the removal proceedings and to have a vawa case that may/may not be denied.

  13. Hi Sandranj, Thanks a lot for the info. I actually received my RFE last week and some of the things they are asking for is impossible to get for instance, my ex hubby moved in with me when i already had an apartment so there was no way i could add him and his rental history couldnt allow him to be added to my lease, so i got a letter from the leasing office stating why they couldnt add him but my RFE want me to include things like that. Then the utilities were in my name too except fr the phone bill but they want more utilities included.

    I have been in the removal proceedings since april 2010 when the ex an i finally called it quits cuz he would constantly choke me an hit me, and he moved in with another woman. Prior to that he always threatened me with ICE and finally when it was over between us he sought vengeance by calling ice on me simply cuz i asked him to leave and told the leasing office who in turn sent him a letter since he wasnt an occupant on my lease.

    After ice came to pick me up they gave me a NOTICE TO APPEAR and i have been going to see an IJ and DO since then. My lawyer advised me to file for i360 for vawa since the relationship was abusive and thats what i did in may 2011. Since then i never heard a word frm VSC until last week when they send me an RFE. So if my vawa gets denied will they deport me or what are they options that i would get since u said re-marrying was not an option??? My current fiance and i are gonna be moving in together around october but like i said earlier we are not married and im not intending to get married until my vawa case is over.

  14. I'm glad I asked... An expert may answer your question, hopefully soon; I'm just trying to educate myself and file VAWA via pro-bono immigration lawyers. It sounds like you originally filed without any help? Do you have help now?

    Yes i tried to file via pro-bono but they dropped my case since i wasnt documented yet i was working,it was a lil complicated but pro bonos are the best since most of them especially the catholic charities deal with that kinda stuff quit often. Im now past all that cz i eventually hired an attorney and i also got my EAD and renewed it just this year. Best of luck with your case.

  15. Im in the removal proceedings and divorced from my abusive ex husband who reported me to the immigration a day after i kicked him out of our apartment in april 2010. I filed for VAWA and to date my case is still pending, last week i received a RFE. Im lost simply cuz i submitted all the documents required. I have been waiting for more than a year only for them to send me a RFE. IS it normal to receive an RFE?? One of my friend s told me that there are higher chances of getting denied if u get an rfe and if i get denied will i be deported or will they give me a chance to appeal??I have been dating a USC since the beginnning of this year and we just got engaged. He wants us to get married sooner but i explained to him my situation and he said he would wait for as long as it takes. So my question is, is it ok to get married if u have a pending vawa and pending removal proceedings?? my next court date is next month...Somebody plz help me...im baffled and lost.
