  1. Where does the US citizen live? If you live in the UK now with your spouse and your petition was filed in London at the USCIS office, then your process is different. But your timeline says you filed to Texas Service Center. So what is it? where did you mail the I-130 petition for your spouse? Texas is not an option.

    Hard to help without knowing more details.

    Sorry I filed in London and my wife is with me in the UK. I will recheck my timeline, I don't remember putting Texas.

  2. I am more confused than ever! LOL

    I have a case number which was in a letter telling me what they want next. My case number started with LND for London of course. This is NOA2? Or... Will I get another case number from the NVC?

    I was informed once they get all my documents they will send an interview date a couple of weeks after (when I called the helpline provided at the US enbassy London website). I just wonder roughly how many weeks away for an interview?

    I thought the embassy in London provided a date, not the NVC. I don't know though.

    I followed that link provided above, it is hard to make sense of it tbh. I know a lot of work is put into it though. It appears it is for petitioners outside the UK.

    I hope I am being clear enough.

    I have been married for 6 years (not sure if this is showing on timeline) and lived together before then. I am now awaiting for an interview, any idea how long this will take? As I've sent all forms they require and attend my medical next Friday.

    My next question is, other than the forms they require what am I going to expect at the embassy in London so far as, on arrival to questions?

  4. 2 months lol i hope not. i hope it is done ibm London.i have al the paper work and go to medical this Wednesday. i am hoping an interview in amonth. They said some thing about taking 4 to 6 weeks to file. they are not behind. everything has come much sooner for me so far.

  5. Congratulations :D that's very good news. when did you recieve your NOA1? I'm so curios cuz I applied last Sept. and didn't get NOA2 yet :wacko: .... I hope someone will help you soon

    noa1. is that what it is called? i just got a basic letter. it never stated it was a noa1. i applied end of august. all the letter said was it was accepted and what to do next but with the confusion of what i stated above. i am sure you will hear from them soon.

    I received a petition approval letter with a case number. I am confused as it states that I should not send any documents to the office until i am requested to do so; Does this mean I cannot send the ds-2001 and ds-230 form until they ask for it?

    Also:

    Do I send part 1 and 2 of ds-230?

    Can I attend the medical while I send the forms?

    Do I inform them of my medical date when I send the ds-2001 and ds-230?

  7. No problem. Your spouse needs to provide an I-864 regardless of income. Then one parent also provides an I-864 and the other an I-864a. One immigrant is one immigrant. Only the immigrant is being sponsored.

    Yeah, she completed one. Her father has also completed the I-864. However, we just got confused on the I-864a for her mother due to Q13. I thought maybe it was case number or the letter A. I literally put "ONE" and sent the form back for my mother inlaw to complete. My father inlaw also must sign the I-864a as well as the I-864.

  8. The number of immigrants being sponsored. For a spouse case, that would be one. Note that the I-864a is for a household member who is combining income with a sponsor or joint sponsor. Are you sure you need to be using an I-864a? What are the circumstances that lead you to do so?

    Well, the I-864a is being done by my mother in-law as she is on the I-864 due to my father in-law. I am the only one who is emmigrating to the USA as my wife is already a US citizen.

    The reason I am using my in-laws is due to their income, they are above poverty line by a nice margin and we ourselves don't have much to go on.

    I personally thought that the answer was "A" as my name was in that box rather than "one" however, it did state number. I am confused to why it asks such a question and should state "the above". So entering "one" would be the correct answer?

  9. A CR1 or IR1 visa holder does not ever adjust status. These are immigrant visas, so all you need for permanent residence is to enter the USA using the immigrant visa. If you've been married under two years when you enter (CR1) then you will "remove conditions" 21 months later but not adjust status.

    There's a place on the I-130 that asks if you are in the USA now, meaning at the time the petition is filed. If you were and answered that question yes, they are likely to conclude you intend to adjust status instead of apply for a visa. Your N/A in both blanks you mentioned will further confuse that issue, potentially resulting in the petition not being forwarded to the National Visa Center. It would go into storage awaiting your adjustment of status application.

    Contact them a couple weeks after the petition is received and make certain they note that the case is for a visa through London.

  10. The issue is that by putting N/A in both sections, it may not be clear a visa is being pursued. This could be particularly confusing if the foreign spouse was IN the USA at the time the petition was filed. I would CALL USCIS a few weeks after receipt and make a service request to note the petition is intended for a visa, not to adjust status.

  11. 1. What happens is that your wife fills in a I-864, her dad fills in a I-864 and his wife, as a hosuehild member, fills in the I-864A.

    2. There is only one joint sponsor, the parents together

    3. Your wife can write a short letter explaining why she was not required to file.

    And both of them count as a whole household income? together they will be way above the poverty line.

    Also, I do not count my wife as being in their home on the i-864 form right? (as she is not currently living there).

    I was wondering about the i864 form. I will try my best to keep it simple. My wife is my petition sponsor. Due to moving, she will not have money to count as a consistant flow. She will have to use her parents, however, she still must fill the form out.

    So, I went ahead and read the forms. Her father is filing, however her mother is also in his household and must be included. Due to this it states she must also file an i864. My questions are:

    1. It is okay to then have the 3 affidavits?

    2. Would her father tick the "i am the first of two sponsors" and her mother "i am the second of of two joint sponsors"? If not what do they tick?

    3. My wife never needed to file for tax, a document from the IRS stating this will be enough for the embassy?
