Hello all,
I thought I would finalize this post in case anyone ever did a search on the same question I had.
As the posters here suggested, the VO did indeed approve the visa in our situation, but they are mailing the visa AFTER the two year residency has been fulfilled.
So to answer my original question, you can have an interview date scheduled before a J1 two year residency restriction has expired without an issue.

I apologize if the questions are similar, but no one answered the specific question about paperwork and when I asked my previous question she did not have an interview date yet. Unforunately there are no addendum instructions on the GNI-2 form. I hoped someone had some specific experience similar to my case.
As of now I am going with addendums to the GNI-2 form and the DS-230 part II form, which are the two forms asking specifically about the two year restrictions. Hope it works out for us! Just want to make sure everything is right, on our end!

Be truthful, not coy or evasive. You should likely use an addendum, refer to the form instructions for details.
You were given good advice, the last time you asked this similar question at the China forum in November:
Post #6 from Ryan H is the likely scenario. It seems that Darnell's guestimate (Post #12) of your interview date was pretty much right on the mark.

My fiance goes for her K-1 Interview January 9th. Her two year residency restriction expires on February 8th.
There are two forms the she is filling out that ask if she has fulfilled the residency restriction. Would the best way to handle this be to say she has fulfilled the 2yrr, and wait for them to question that answer, or to say she has not done so and add an addendum stating that it will be fulfilled in one month?
We tried to time the interview to coincide exactly with the expiration of the 2yrr, but were just slightly off.

Hello all,
We have an interview scheduled for January 8...well I assume this is the intake day because it is for 12:30pm. We are completing packet 4 and I do not understand how to complete DS-2054, DS-3030, DS-3026, and DS-3025, or if they should be completed at all.
It seems like we should fill out DS-2054 which seems to be a authorization of any required tests and then the remainder of the forms only require name, DOB, etc. and the doctor finishes the form after the exam. Am I correct or am I missing the boat?

My 'for fun' guess was January 7...her two year residency restriction will expire Feb 8th.
I am now debating on the question on the ds-230 part two with regards to the two year restriction:
Do I star the question and state there is an addendum as to why she hasn't completed the restriction? (that it will be complete in one month)
Or do I just let them ask her why she hasn't completed the restriction yet when they see the question?
Any thoughts?

Need a bit of advice.
When filling about the OF-169 form the instructions state to check each box that applies to the person before mailing. Most other forms say that you should not leave items blank; if they do not apply you should write N/A. Should I do that on this form even though it is not stated in the instructions, or is it better just to leave items blank if they do not apply? There is also a possibility that I am giving this way too much thought?

I guess I'm just getting ahead of myself. We were not planning on requesting anything until we send in the packet 3 information, but I was hoping she could request an interview date after the 2 yrr was fulfilled when we sent the packet in.
I will make the necessary calls to nvc and dos to make sure we stay on top of what's going on...

What is the 2 year residency restriction? I have never heard of it. My wife is also in Guangzhou, so I am naturally interested to hear about it.
She was in the USA on a J-1 visa for a year, and sometimes you are required to go back to your home country for two years before being granted a visa back to the United States. I have been trying to time everything properly so we will not have to wait longer than the two years we will have already waited.

OP, if the interview takes places prior to the end of the HRR requirement, the Consulate will delay issuing the visa (provided they approve it in the first place) until the HRR has been met.
Thanks for the information Ryan. So it sounds like we can go ahead and proceed. I noticed that the ds-230 part two form asks if one has fulfilled the two year residence requirement, so I guess she needs to check 'no' to that box and state that her 2 year requirement will be fulfilled Feb. 9th.

Is it known for a fact that they will deny the K1 if HRR has not been met yet?
Or will they approve it and she can not leave China until 2 yr HRR is met?
Good question and I am not sure. I am going to email Guz and ask as soon as I have a case number from NVC and hope they can give me an answer. If that is the case I'd be much less worried!
I just hoped maybe someone here might have been in the same situation.

Hello all,
My fiancee and I recently received our NOA2. We are glad to have some movement on our case after waiting patiently for 6 months.
My question is concerning the visa interview. My fiancee cannot come to the USA until she has fulfilled a 2 year residency restriction in China, which will expire February 9th. I have been trying to time this all properly but it seems like everything may be going a little faster at the consulate than the Guangzhou website states.
I was wondering if, when sending in packet 3, anyone has had luck in asking for an interview AFTER a certain date. I know that one can't ask for a particular interview date, but if it is scheduled before Feb. 9th the visa will be denied because the 2 year restriction hasn't been completed.
Another option may be to try to get the interview asap and then reschedule.
Does anybody have any thoughts/advice about my dilemma?
Oh, one other quick question since I'm asking....does my fiancee have to fill out the medical forms in Packet 4, or does the doctor do that during the medical examination?

Hello,
I am looking for any recent information on what should be included in an application for my wife's (permanent resident) parents to come visit us in the USA. In addition to the DS-160 application, what can we do to help or what are the important things that they need to provide? I plan to include an invitation letter. I have been reading mixed opinions on I-134 affidavits of support. I understand the intent to return is the most important.
Any tips, links to more information, or recent experience would be greatly appreciated!
