    The immigration officer said the fee is lost and we have to reapply even though the conditional residence since date was incorrect per their error.

  2. My conditional permanent residency card said my resident since date was 2/24/14. Later when I applied for and received my  non-conditional permanent residency card the residenct since date said 12/16/14, not 2/24/14. I included copies of both cards in my N400 application. I then applied for the N400 on about 3/1/17 and waited until my citizenship interview 12/12/17 for the immigration officer to tell me that I applied too early and that I would have to pay $725 again and reapply and wait 8 months again.

     

    What can I do to prove that uscis made the resident since date error and not have to wait another 8 months and spend $725 to reapply. Are there any ways to get an issue like this resolved timely? Has anyone else had a similar experience with a uscis error?

  3. I am recently graduated and under my mom's health insurance currently. I work as a Payroll professional intern at Disney in Orlando Florida. In June I plan to find a career with benefits preferably with Disney but until then I need insurance for my spouse Fernanda. I will be covered until age 26 by my mom unless I find an insurance plan before that. I just turned 24 in January.

    I am doing quite a bit of research and I was wondering if anyone can help me answer some questions in regards to getting health insurance for my fiance. Does anybody know if my fiance can apply for health insurance via the healthcare.gov website? She just entered the United States on a K-1 visa and we were wondering if she would be permitted health insurance if we applied. Note, she is not yet a citizen as we are still waiting for the green card AOS things. Please let me know what type of insurance I should find for her. Also, do you know if there are any dental & vision insurance that I can purchase together. I have been looking around and I was wondering from anyone's experience if they know of a good insurance company I should look into.

  5. My fiance is arriving in Orlando on January 29th and we want to get married as soon as possible and get the AOS things ready to go. We were wondering how do you schedule a biometrics exam? Do I have to schedule this or will I just be mailed a time when and where I need to take my fiance? I live in Orlando Florida so if anybody knows a place there to get a biometrics exam taken care of please let me know.

    Also, does my fiance do the exam after the AOS packet of things have been mailed away by me?

    PS What are the best short-term 5 month health insurance policies I should get for my fiance? I am also looking for a vision provider as she will eventually need a prescription for new contacts? Any ideas??

  6. $1,070 total.

    File for EAD/I-765 with the AOS application. EAD is a temporary work authorization and is usually approved in 2-3 months.

    Consider also filing for AP/I-131 so she can have a temporary travel authorization.

    AOS from K-1 timelines vary greatly. It can take a few months as it can take more than a year. That is why filing for EAD and AP is a good idea (fees for those two applications are waived when filed at the same time as the AOS). The EAD/AP card will be void once a decision is made on her AOS case.

    Both I-765/EAD and AP fees are waived when filing all at once with the AOS application? I can't seem to find it on any official I-485 document but thats great news to my ears I hope this is true. Either way I intend to file for all 3 at the same time.

  7. My fiance Fernanda already has her drivers license in Brazil. Once she comes here to live with me will I need to simply go to the DMV to prove her residency to get her a state drivers license? Will I need to file an AP/I-131? She will be fine driving in the US with her Brazilian drivers license correct?

    Also, is the EAD/I-765 form simply how Fernanda would apply for her work permit, is that what that form essentially does? Also, you said filing them together would not result in an additional fee is that how I should interpret it. Simply attach that application and supporting documents behind the AOS when I send it in?

  8. I was wondering if anybody knows exactly how much to expect to pay for Adjustment of Status and Work Permit. My fiance will be arriving in February and I was wondering if anybody has gone through the entire process of paying for those items or if I should expect to pay for other things. Also, how long did it take to receive the work permit and adjustment of status. My fiance intends to work as soon as possible and was unsure about the timetable when she would be able to legally work.

    This is how it went

    Officer: Who are u vising? Friend, Family, BF?

    ME: My fiance

    Officer: How nice!( was he was stamping my passaport)

    Officer: 4 finger please...

    HE didnt even ask me for how long i was staying! NOTHING! and I had everything with me NOA1 NOA2 everything!!!!!

    now i just have to go to the interview next month!

  10. I have done my research on my question by searching the custom search and looking at blogs outside this site and have not found a solid conclusion as to my answer. Can anybody please answer or provide any additional comments on similar experiences they may have had in relation to my situation and questions below? I appreciate all your help



    Ok so today I received a letter from the NVC saying the I129 petition has been sent to Rio di Janeiro where my fiance Fernanda will be required to schedule an interview for the K1 visa. Does anybody know what the steps like going forward from this stage in the visa process? We ideally would like to schedule Fernanda's interview in December because that is the only time she can travel and get off work to go to the interview in Rio from Sao Paulo. Does anybody know how the "scheduling" works for the K1 visa interview in Rio?



    Also, on my NOA2 it has a "validation" date on it from 4/19/2013 t 08/18/2013. What validation date does this exactly mean? Does this mean that Fernanda must receive her K1 visa before the expiration date of 8/18/2013 or what does this validation date specifically mean?

  12. So once the Embassy in Brazil has my case and if we request an extension for the K1 visa for instance lets say to schedule my fiance's interview December 15th based upon personal reasons, then it would not matter that my I-797 NOA2 has expired from the 8/18/2013 date?

    We are thinking of sending the embassy an email stating our reason for requesting an extension " on VJ i heard it was called a "reissuance of K1 visa". Do you have any comments about how to properly go about doing this, I'm guessing send that email once the Embassy in Brazil has contacted my fiance to come for the interview.

    Is there anything else I should be aware of with my situation? I appreciate your help alot! Thank you so much!

  13. I have another question for anyone who may know the answer. So Fernanda and I had a discussion tonight and we now think it may be best to just request a reissue of the K1 visa so that she can schedule her interview sometime in December. What we are thinking is that I am still in college and in December I plan to have a full-time job to be able to support us as right now I don't really have too much income. Also, Fernanda can't get off for work to go all the way to Rio to do her interview until Brazilian summer in mid-December. So we feel that for those reasons we want to request a reissue or extension of my NOA2, I am not sure how to go about doing this and I am looking for advice. Since the NOA2 has already been approved and is in the process of being sent to Fernanda to have her interview scheduled, should Fernanda just call the consulate once they notify her to schedule an interview?

    I heard from a few posts that people must write a written request for the extension of the K1 visa, is this true? Also, is there anything I must do back here in the US to help make sure this transition works smoothly?

  14. That was the solution I was trying to figure out buy you totally make sense. So if my fiance in Brazil took her medical exam and interview before 8/18/2013 which would be when my I-127 (NOA2) expires THEN her K1 6month time would start from the day she gets approved from her interview. Theoretically, if she gets approved 8/15/2013 for example we would have until 2/18/2014 for her to come to the USA and then 90 days to get married from that point. Does this all seem logical?

  15. I received my NOA1 September 14th 2012 and received my NOA2 (I-797) April 19th 2013. It says "Notice Type: Approval Notice Valid from 04/19/2013 to 08/18/2013." Does this mean that my fiance has to come to the USA to live with me before 08/18/2013?

    Below on the form that it will take a few weeks for the NVC to process the approved fiance petition and send it to the US Embassy in Brazil where my fiance is from. I am currently in school and will graduate around December 15th 2013 which is when we originally planned for my fiance Fernanda to come and live with me and then we would get married.

    Does anyone know what the exact final date my fiance would have to come to the USA to live with me? Does it go from the date of her interview in Brazil or is it the date on this I-797? Also, is there ANY way to extend the 6 month time frame because I don't want my fiance to come to the USA to live me with while I am still in school and because she teaching and would like to finish out the year in December. Once I graduate we will be much more stable financially as well as it will be a perfect time for her to come live with me.

    What are your thoughts? Have anybody had any similar experiences or know of any stories about this type of situation?
