The U.S. Supreme Court ruled in Plyler vs. Doe (457 U.S. 202 (1982)) that undocumented children and young adults have the same right to attend public primary and secondary schools as do U.S. citizens and permanent residents. Like other children, undocumented students are obliged under state law to attend school until they reach a mandated age. As a result of the Plyler ruling, public schools may not:

• Deny admission to a student during initial enrollment or at any other time on the basis of undocumented status.
• Treat a student differently to determine residency.
• Engage in any practices to "chill" the right of access to school.
• Require students or parents to disclose or document their immigration status.
• Make inquiries of students or parents that may expose their undocumented status.
• Require social security numbers from all students, as this may expose undocumented status.

Students without social security numbers should be assigned a number generated by the school. Adults without social security numbers who are applying for a free lunch and/or breakfast program on behalf of a student need only indicate on the application that they do not have a social security number.

Changes in the F-1 (Student) Visa Program do not alter the Plyler obligations to undocumented children. These changes apply only to students who apply for a student visa from outside the U.S.

Finally, school personnel -- especially building principals and those involved with student intake activities -- should be aware that they have no legal obligation to enforce U.S. immigration laws. (U.S. Supreme Court, 1982)

I will rephrase the question ----- Can a child attend school after filing i-485 AOS?

I was an I-130 immigrant who is now a US citizen. My daughter from a previous marriage wants to leave England and come and live with me in the US. Her mother and i have discussed it and think it would be a good idea, more opportunities, better weather etc etc

My question is, if she was tom come over on the Esta program and I filed I-130 and I-485 AOS while she is here, while we are waiting for the I-130 to be approved (it will be definitely) can she attend high school?

Thanks again to all who replied to my question. I have an update that might be helpful to others who find themselves in a similar situation: I called USCIS this morning and they confirmed that I can travel with the old GC and the one-year extension letter without any problem. In other words, the extension is still valid even after one's I-751 has been approved. So I don't need to get a stamp in my passport or anything of the sort. (When you think about it, it makes perfect sense that it would work like this: after all, someone could travel outside the country while still waiting for a decision, and it would be absurd if they had any trouble re-entering the country just because an approval was issued in the meantime.)

This actually happened to me on Sunday. I flew back from the UK and landed in D.C. not realising I had an approval last Wednesday. I came through passport control with my current green card and extension letter with no problem.

Hi guys, my stats aren't in the list but I applied June 1st last year, NOA June 3rd. Got my approval letter yesterday in the mail from the local Norfolk office, approved April 27th. My online status has not changed and still says Case received. I can't believe how long it took. Filing N400 May 23rd!!!

Firstly, I'll tell you the situation. Last year I finally emigrated to USA from UK to be with my American wife. I now have Green Cad with conditions attached and will be losing those conditions, hopefully, in 12 months time. My daughter, who is 13 years old and from a previous relationship would now like to come and live in America with her new stepmom and I. I have seen various ways of doing this but cannot find a definitive answer, so here are my questions.

1. Is the I-130 route the only route?

2. Do I have to file I-130 while she is in England or can she come over beforehand and file it while she is in the states, thus, her not having to return to England.

3. If she does come over while filing is in progress, will she be able to go to school, will I be able to register her on our health insurance.

I have just nearly completed 24 years in the Royal Navy and will be picking up all my medical records from the Sickbay tomorrow, so hopefully that should suffice because if I had any disorders either physical or mental, then the Navy would know about it!!!!!

Fair enough. I was only guessing at a reason why they might want it - I sometimes wonder if it's just a blocker to stop booking their medicals too early. It is ordinarily required though (as you'll no doubt have seen on the embassy website and the pdf above).

Yes I agree, I know it is required, I did order two copies, sent one off to NVC and kept the other to take to medical, but I can't bloody find it!!!! lol

I had wondered why we needed to take it to medical when other countries don't.

I even called the NVC and asked them why I needed to take it to medical and they didn't know, they said to discuss it with the consulate.

I've just called the London US Embassy and told them that the NVC have processed my Police certificate, it's on it's way to them and I don't have another. I actually do have another but can't find it anywhere!!!!! and they said that's OK. Just tell the guys at the medical that the embassy already have it because the NVC passed it to them.

So, I'm assuming that the Doctor doesn't actually need any information from it at all?

It's a way for them to find out if you've had any drug related convictions, I assume?

Why do I need to take a Police Certificate to the medical?

I have already submitted my Police Certificate to the NVC and I'm case complete so It must be Ok, in fact, in my Email it says 'O The NVC sent this form or document to the U.S. Embassy or Consulate'

I haven't got another one so it looks like I'm stuffed, medical is next Friday

Also, please don't take any stats or information regarding the length of time it has taken us to complete this process. This is because I am in the UK Armed Forces (Leaving in two months) and WE have dictated the length of time rather than USCIS and NVC dictating the length of time. We could have completed last year but I wouldn't have been able to move to the states. We took it slowly on purpose.

After waking up on Saturday and seeing that a few people from the UK had called the NVC and were told that their interview dates had been scheduled, I have been waiting all weekend to call them myself to see if mine had been scheduled too.

I just called them and guess what? I have an interview date set too!!!!!!!!!!

Aug 6th - This is great and also unbelievably typical because my wife flies back to the states after being here in the UK for a couple of weeks holiday on Aug 5th!!!! lol

So dwheels, if you would be so kind to update us on the list, that would be awesome!!!!! (just getting into the american lingo there) ;-)

K1s and spouse DCF require a medical before the interview will be scheduled. Regular IR1/CR1 get interview date then schedule a medical so they attend before their interview by at least a week to make sure the results are there by interview day.

Lost--I corrected a few posts you made about that but I guess you didn't see it. One was a person working out timing to return from the US. You said two trips back. I explained they only had to go back a week before the interview and squeeze in the medical.

I am CR1 so will just wait for interview date then book my medical.

The guide for CR1 needs to be edited because it doesn't state what you said.

Well, I'm a bit confused too, but you definitely need to have HAD the medical before the interview (it takes them about 4 working days to get the results to the embassy). I thought no matter your visa type you only needed your LND number and Police certificate to book, and have, the medical.

I called the Office and got told you have to have an interview date scheduled too

I read in the CR1 guide on here that you can have your medical at any time you want, however, when I called the Harley Street doctors office in London, the receptionist told me I had to wait until I had my interview date to book the medical.

I also read that you won't get an interview date until you've done the medical.

Which is the correct way?

Totally confused, I don't want to sit here waiting for an interview date which will never come because I haven't done the medical!!!!

Welcome to the group. Congratulations. I have added you to the list (see above) I put your case Complete at 6/26. If you call NVC they will give you the exact date of Case complete. The email always comes a week later for whatever reason.

Now you are in the long interview queue waiting on next round of interviews that's for August that has not started yet.
