    But on the income portion of it, I still don't know how to distribute their "income" . Each one of them has a w2 with some income. And they together have the 1040 (from the business) with the rest of the income.
    The number from the form 1040 (line 22-total income) , do I split it in two and add it to each one of their individual w2's ? Since they both equally share the business ?

    Also what is the difference between filling two I-864 forms, in comparison to filling one I-864 form and a I-864a ? (I never saw the I-864a in the instructions of the I-864, instead it said to fill another I-864) , I just want to make sure.

    My wife's parents (who own a business) will be sponsoring me for the form I-864. I have all of the proper income/tax documentation from them.
    However I am insure as to how to fill in their income into the form(s) [2 people = 2 forms] .
    Since they share a business (and therefore most of their paperwork is together) I don't know if I should add their W-2's income + the income of the business divided by 2?

    The income from their w-2's is not enough , so how would I add the income from the business onto that ?

    If anyone knows what numbers I should use for this I would greatly appreciate it.

  3. Hello everyone, I am a F-1 student at the moment, filling the forms for adjustment of status through marriage. But I have a few concrete questions regarding some of the forms. If anyone can help me, I would really appreciate it.

    1) Form I-485: "Current USCIS Status" and "Expires on" . --> Would I put "F1" and "expiration date of visa" respectively here?
    2) Form I-485: "Nonimigrant visa number" --> I have looked online for this, but cannot come to an answer. There is nothing called this or similar to this on my visa. I am not sure what to put here.
    3) Form I-130, question 22: "USCIS office in.." ---> how do I know which USCIS office I should use? Simply the closest to where I live? Or is there a designated office for certain locations?

    4) Form G-325A: "File number" ---> Starts with an "A" according to the form, however I have no idea where this number would come from.
    5) Form G-325A: "Alien Registration Number" --> Exactly the same as above, starts with an "A" , yet I don't know where to get it from.

    6) Form I-765, question 16: "Who may file form I-765" --> I am not sure on the category, I belive it might be (a)(9) "k-3 Nonimmigrant Spouse of US citizen or K-4 Dependent" . (I got married to a US citizen, currently going to college on a F1 visa. I have been in the US for more than 90 days. And I am applying for a green card.) If (a)(9) is the right category, which parenthesis would I leave blank on the form? (there are three parenthesis to fill).

  4. And from the moment I receive my 'new combination of EAD/AP' I won't be attach to the F-1 OPT rules? For example: I have to work full time (more than 20 hours, and I have to do it only within my field of study?.

    Are there any 'job' rules for the EAD through the AOS process?

    And if I am not planning on leaving the country I don't have to file my I-131 , is that correct?

    First of all a little background information: Me and my fiancee are planning on getting married sometime in the first half of next year (2013). And I (I am the foreign, she is from the US) am currently an F1 student starting my OPT on february of 2013.

    My question is, when we file for AOS, my OPT goes invalid the moment we send all the forms for AOS? Do I have to send the form i-765 once again? And instead of answering question 16 like a student, I would just do it differently?

    We do not have an exact date of the marriage quite yet, but assuming I am 4 months into my OPT and lets say that's when we get married and send the papers, does the work permit restart? Do I still have my 12 month limit of work permit, just like I have now as an F-1 student? Or the 12 month time limit doesn't apply anymore after we apply for AOS?
