  1. Long story short:

    1. Started dating in 2008

    2. Engaged in 2012

    3. Married in August 2013

    I'm a Canadian citizen who had been working/living in the US under TN visa status since 2009. Once married, I filed for AOS. I was granted my conditional GC at the end of July 2014. Around the same time, my wife (US citizen) admitted to infidelity and I decided to move on. I am now living in another state (IL). W e are currently discussin which route to take to end our marriage legally. Since we have been married such a short period of time, she was told by a lawyer that is would be easier for us to pursue a dissolution of marriage vs. divorce. I am wondering if doing so will affect my ability to apply for ROC and gain Permanent Residency in the US when it comes to do so?

    Also, I would like to consult with a qualified legal professional about my situation and what steps to take next. Would anyone on the forums know of a high quality, dependable lawyer with experience dealing with immigration issues, as well as divorce?

    I am living in the Chicago area and appreciate any help you can provide me with. Thank you.

  2. Hi all,

    I have posted several times in the past regarding my immigration situation, so I won't go into much detail. On to the actual issues:

    1. I have been working in the US via TN status each 12 month period for the last 4 years. I plan on reapplying for this again in about two weeks and expect no issues.

    2. I will be marrying a US citizen in about 6 weeks.

    I was going to just file the change of status paperwork myself, but am now getting qorried about the timeframe of the filing and the "intent to immigrate" issues it presents. I'm looking for advice from anyone on here who has gone through a similar situation. Should I wait an extended period of time after the wedding to file for change of status? Should I just hire an immigration lawyer and start the immigration procedures from scratch (as though I was not even in the US for employment?

  3. So here is the scoop. I have been working in the US under TN status for the last 4 years. Each year I left and renewed the TN status...samer job, but the school has me on annual renewing contracts (boo).

    Anyways, I was considering doing the "renewal by mail" option for my next year of employment. The issue is this:

    • My current visa won't expire until August 13th, 2013
    • My new TN status is scheduled to start August 15th, 2013 (or so)

    My question is this...I am planning on doing a "roadtrip" across Canada from the 27th of june through to the 13th of July. Am I allowed to leave the US while my "renewal by mail" is pending???

  4. First off...thank you for the replies and in-depth information provided! I was wondering about a couple of other things related to my personal situation vs. general info:

    1. I work on 12 month TN visas...if I apply for AOS, will I be in trouble if my TN status expires while waiting for steps in the process?

    2. Should I wait until married to apply for AOS, or go after the K-1 status before the wedding day???

  5. Just looking for some initial info/advice from anyone who may have been or currently is in a similar situation...

    I recently just got engaged. I am a Canadian citizen who works in the USA under TN status, my fiance is a US citizen. We plan on having our wedding in late August 2013 in the USA.

    With that information out there, will I have to leave the US and apply for a K-1 visa? Can I just apply for AOS under my TN status?
