  1. after 5 mos.. we gonna do everything we can.. we talked to a lawyer and he said there's always a way for approval on a previously denied case so long as u dont have any criminal case. so thinking about my husband moving to my country is not an option. im gonna stay here and file again.

  2. hi has anybody here had experienced the denial of I485 together with the EAD? I had been waiting for my green card and EAD to be in my hands anytime this month or next month coz i never thought they'd be denied. i dont know the reason yet for the denial but i've called the USCIS but the three people ive talked to said they did not have an access to the letter so i just have to wait for the letter which im expecting to receive anytime this week. I havent told my husband yet about this and i know he will be so frustrated about this. i was gonna freak out and couldnt believe at first when i read the status check online...but oh my.. what can i do.. i was thinking that was just a dream.. that i havent checked it yet and my green card and EAD is soon to come. lol..

    i have not had interview..didnt receive any letter for that though. i had my 2 biometrics since they sent me another appointment letter after the first biometrics i had. i had my biometrics june 19 and july 16,2012.

    what shall i do?.. i dont wanna be deported.. will i be?.. is the denial of AOS always have a second chance?like to appeal or send another or new I485 application?... i dont know what to do. ill just keep on praying everything will be fine soon.

    another thing is if we file for another I485 would the processing time which supposedly should be 3-6mos to receive the permanent residency would take longer?since it's second filing?

    i am convincing myself.. this is nothing and can be solved.. everything will be fine. hakuna matata. :D

    and by the way.. i came to the US under k1 visa.

    And I am soooooo sorry for your denial :(

    I am so trembling because I entered the States on B1 visa and got married in 4 months. And now I am working on the forms for green card and I am soooo scared that I might be denied because I didn't have the right visa type when I got married :((((((

    Is there any chance for your husband to move to your country with you if you dont find an opportunity to apply for green card again?

  3. Hey everyone!

    I am working on the forms for AOS and have got a few questions.

    1) FORM I-864

    My husband has Federal income tax return only for past TWO years (2011 and 2010). He meets the Income Requirements ONLY in 2011 (he doesn't meet the requirements in 2010 and 2009).

    Right now he has a good job and makes about 120,000 a year. I am going to get some letter from his employer that states he's employed.

    But the question is do I have to find a Joint Sponsor if my husband doesn't meet the Income Requirements in 2010 and 2009?

    2) FORM I-765

    I entered the USA on B1 visa type and got married. There're questions 16 and 17 in the form. I am trying to identify the letter and number of the category that I must select in the instrustion. But I have NO clue which one it is.

    Could anyone help me to select the number and letter I have to type in the form?

    3) FORM I-130

    The following questions are going to be silly I just want to make sure we are filling it out correctly.

    Part C. Information about your relative

    There's the question #15 "Name and address of present employer.

    Are we supposed to put MY employer (not my husband's) if I have any, right? Because I don't work.

    And another silly question: #14 I have to write down my arrival/departure record (I-94) and there're space for 3 figures then HUGE dash then spaces for other 8 figures. So do I have to fit all the numbers from I-94 in this order? Because all those figures go like that in my I-94 form 123456789 12?

    Alright, I think it's all I am interested in and confused about right now. Although I might get some some questions later.

    I'll greatly appreciate any help from people who have already got through all those forms

    I am trying to fill out all the forms to apply for a green card and I should do it ASAP. So I've read this statement "If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US." here "http://www.visajourney.com/content/i130guide2"

    It sounds pretty scary.. I've got married on a tourist visa B1/B2 . Does anyone know what I shall do?.. Do I really have to go back to Russia and file the required forms from there?...

  5. hey! I see you're ready to file all the forms.. I am struggling with this issue right now. I dont know what forms I have to file to USCIS applying for green card though marriage.. The official website says it must be I-130 and I-485. But why are you filing the other forms? If you file all that dozen of the forms, are you doing it in one envelope or in two different?

    Please, share with me some information.. I have to hurry with my preparations but I barely understand what to do

    I'm trying to find out what forms I have to fill out and file to USCIS applying for green card through marriage. The official website says it must be I-130 and I-485 filed at the same time. But I've read on a website of some layer that I also have to file forms G-325a, I-693, I-765 and I-864. So I have to idea what to do and what to file.. If I file all these 6 forms, do I send it in one package on in two different ones?

    If it's possible I'd like to get some advice from you.
