Hello, i have one of my friend having a big problem with immigration. he is in USA on k1 visa last year and now applying for adjustment. They both are not getting along well in usa. His wife told immigration that she did the fraud marriage for money, but actually its just an excuse for her coz she wanna kick out my friend out of usa n go back to his ex-boy friend. My friend now want to withdraw i485 and go back to his country.

He is planning to apply for student visa to newzealand or australia. is it possible for him? will newzealand or australia check his background in usa that he have fraud marriage?

No because you have to stay in legal status for 10+ yrs until the immigrant visa number becomes available to you. You can't adjust status from K-1 visa through sibling petition 10+ yrs later. There is no waiver for illegal presence for siblings of USC. You better leave before you close the door to immigration for you forever.

And what do you mean you withdrew AOS because "marriage life doesn't work"? You said your wife took your money, claimed fraudulent marriage while living at another address with her boyfriend, gave a statement of fraud to ICE and you were told to withdraw I-485 and leave?

They gave me two option: withdraw it or keep going through ins.

I decided to withdraw it and saying that our marriage life doesn't work. coz my wife staying with her boyfriend n leave me here n stop picking up my phone call. she is disappear from me.

i will explain to an investigator.. is it a good option for me?

I'm recently withdraw my i-485 application coz our marriage life doesn't work.

I have my brother who is a us citizen and i want him to sponsor me so i can live here without going back to my origin country.

I'm thinking to stay here illegal while my brother preparing document to sponsor me. Will that work?

I nerver heard an investigator came to a house n said they are going to help us or anything. I should have gone through fraud interview room n put a handcuff on my hand n go to jail. I'm so hesitate about that at first coz I think my wife n his boyfriend ask somebody to play this trick with me. But then when i have an appointment with an investigator after my wife told him everything I saw his car license plat is a government car. They wear like a blue uniform n he asked me if I'm commited fraud or not? N there is a man standing right next to me keeping looking at me n noting what I said.

He said I gave my wife money to marry her n get a green card. N he told me to withdraw my i485 or keep going through? He want me to make a decision n email him then he will take care all of the paper. I want to talk to my wife if she is willing to come back n live with me but she didn't pick up my phone call anymore. I can say there is no way to make my first marriage life work anymore I'm so disappointed about that. I'm going to email an investigator n withdraw i485 next week. I really have no choice.

I should have known my wife only want money from me since we were just married. After we got married on january 23rd, she don't want to file for i485 for me at all. She said i have to wait for case number or sth that is not really is. As i did my research online i know i can file i485 2weeks after i got married. Until April 24th she agree to sign the paper for me. It took me 3months for just asking her to garder document related to her. I cant imagine she is trying to drag my time 3months for just a thing that could be done within 2 or 3 days. She said she will take care of all the paper work but she did nothing. I'm lucky that I can understand some English n read English or otherwise I could be worst than that. I did the paper work n ask her to sign for me coz I don't want to stay home all day n night for nothing. I need to go to work for money to pay rent n to survive by myself. I have gone through this bad situation until I got all the paper work n sent out to uscis in Chicago. I got biometric n I got interview schedule I'm so happy when I know I can go to work n see new world. Finally there is another big trouble coming again n it is over my ability to deal with. I'm so so so hopeless right now... I'm getting stuck in the middle of nowhere. Thanks for reading my story......... N thanks for any advise u gave me....

Exactly. Start looking at air fares.

I will need to sell my laptop and other thing to get money for ticket back home.

Is it possible if i want to come back again on student visa, k1 visa?

I have my brother living at another state and he is a USC. Can he sponsor me and come back again in the next 10years?

I am so sorry this is happening to you.

I don't have much advice, but can you get any of the money back from your wife? Could your parents help you?

I guess it all depends what you want to do, do you want to stay or go home?

If all else fails the Chinese embassy should be able to help get you home.

I really need my wife back and at the same time i dream about going to college everyday and night, but everything were ruined by my wife.

I'm so hopeless in my life.

But I didn't commit any fraud... What should I do?

Should i withdraw my I-485 or not?

This is my step for K1 visa to USA:

- My wife sponsor me to USA on K1 visa.

- We got married 1 month after i depart in USA.

- I file for I-485 and sent it to uscis lockbox.

- Got biometric appointment.

- Got Interview appointment for i-485.

- 1 week before interview investigator come to my wife's house and interview her to find out if we are fraud or not.

(Me and my wife are not living together. she told me to live at her sister's house and she will move to live with me soon, but it seem like she have no intend to move and live with me at all). later I found out that she is living with her ex boyfriend after she got married with me. She even told investigator that our marriage is fraud and even signed a letter admitted that she had fraud marriage. (investigator promise her not to take her to jail if she tell the truth). She said she got 25000$ from me, but this is all the money my Mom gave us to start a new life with my wife in USA. (This is Chinese people tradition to give money to their child after married). I'm new to USA and i don't even know anything about this country that's why my wife play this trick to get money from me.

- She is now living and happy with her ex boyfriend. she kept me at her sister's house and i don't even have money to buy food. I have no job, car or anything. All i do to survive myself is spending 65 mins to walk back and forth to mall and buy bread to eat. I sold my iPhone then save the money buying and selling iPhone on craigslist for profit to survive myself. this is a hard time and so stress out in my life.

- Investigator come to me and ask me to withdraw my I-485 application or keep it going through to INS. (He told me he gave chance to me so i can come back to USA again).

1. Please let me know what they are going to do with me?

2. What should i do? withdraw i485 or keep it going through?

3. What is next if i withdraw i485?

4. Will it effect my future if i have 2nd marriage life? (This is my first marriage life in my life and it doesn't work at all after we got married)
