I just wanted to make sure that you understand that since at the end of 2013 your husband was still a nonresident alien that the only way you can file a joint return for 2013 is for both of you to attach an election statement to the joint return stating that you want your spouse to be treated as a resident alien for tax purposes for 2013. This also means that you can't file electronically but must mail your paper return to the IRS.

    Yes, I plan on printing out the form from Turbo Tax and then mailing it in.

    Thank you for the help!!! Do you have any idea if there is a certain form to make an election statement on? Or just type someting up ourselves? If that's the case, what should it say exactly?

  2. We already decided to file married jointly, he has a SS#.

    I just didn't know if it was ok to just report the interest earned starting from September. Or does it need to be the whole year's worth.

    The full years worth came out to about $4300 USD (converted from pounds) in interest for the year. which seems to have added $2450 to what we now owe!!! Yikes that's 50% which seems wrong. (done on Turbo Tax)

  3. My husband moved here to US in Sept 2013 and we were married Oct 2013. He is still not a resident, however, we will be filing our taxes married jointly.

    Only I worked in the US last year. The only income he received during the year were his bank interest and stock dividends from the UK.

    Do we report the full year of his interest and dividends or just from September - December 2013.

    Just a quick one...or two!

    I understand that the I94 is now done automatically, that there is no "paper arrival form" and that I must apply online to retrieve it after I arrive. My question is, to those that have already travelled on their K1 Visa, I assume that you itemise each and every item that you're carrying on the flight on the rear of the form as all items will remain in the US?

    Also, just to confirm, a one-way ticket to the US is fine?

I paid the MRV fee and set up the courier earlier today using http://dld.bz/ivbook and the instructions given on the interview instruction document, as shown in Nich-Nick's link in the post above. It worked really well and the step-by-step guide shown was exactly how it played out during the payment and setting up of the courier. It didn't once ask for the interview date. Prior to paying for the MRV fee, it'll make you choose a regional UK centre for the delivery of your documents after, hopefully, approval, but after the payment is processed, you can very easily set-up the courier for home delivery.

  6. Just to let you know that I got in successfully at Chicago O'Hare. Really long queue for passport control and took about 75 minutes to get to the head of it (my fiancé was going spare and my US mobile couldn't get a signal).

    Was asked why I was coming to the US - I said vacation. I was asked who I was staying with - I said 'fiancé'. She asked when we were getting married and I said 'Once all the paperwork is finished and I got back for the medical and interview'. She mentioned that I had stayed the whole 90 days last time. I said I knew but I had a ticket for two weeks this time. She asked to see my return ticket and then stamped my passport to leave by 1 July anyway - so still the 90 days.

  7. We have just sent off our I-129F to the Dallas Lockbox via U.S.P.S. and sent it using their Certified Mail service (Certified Mail, Return Receipt). Through tracking it via the U.S.P.S. site, it states that "Notice Left (No Authorized Recipient Available)". I'm just a little worried that it's been sent to a near-by Post Office as it couldn't be signed for. Is this the service that the majority of you wonderfully, informative people use or have we made a mistake by sending Certified Mail to a P.O. Box? I notice that on the guide, it advises to send that way so I guess it's worked for others, right?

  8. First of all, what a site! A fountain of knowledge! My Fiancée and I are just about to begin the K-1 process and I have a query regarding the I-134, Affidavit of Support. If my Fiancée (Petitioner) can’t make the 125% income above the property level and the required assets (x3 I believe?), would I be able to “sponsor” myself (I have in excess of the assets required in fairly liquid assets). That being said, we would have a co-sponsor who can match the requirements. However, I believe from reading around this site, some embassies accept co-sponsoring and some don’t. Would anyone know if London is accepting of a co-sponsor? Both my Fiancée and I appreciate any advice.
