  1. Hola gente,

I am not sure if this is the correct forum for this question (I'm sure that the VisaJourney Gods will let me know)

Nevertheless, I am in DESPERATE need of guidance on this matter. I have been trying to convince my wife that Advanced Parole (Form I-131) will allow her to return from visiting her country.

She came here on a K-1 visa.

    We married within 90 days.

We filed the AOS packet (I-485) with along with Employment Authorization (I-765) and Advanced Parole (I-131)

I-765 was approved; she received her work permit card, and on the bottom it says "valid for advanced parole"

We are still waiting on AOS.

I have told her countless times that Advanced Parole is for reentry into the US, and that since she has it, she would be able to visit her country without any problems on return. However, her friends keep telling her that she needs her full-on greencard to travel. Can someone please clear things up for me/her/us??

Her passport bears her maiden name. Her work authorization card bears her married name.

From what I have read, in order to travel, she will need to buy the ticket under her passport name, but then use the combo Work Auth./Advanced Parole card upon reentering the US.

    Is this the case?

You guys have been so very helpful in the past.

My sincerest thanks for all your help,

    Jude

  2. Hello everyone!

This forum helped us get our K-1 approved, and now we need help with the AOS.

On form I-131, I'm not sure whether to mark Reentry permit or Advanced Parole, or both.

My wife and I are, of course, married, and together in the USA.

Advanced Parole seems to be for NON-permanent citizens outside the US.

and Reentry for PERMANENT citizens in the US.

My wife will be a permanent citizen once the i-485 is approved..so should I mark reentry? So confused!

thanks in advance for any help!

    Jude

  3. So after about an hour of waiting, we were called to the window for a preliminary interview. Then, after another hour the real interview began. It only lasted 7 minutes! It was in Spanish and the officer literally said that we had so much evidence that he had no questions to ask us. He also complimented my Spanish which was a plus :P Anyway! our visa has been approved! Thabks so much to everyone in this forum. You guys are absolutely awesome and always willing to help! Best of luck to everyone on their visa journeys. remember, you'll get there!

  4. Okay guys!

It's crunch time. I'm heading to Peru tomorrow for the visa interview.

I have a lot of the materials ready. I just want you guys to look over what I have and tell me if anything is missing.

    My fiancee has:

    -Medical exam results

    -vaccinations

    -police records

-recent letter of intent to marry

-two color photos as per consulate specs

    I will bring:

    -I-134

    letters from employers

    past three months of paystubs

    past three years of taxes

    original 129F receipt and NOA2

    evidence of relationship:

    -receipt for engagement ring

-new pictures of us (taken after I129F was submitted)

-boarding passes/copies of flight itineraries (trips made after I129F was submitted)

Should I include old photos and flights as well?

-handwritten letters/notes written to me by my fiancee

-I have some western union receipts...I dont know if these would benefit me or not

This is what I have so far.

If anyone notices anything that might be missing please let me know!

I leave tomorrow, and won't be able to get originals if I forget them here!

    Thanks!

  5. Hello guys, We have our interview date at the embassy in Lima Peru for the K-1 visa; however, I was wondering how necessary it is for both parties to attend. A plane ticket is ~ $700, and I'd rather save that money for the interview cost, medical examination, or my fiancee's flight here.

So my big question is this: how much does the presence of the petitioner aid in the approval of the visa?

If i DONT go, will We be rejected?

If i DO go, is it guaranteed that we'll be approved?

    Ughhhh!

    Any insight would be great!

  6. You don't need a letter from your employer, paystubs and taxes are fine!

But if you do want to send a letter, make sure it has a letter head with the company logo, it should tell how long you worked there and I guess how much you make since income is the important thing here...

I thought that paystubs,w-2s, and taxes would suffice, but theyre not listed on the instructions sheet:

    Supporting Evidence

As the sponsor, you must show you have sufficient income or financial resources to assure that the alien you are sponsoring will not become a public charge while in the United States.

Evidence should consist of copies of any of the documents listed below that apply to your situation.

Failure to provide evidence of sufficient income or financial resources may result in the denial of the alien's application for a visa or his or her removal from the United States.

Submit in duplicate evidence of income and resources, as appropriate:

    A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account:

    1. Date account opened;

    2. Total amount deposited for the past year; and 3. Present balance.

    B. Statement(s) from your employer on business stationery showing:

    1. Date and nature of employment;

    2. Salary paid; and

    3. Whether the position is temporary or permanent.

    C. If self-employed:

    1. Copy of last income tax return filed; or 2. Report of commercial rating concern.

Ill probably send them anyway....it sounds like the letter is pretty necessary though...

  7. Hello all! I was just wondering if my fiancee has to fill out the DS-156/DS-156K and take them to her interview? Or does she merely fill them out AT the interview? (we just got out NOA2, and we have read about these forms, but we arent sure when theyre needed) I wanted to get everything squared away so the process goes as fast as possible.

    Thanks!

  8. I just got by NOA2, and my excitement turned to confusion when tackling the steps left for us to get the K-1. I see alot of timelines where people are like "oh yeah i just emailed the NVC for expedited processing and they did it" ...is this real? How do you just email them? And does requesting expedited processing work? Also what number do you call to get the case number?

  9. Ok this is what I have after checking with my enamorada..again our interview was on Jan 23rd,2013 so this is all recent info.

I contacted the NVC approx 1 week after I had received the NOA2 and was given the Lima case#LMAxxxxxx. The NVC packet to the Peru Embassy was sent and logged by the Embassy in Peru approximately 10 days after it left the NVC. Exact dates I do not recall. The reason I was contacting the NVC than Embassy was because I wanted to check/change the interview date if it did not happen while I was in Lima. Luckily, I was able to change it.

The packet 3 she received had the interview date, the approved doctors for the medical check, the list of required documents and other instructions to be completed before the interview. Those instructions lead one to believe that one MUST do the medical check and have the report before the interview, but that is not REQUIRED for the interview. My fiancee ended up going to the medical check AFTER the interview and sent in the results via DHL as instructed by the consular officer.

The acta de nacimiento must be certified somehow and it is done at the same location that you go to request it. Sandra(my fiancee)told them she needed it for a visa/USA embassy and they certified/notorized it for her. You must pay for the antecedentes penales, antecedantes judiciales a nivel nacional and the policial at the Banco de La Nacion and have the receipt when you go to request those forms. Of those forms the policial was not taken by the consular officer the day of our interview, although it is listed in the instructions as required. Also for the antecedentes judiciales you can go to a website and request them, than just go to the location and retrieve them - it makes the wait time for the letter much shorter. We had been waiting for at least 90 minutes the day we went and noticed there was a website line, found out the website address requested the form thru my smartphone, got a ticket for the people that already had requested the form thru the web and not even 20 minutes later had the letter and left..

These documents do not need translation. I think that is all..ooh yes the day of the interview get there very early. We arrived around at least 1 hour before our scheduled interview time and the line was rather long, it took us almost 30 minutes just to get in the building. Some say that regardless the time you have the interview they take people in the order they arrive so plan on going there at least 90 minutes before the embassy opens, I think that is at 8am.

I hope that helps and good luck with everything!!

RS, you have been an immense help. Thank you very much, i just have one question. So we go to banco de la nacion and request all of those documents/pay for them there, but go somewhere else with the receipt to pick them up? Also, for the antecedentes judiciales, did you pay via your smart phone? Or how did that work? Did you show them your receipt on the screen of your phone? (id rather do ot this way if the wait is alot shorter) Im sorry, i just want a clear idea of what im doing. Everything else seems good. Thanks so much for your comprehensive walkthrough!

  10. Let's not confuse/frustrate the OP more than needed.. I agree the forums, guides, faqs, embassy reviews and searching for previous threads is great info that is what we did. Our NOA2 was on 11/19/2012, the case files left the NVC on 12/3/12, approx two weeks after that I called in to the local embassy(PERU) and confirmed. changed the interview date although we had not received the packet 3. She received the packet 3 in Peru a week later at the most. That packet had all of the requirements and addresses where one goes to retrieve the various documents, bear in mind one has to pay for the national and other records at a local bank and proof of it before going to request the forms also some can be done online and once at the local office the wait process to retrieve them is shorter. I will know the specifics once I chat with my fiancee.

The medical/immunizations are NOT REQUIRED for the interview date, but the approval process is obviously faster. We and others have sent in those documents to the Peru USA embassy after the interview via DHL prepaid by the USA Embassy.

Wow..this is alot to take in...im very grateful for the information..but this changes what id been thinking

I assumed i would get the I-134 in order...and just wait for the embassy to send information/instructions to my fiancee..and go from there....i had no idea i had to actively contact them to keep things going... Okay so in two weeks ill start calling "them" and asking for a case number?

And the vaccinations i thought wouldnt be an issue until AOS? Is this not the case? Will we need them for the interview?

And the embassy(?) will tell us which doctors to go to right?

  11. We had our interview on the 23rd of January and we did not send anything to the Embassy, until AFTER the interview since we were missing the medical results. We brought our paperwork in hand on the day of the interview i.e proof of ongoing relationship(pictures, skype history, emails, hotel and other receipts), current letter of intent to marry one from each of us, copy of my paystubs for the previous 2.5 months, copies of my tax returns for the past 2+ years,i-134, DS156, DS156k forms... As the other poster replied look at the guide, flowchart and FAQs those helped me.

Take a few DEEP breaths and "enjoy" the final steps of this process, you are almost there.

Also, where did you get copies of police records/court documents? And where in Lima can they be certified translated into English?? Did you send original paystubs? Or copies? And the same for the taxes? Ugh so many questionss..thanks again! Te debo un ceviche!

  12. Okay. Thanks so much for your reply! So ill send the i-134 and all that jazz to my fiancee. She should have her birth certificate, police record, and court documents translated into english right? Is that necessary? Also, you BOTH attended the interview? Is that necessary? Or can she go alone? (Im in Peru at the moment, and another trip down might not be feasible) thanks so much!

  13. Hello, I posted a while ago looking for tips on the NOA2, but i didnt get any replies :/

Heres another try: The NOA2 doesnt tell me what to send to the embassy or the nvc (i dont know what that is, but everyone mentions it) ..it just says that theyre sending stuff to the consulate in Peru...do I just wait?? is there really nothing that i have to send them? i'm aware that i should send the affidavit of support to my fiancee..but do i have to send anything to the government? Also, it says that the NOA2 expires in june...what if they dont contact me? Ughhh please help

  14. Okay, I should have included this in my original post, but here goes: In terms of things I need to send to my fiancee, does supporting evidence have to be the original? Or are copies valid? For example, my paystubs are located at home. Could I possibly scan them and send them to her to print? Also, the guide on this site, doesnt seem to mention what I send to the govt, just what I send to my fiancee. Any clarification would be greatly appreciated.

  15. First off, I would like to extend a big, big "Thank You" to the VisaJourney community. I followed all of your advice, read every post, and on February 13, a day after I arrived in my fiancee's country on a surprise Valentines day visit, our petition was approved. Thanks so much, everybody.

Now, I understand this isn't the end. yet. There's still a few government-established hoops to jump through, and I was wondering if anyone (particularly those familiar with the consulate in Lima) can tell me what exactly I will need to send out with the NOA2? The notification that contains this information is being send to my home, where I will not be for another week, and I was hoping to get a jump start while I'm here in case I need any special paperwork from my fiancee.

In closing, one last THANK YOU/GRACIAS/OBRIGADO/MERCI/GRAZIE to the visa journey community for the help so far, and another THANK YOU if you could shed some light on the NOA2.

  16. Hello All, my NOA2 seems to be within reach, and I wanted to be as ready as possible for its arrival. i was looking at the affidavit of support, and I realized that perhaps I may be denied as I do not own my own home, but rather reside at my mother's house. In terms of income, I think I'll be ok. But my question is, I have read about co-sponsors, but what form would I use to have a co-sponsor (such as my mother) vow to aid in supporting my Fiancee? Is there a special form? Or is it a mere addendum to the i-134?

    Thanks in advance!!
