A student visa is a non- immigrant visa, meaning he can't get one with the intent of staying afterwards. That's fraud.

His uncle can't do anything for him. There is not a "nephew visa". His uncle could petition for your friend's parent, and then his parent petition for him once he has a green card, but that could take decades.

Sounds like he needs an H1 B visa or a diversity lottery one.

Thank you for your help! Appreciate it.

  2. Hello,

So my friend currently resides in Pakistan, and would like to immigrate to the US. He is in his mid 30s, married with 2 kids. He does have an Uncle who is a US citizen however he lives in Dubai. So no one really living in the US. What kind of legal avenues does he have to immigrate to the US? Student visa, like a post grad degree? Job visa? Lottery visa?

    Thanks for your help

  3. Thank you all for your guidance.

Yeah I was just thinking, if my mother-in-law does write an email to the embassy, would that automatically put her at risk for her having her visa denied if she is not able to provide funds. She should be able to as many of her family members and I can help with funds, but I just wanted to check that emailing the embassy wont automatically put her at risk for rejection of her already approved visa.

  4. Greetings

My parents in law had their immigration visa approved in November 2015 from the US embassy in Islamabad in Pakistan. The deadline for the entry into US is by March 1st 2016.

Here is the dilemma. My mother in law recentlyt got diagnosed with cancer and her chemotherapy and radiation will go past the US entry deadline of March 1st 2016. Understandably the doctor does not want her travel during her chemotherapy.

Is there a way to have an extension because of her chemotherapy. I understand that they need to contact the US embassy in Islamabad one way or another. Is there a form or procedure they need to fill or follow?

    Thanks

  5. Thank you for your reply.

So we sent in our additional documents today March 19th: Deadline is April 3rd. We used priority mail, and it will give us a tracking number for telling us when it is delivered (but not when its recieved by USCIS) because its a po box, not a phyiscal address, so God willing it should be there by this coming Monday-Wednesday (March 23-25th).

Here is what we included copies of:

    1. Drivers license of both petitioner and applicant

    2. Daughter's birth certificate, ss#, passport, footprints, and crib card

    3. Sworn affidavits from parents (whom we live with) stating the house is in their name, hence there are no utilitiy bills, or rent

    4. Telephone bill. Stated that this is under my brother's name, and we did this for the familly plan discounts. Showed that my wife and I are on the family plan. Showed our bills for the 1st month when we started last year, and then the last 2 months . And also showed bank statements showing our payment to our brother for the total of our monthly phone bill that we pay to him monthly/ Also showed phone logs for the from the first and the previous 2 months showing how often my wife and I called and for how long our conversations were.

    5. Our living will notarized from 2013.

    6. Joint tax returns of 2014. We already sent the ones from 2013, and 2012 in the first evidence.

    7. Also sent medical bills for my wife and daughter when my wife gave birth

    8. Also sent letters addressed to our residence, some under joint name, some under my wife's name, and some under my name.

    9. Also sent about 40 pictures, showing us together since my wife has been here, and our daughter's birth, and our daughter's aqeeqa (Islamic) celebration.

God willing that suffices for the officer. I didnt sent W2 forms for 2014. I am also wondering how long it would take for them to reply. Also my wife and I are planning to go overseas late October this year, and her green card expires in December, I was wondering should we get an extension, and if so when should she apply for that?

  6. Hello all

We filed for my wife's i-751 in October of 2014, and then we got a letter in January that they dont believe the evidence we provided was sufficient evidence to prove a good faith marriage. So I have been collecting additional evidence for my wife's I-751, our daughter was born 1 month after my wife had her fingerprints done, so I am planning to add my daughter's birth certificate, SS#, and passport that to the evidence. We dont have utilities or assets under our name since we both live with my parents, its one of the traditions of Indo-Pak region that wse follow, so all the utilities are under their name as well. I was thinking of adding the medical bills, especially my wife's deliver bills, and also I will write a letter detailing all of the living arrangments we have with our parents. Before the RFE, I had already sent the joint tax papers, joint health and car insurance, joint bank account statements, affidavits from my parents that we live with them in the same house.

Another one of my concern is, what if they still think the evidence is not sufficient enough, what happens next? kind of freaking out. God willing everything will work out well. I am also thinking of getting a consultation from an immigration lawyer.

    Thanks

  7. Sorry for the late reply. I have been quite pre-occupied with studying for certification exams. Thank you all for your reply.

So the answer to the questions

    1. Bank account statements, we went to the bank and had them print a whole year's worth.

    2. Tax transcripts were under both names for the past 2 years

    3. I will write a letter explaining our living situation

    4. Already sent the notarized letters from parents stating that we are living with them

    5. Unfortunately dont have any joint ownership or memberships such as gym. The reason the car is under my name is because i bought the car before I got married and havent changed it since.

    6. The reason why I didnt sent my daughter's birth certificate before was because she was born after my wife had her fingerprints done, I will send one now

    7. We have mail addressed in our name that is reciepts for charitable organizations.

    8. We have tons of photos, will send them. Will print them

    9. I am kind of scared, God forbid they dont like our evidence, what happens then?!

  8. Greetings all

I applied for my wife's removal of conditional green card. We sent in copies of our joint bank account, our medical insurance with my wife as spouse status on it and car insurance. We just received a letter asking for additional evidence, which includes our names in utility bills and mortgage or lease, child birth certificate. The thing is we live in a traditional way, meaning the couple lives with older parents, so basically we live in my parents house. So we dont have a lease or mortgage, the house which is fully paid for is under my parents names. The utilities are under the parents names a s well. Also my wife and I's phone bills are under my brother's name, and we did that because we got a great discount. Thank God we were blessed with a baby girl, so I do have her birth certificate listing our names as parents. My car is fully paid for which I bought before I got married. So my questions are 1) should I send a letter detailing that we live with my parents due to cultural traditions, hence my wife and I dont have property or lease or utilities under our name? 2) would only our daughter's birth certificate suffice? 3) we have medical bills under my wife and daughter's name from giving birth etc, can I use those? 4) can I add my wife as co-owner on my car? Would that look shady as it is coming after they sent a request for more evidence? Pls advise, thanks.

  9. Thank you for the replies. Thing is tjat they already had their fingerprints and oath taken in the last interview and then their case went into AP. The problem I think was my parents in law took their passports back instead of letting the immigration officers keep them. A year after the interview they asked for the passports, my guess was for the visas, but then they got a call for filling out the DS 260 forms and reappearing for the interview and fingerprints. It didn't make much sense to me

  10. Greetings

My parents in law have had all their interview done in Islamabad, and all the necessary paperwork was complete. About a year later they called them to resend their passports. They sent their passports to the us embassy. Today they got a call that they need to fill out D 260 form and go for an interview again in Islamabad. What is this? I thought this was all completed as they just needed the visas issued on their passports. Please help. Thanks

They had their interview oct 30th 2013

  11. Thank you all for your replies

It definitely is a test. May God make the process quicker and easier and unite us all with our loved ones.Ameen. I have used that website in order to inquire, but I have had no success in terms of them replying. But I will try again, and God willing get a positive reply. Please keep my family and I in your prayers as well.

  12. Greetings

Hope all of you are well here. My uncle-in-law who is a US citizen (sponsor) had applied for parents-in-law had applied for immigration a long time ago. So in October of 2013, my parents-in-law had their interview at the US embassy in Islamabad in Pakistan, and since then they have been in AP (administrative processing). At that time, my mother-in-law had requested to keep their passports with themselves for further travel, they havent travelled since then, and now they would like to send their passports back to the US embassy. I tried getting in touch with the US embassy via email twice and phone calls, but they dont allow me to speak to anyone, and the embassy has not replied since I emailed them back twice in November of 2013. So at what specific address and to whom should my parents-in-law send their passports to at the US embassy in Islamabad, Pakistan?

Also I was wondering if my uncle should contact a senator to inquire about my parents-in-laws' case?

    Thanks

  13. Dear Bro,

you dnt worry, I have a feeling your wife will get the visa soon may be in one month, i previously wrote to someones thread about my friend who was temporarily refused without any reason. My friend is a pharmacist so they just wanted to check either she was involve in any research paper or not.for temporariry refusal they give green paper.

Further, I have noticed since many days those girls who wear hijab goes to AP which is just frustrating, wearing hijab is ones own decision and its about our religion, I dnt know why the hell they link the hijab with bad intentions... thats simply rediculous.

I pray your wife will get her visa in days only. InshaALLAH.

    Regards,

    SZ

Ameen, summa ameen, inshaAllah. Yeah I contacted another senator, they said to give it some time, and they will ask on my behalf, I pray inshaAllah it is approved before it even has to go that far, ameen.

  14. I wish I could tell you that you can find out why but more than likely you may never know

We were just lucky that the co told us specifically that our case was fine he just had to go they name checks but not all co will give that much

Hopefully soon all will be finished

Sorry, I keep bugging you, I went to the website https://ceac.state.gov/CEACStatTracker/Status.aspx to track the case, and it says "refused" for the immigration application visa, is this the current temporary refusal because of AP, or permanent refusal. I am starting to get paranoid because now i am afraid the visa will be refused. God help us, please advise, thanks

  15. I can understand your frustration and can empathize with you entirely. However because you just had the interview there isnt much to do but give it time. More than likely her visa will be issued within a few months. They have been putting more women in AP lately in Islamabad but they still seem to finish their cases long before the men's.

Because you just had the interview you will find it difficult to get a senator involved this early. Usually they ask for you to give them a call about the 5th month or so but i doubt you will have to. Lawyer wouldnt be able to do anything the senator wont except he can charge you loads of money to do what you can get done for free after the 5 month.

All you can do is be patient and let them finish the work. They will and while it may take a few months the end will be worth it.

    Wishing u well...

Thank you so much EAbbas, yeah i finally got a response saying that after 6 weeks if you dont hear anything, then we can ask on your behalf, but in the mean time just wait. I pray she gets approved before that time comes inshaAllah, i guess I will have to just tough it out in the mean while. I really want to know why they put her in AP though, is there a way to find out? because they said they will not entertain any phone calls or emails.

  16. hello,

lawyers cant help you out, senators may be but that doesnt work for many people.

Just calm and pray your wife will get her visa soon, dnt worry women are generally in AP fo shorter time but you are right you you never know how many months...did you try to figure out why did they put in AP i mean age difference, finacial situation of petitioner, name check or due to some girls who wear hijab they do AP..

I have my interview this month and hope to get the visa soon because I can realise this time jut kill the husband wife.

    Regards,

    Sarah

Thanks Sarah, they didnt give her a reason as to why it went into AP, she does wear hijab, and we do have an 8 year difference in age, but alhamdulillah financial situation is okay. Is there a way i can figure out why we are in AP? The letter they gave her said they wont enteratain phone calls or emails. InshaAllah I am praying that the AP goes by quick, and she gets approved, ameen. InshaAllah you get your visa right after the interview.

  17. The interview was yesterday. Relax a bit.An attorney can't help you. Your senator can't help you.

Thanks Anh map, the thing is i have been reading on these forums and others that some people have spent years in AP, and its scary, I think its generally men who have a longer time in AP, but the fact you never know how long it could take, thats really nerve wracking. So i saw some people write to senators, where some say it helped, others not so much, I guess i am just trying to plan for the future and figure out options...God willing it will be alright

  18. Hello All, I am new to this site, I am a US Citizen and I applied for my wife's CR1 in october last year. My wife had her interview in Islamabad US embassy yesterday, and after the interview they gave her all the original documents back, (we had not missed anything) and kept her passport. Then they gave her a green sheet called administrative processing, and said the case will undergo further review, and it could take 2 months or maybe more! Furthermore they stated they will not entertain any phone calls or emails. So i am using this company called rapidvisa, and they said to use my state's senators to inquire about the AP, I called and emailed them, and so far have not heard back from them. Now i am so frustrated and disheartened, I heard men generally go in to AP, not women, is it because of common names like ahmed? Thats my middle name, but my wife's name does not even have it, except share my last name. I am desperate, and I am not sure what to do, can you guys give me any advice/help? Should i get an immigration attorney involved?

    HasbunAllahu wa nimal wakil.
