  1. I believe you need to fill in 2 if your spouse has been married once before, since your current marriage counts for the question, "How many times has your current spouse been married"?

    On page 4 of the instructions for the N-400: http://www.uscis.gov/files/form/N-400ins.pdf, it says that you need to fill out information about your current spouse's prior marriages in Section G, so yes, your husband's ex-wife's information needs to be filled in.

    If your spouse was married before to someone else, and is currently married to you, then he must have been married at least twice (once to his ex-wife, and once to you). So the answer to the question "How many times has your current spouse been married" must be 2, not 1.

    Then, it goes on to ask If your spouse has ever been married before, give the following information about your spouse's prior marriage: ... 1. Prior spouse's family name ...

    This is where you'd put the name of your husband's ex-wife. In other words, the prior spouse of your spouse.

    Any Sign of life guys or may be they got approved, RFE, Interview and didn't let us know?

    We just received an email from them telling us that they transfered our application to california center. We filled on july 2008. Some friends said that they it did take up to one year to get their 10 years GC from Vermont.

  3. Thank you guys. I appreciate the quick replies and answers. My friend insisted that he knows people that submitted the i-485 and they never being asked to fill out the i-130. I think that what made lawyer to rethink about it and called him later today saying that my friend is right and he does not need the 130.

    I told him if I were you, I would do the paper work myself. Some lawyers are realyy greedy and looking to rip people off sepcially who don t know things like this.

  4. I am submitting a question on my friend behalf. His lawyer asked him to file form I-130 along with i-485. I disagreed with him.

    His wife came in to the contry on k1 visa fiancee visa. They got married here and filed i-485 just like it s being detailed on the visajourney guide. Now he hired a lawyer and this guy aked him for $1200 to file i-130. He insisted that s my friend wife should had filled it. I am kind of guessing he is just tring to take more money from him.

    My question is there any proof we can show to this lawyer to prove he is wrong? Thanks in advance for your replies

  5. I received an email end of march from INS (uscs) telling us that our interview is being canceled and it will be rescheduled. So far, we did not get anything. We tried to call the customer service line with no luck to get a live soul. We live in Orlando and the local office here is backed up very bad. It takes 2 to 3 years to get an interview.

    Does anyone experience the same thing? Thank you in advance
