  1. Not enough information. Need to know the birth date of the applicant, the priority date, the date the petition was approved, and the date the priority date became current.

    In a nutshell, they calculate the amount of time between the priority date and the date the petition was approved, and they deduct that time from the applicant's age on the day the priority date became current. If the result is under 21 years then the applicant didn't age out. They have one year from the day the priority date became current to "seek to acquire" permanent resident status, which usually means they have to submit the DS-230 to the NVC.

    You are right, it was impossible to tell anything with the information I provided previously, sorry.

    Date of Birth: Apr. 11 1988

    Priority Date: May 23 2001

    Approval Date: Jan 22 2010

    Estimated date when priority date will become current: Dec 01 2012

    Considering the 'formula' above, my son will be around 15 yrs old as per CSPA consideration.

    My doubt now is if I need to communicate NVC at some point about his condition or should I just carry on with the process (sending DS-230 and documents) and this will be decided only in the interview.

  2. Usually it doesn't take that long for the approval. Are you sure of that date ? Normally it is about a year

    Yeah, I'm sure about the date. Below is a copy of the notice received by me.

    "Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN.

    Current Status: Approval notice sent. On January 22, 2010, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN...."

    This notice was sent by USCIS.

  3. Hello everyone!

    I need help understanding if my son qualifies for CSPA. My brother (US citizen) filed a petition in which I'm the main beneficiary and both my wife and son are also beneficiaries.

    I've used the CSPA calculator and it said my son still has the right of obtaining the visa.

    Here are the dates of our case:

    Date of Birthday: Apr. 5th 1988

    Process Priority date: May 23rd 2001

    Approval date by USCIS: Jan. 22nd 2010

    Visa bulletin date for August (F4): Feb. 15th 2001

    Did I get it right? Is he eligible?

    In this case should I do anything to inform NVC about the CSPA or they will figure it out by themselves?
