  1. We are hoping to get some advice or feedback from others who are separated and have filed jointly. Our marriage was entered in good faith, we are filing jointly, and have some co-mingled finances is there anything we need to do to address the fact that we are separated?

My husband and I have been separated and living apart for a while.

Long story short, what started as a cross-country move for a job eventually turned into our decision to separate. We have since both moved several times and since so many things were uncertain, we did not file AR-11 and have always used my parents house as our permanent mailing address for really important stuff, especially immigration as we didn't want anything lost.

We were planning on continuing to use my parents house as our permanent address, but some of the evidence we are submitting contains other addresses.

We don't want to red flag our situation but don't want to provide too little or too much information either.

Should we submit a separate sheet listing addresses or will that be problematic since we do not have corresponding AR-11s?

We thought about sending AR-11 before applying, but my husband will be moving again in a month or so and we don't want things getting lost.

Any advice on what to do?

    As evidence we are submitting:

    1. tax returns from 2007 & 2008

    2. Joint savings account

    3. Joint credit card account

    4. Health insurance

    5. Life insurance

    6. Recent pictures from visits

thank you in advance for your advice

  2. Hi the other day I posted a question regarding this situation and just wanted to share the results!

My husband is working out of state for a few months (Atlanta) and was requested to get his biometrics for EAD renewal taken in St. Paul.

We kept rescheduling thinking it may be more convenient (and economical) to fly up at a later date.

Anyway we came across this solution and it worked!

Without notifying the St. Paul office he presented at the Atlanta office on the day and time he was scheduled in St. Paul. He had a faxed copy of his notice (the original did not arrive to him in time). We thought he may not get in that day, they may demand he come back with his original notice, or they may notify him of their walk in day and he would have to go back then.

Well he got lucky they let him in with just the copy of his notice, he waited in line, and they took his prints and photos and he was out the door.

No hassle and not many questions asked!

  3. Well no one wants an RFE but at least it lets you know somebody is doing something with your case!!!! ha ha haaa

Anyway my husbands AOS case has been in FBI name check since October 2007 and just now we recieved an email about RFE!

I was under the impression that once you were in name check stuff like that didn't happen... that your case was all good but just waiting for the name check. I guess not.....

Anybody have a similar experience?

  4. You do not pay for the exam until you get the carta blanca o permiso de salir, depending which way you want to go salida definitiva o indefinitiva. At that time you pay a fee to your local immigration office..... if i remember correctly.......... i think it is around $400 per person or something like that.

It has been a while but PM me if you have any other questions.

    Best,

  5. My husband and i are considering a move to Honolulu for a pending job offer. We are both really excited about the possibility and craving a return to island life. But it's a big change and a big decision so we are looking for any and all advice we can get on housing, daily routine, jobs, transportation, and well everything! We don't have a lot of big stuff so "moving shouldn't be too big of a deal....

We would appreciate any feed back from people who have made the move.

    thanks

  6. Okay, I am in a quandry.

Fiancee (now wife) came over on K-1.

We were both in Thailand during most of the K-1 Process, and we never received our NOA2 Approval of I-129f Thai mail is sometimes a little shaky). Okay, we want to file for AOS, but you need that form.

So, Form I-824 is used to, among other things, getting a copy of the I-129f. (The copy costs $340!!!!!).

Anyway, we submitted it, but it was returned because we did not include the receipt number for the form. Well, if I had that, maybe I had the form, and I didnt't need the copy....

Anyway, what are you supposed to do to get a copy of a form when you don't have the form (nor the receipt number) to reference? I sent all info I had, and there cannot be that many women from Thailand with her name and A# that came in on a K-1 visa, can there?

Any help here is much appreciated.

    Michael

Hey sorry to hear about your dilema.... i don't have any solid advice but we had a similar experience.

We brought it to the interview at the embassy and it did not get returned to us. So who knew we would ever need that again...... since the interview was approved and the data in system somewhere who know that little reciept would ever matter! But when it came time to file for AOS it was a supporting document. We filed to get a copy and a few months and some $$$ later we were denied our request for a simple typo. Out a bunch of $, some time, and still no copy of NOA2.

WE ended up filing without the copy we submitted a letter explaining why there was no NOA2 and copy of the NOA1 so at least they could have the case number and all that official business.

It seemed like it would be enough, an attorney advised us it would be sufficient. But look at our time line!!!!! Maybe that's the hold up who knows!!!

So anyway good luck and consider checking with an attorney many give free consults and would be willing to help advise.

  7. Today was the interview, supposedly at 8:30 in the morning. It's past 4 pm their time and I haven't heard anything news. Is that a good sign or a bad sign? Anybody know how long it takes at the embassy the day of the interview?? It's driving me nutty.

Its no fun waiting!!!! Especially with no news! Don't worry though some embassy's make interviews a day long event. We were there from 7:30 AM were bumped up to the head of the line (which seemed promising for a quick visit), and then interviewed almost dead last. Didn't even have enough time left when we were done to print the visa! We had to come back the next day. And then the drive home.

So at least from my point of view you this is not necessarily a bad sign. Just torturous!!! Hang in there!!!

  8. Well........ when we filed AOS back in January we had recently moved out of my family's house and into an apartment.

We used my parents address on all our paperwork and for some important mail (such as bank accounts and credit cards).

Because it is more secure...... we have had problems with our mail at our apartment and because we were not originaly planning on staying at this address very long so we didn't want to have to change everything again.

We do have bills in both of our names at our apartment address cell phone, utilities, and car insurance.

My drivers license still has my family's address and my husband's has our apartment (this i see as potentially problematic, but I could easily change the address on mine).

So I hope this post is not too confusing. We were just thinking as the interview hopefully will be sometime soon we should get some advice on this situation. At first we didn't see it as anything problematic with using our "permanent address" but as time passes we have more stuff with our apartment address and don't want it to look shady!

    Thanks in advance!

  9. Hey just wondering other peoples experiences....

Some friends of ours just moved from Florida to Minnesota. I don't remember this happening to other friends of mine who have moved to Minnesota from other states, but they went to the licensing office to change thier drivers licenses and were told they have to pass the knowlege test again!!!!!!

For all classes and all endorsements!!!!!!!!!!!!!!!!!!!!

Anybody else moved and had to re-test?????????????????????????????/

  10. I know I have read this in another post but it was a very long time ago and things change all the time in cuba so i just want to check.

My husband got him medical exam but the doctor didnt give it to him in a sealed envelope and they told him that they never do it that way and that the US embassy never gave them an envelope to put the medical exams in, but the Packet that I recived says that on the day of the interview my husband needs to bring in the x-ray and the medical exam in a sealed envelope

No worries we didn't have a sealed envelope either, they didn't seem to expect one at the interest section either!!! lol

I would recommend your husband make copies of all pages of his medical. He may need it later when AOS and it seemed to be common phenomenon recently of peoples medicals getting lost in the shuffle when filing AOS. Making a few extra copies now will save you both big headaches and empty pockets paying for medical again. Maybe this is just K-1 advice since you are already married I don't know if the full medical is waived when applying for AOS.

That you will have to investigate.. but hey make the copies anyway!!!!!

    Good Luck!

  11. I will be traveling to Habana ASAP because of a family emergency.

I am USC, but I have not yet changed my passport from my married name…. as I wasn’t planning on traveling anytime soon. Will this be problematic, I still have other ID and credit card with my maiden name I am just wondering if there would be any potential problem upon re-entry into the US? Or am I just being silly?

My husband is still waiting AOS so it is not possible for him to go and trying to get AP will take a little time. And could possibly be problematic since the emergency is in Cuba and the tremendous amount of bureaucracy that he would have to go thought to get the permission to enter. And asking for emergency AP for Cuba without applying for US permission to visit just might be big red flag!!!! So we feel him going through a third country may not be a good option

We haven’t ruled this option out, but see it as problematic are there any other Cubans or people who know Cubans who have returned to Cuba for an emergency while AOS was pending???????????

  12. So we were transfered to CSC and are still in limbo waiting infinitely it seems. Our concern is that we did not apply for AP originally thinking it would not be necessary (and trying to save a little cash), but now that this is AOS business is taking much longer than anticipated we are concerned we'll be stuck with out a GC for the long haul with no way to leave the country. It would be preferable to apply for AP before the fees go up if we are going to do it at all, but it would be even better if they would just approve the case and send us the dang GC.

Any advice. I just don't want to see my husband stuck in limbo for even longer with no way to go and visit family if he wants to or if there is an emergency and he needs to.

    Thanks
