  1. Hi Raheel,

    Same thing CO told my wife also. I was there and CO stated that all documents are completed and everything is fine but they have to complete the Admin Process and it will take up to 3 months. CO kept my wife passport and even I asked CO after the interview ended that if they need any document OR name check is not clear what the reason for AP? CO just stated with smile that all is good they have to complete the AP process and it will take up to 3 months.

    The Pakistani lady who was the translator stated to my wife that it will take a week, 15 days, 30 days, 45 days to 3 months to complete the AP process.

    Yes, my wife interviewed at window # 3 and the CO was middle age male (with good attitude) and Pakistani lady as the translator. I hope too that AP for al of us end soon. InshaAllah!!!!

  2. It is really surprise us as most female are now also placing on AP. Male on AP is common but females now too.. Really makes no sense when all documents are completed and name check clered then why AP?? Even I asked CO but he stated we have to complete our Admin Process. Why they didn't completed before the interview scheduled?

    Even as a Petitioner I accompanied my wife to provide her moral support and my presence should make the big difference. They should know how hard it is to get a time off from the work and how much costly the air fares are now a days.

    I feel so sad when I see people like me waiting for their love ones to join them and the waiting time is too long for some people which is unbelievable.

    I called DOS and they told me to wait till 8 weeks then contact them as they don't have any info right now and it is too early to contact them.

    I will be flying back to USA next week and I will contact my Congressman OR Senator but I think it will be too soon to contact them. Any advice?

  3. Not a good result. CO put my wife on AP. Handed Sky blue sheet with 221(g) marked with an "X" and stated that the case is in Administrative process and it will take upto 3 months and if no response in 3 months then we can contact Embassy after 90 days.

    We arrived Embassy via shuttle service. They took her finger prints. Then sent her to Window # 6 to submit her letter of appointment from NVC.

    After waiting 25 mins She was called at window # 6 and asked to submit her medical and passport. The lady confirmed her cellular number in order to have American Express called them once the Visa will be issue and handed my wife a Purple color token with a Serial # on it to have her passport and Visa collected from American Embassy once visa approved. She asked what language my wife prefer to interview and she stated native language "Urdu".

    I handed over my updated I-864 (Affidavit of support) to the lady and informed her that my job is changed and she accepted the new I-864 with my job letter and 3 yrs IRS TAX Transcripts and she returned back to me old I-864.

    Then we waited another 20 mins and again my wife was called at Window # 3 and there was a White male CO officer mid age with a Pakistani lady who was doing translation in Urdu.

    I introduced myself as a Petitioner to the CO and handed over my US Passport to him. CO verified the entry stamp and Biographic data on the passport and handed over my passport back to me. I requested CO that my wife is not familiar about Petitioner US documents and will need my help to provide the documents to CO during the interview. CO stated not a problem I can stay but I cannot speak during the interview.

    They had my Wife take oath and then the CO sked the following questions:

    1). Who is the petitioner?

    Ans). My Husband and she pointed at me and CO smiled and stated offcourse.

    2). When you got married?

    Ans). She told the date of our marriage.

    3). Did the Rukhsatee (Bride Reception) has been performed?

    Ans). Yes.

    4). What your husband do for a living?

    Ans). She told my job title.

    5). How long you lived together after marriage?

    Ans). She told 7 weeks after marriage.

    6). How you know your husband?

    Ans). She told about it in detail. Arrange marriage.

    7). Are you ever charge for any crime OR visited court?

    Ans). No never.

    8). Did you travel outside Pakistan?

    Ans). No Never.

    9). Do you have your wedding album?

    Ans). Yes. She slided the album and CO looked at the album and checked each photos then returned back with the the smile and said thank you.

    10). Where you live right now?

    Ans). With my in-laws.

    11). Where they live?

    Ans). She told the address.

    12). Did this is you first Passport?

    Ans). She stated that yes this is her first passport ever made.

    CO stated that all documents are completed and everything is fine. We have to go through our Admin Process and it will take upto 3 months and if you didn't hear in 3 months then you can contact Embassy for an update.

    CO kept her passport. CO was nice and didn't asked any documents and spoke very softly during the whole interview process.

    I asked CO may I speak? CO stated go ahead then I asked CO if any document require OR name check is not cleared? CO stated that all documents are completed and none required. Name check is cleared but need to go through Admin process.

    My Wife said "Thank you" to the CO and he smiled at her and said "Thank you" too. We left the window and walked out the Embassy.

    Why CO not aproved her visa when everything was ok and all documents are completed? I saw few others womens also got refusal sheet for AP.

    My wife still crying since she left the Embassy and she is really disappointed and heart broken why she got refused and I am going to leave her alone once again.

    Now, I need to know what options do we have and what you guys suggest?

  5. Hi Ali k,

    It seems like they asking your wife to provide Union Council Divorce certificate (Which is usually used to be in URdu) not the NADRA issued Divorce certificate.

    Could you tell us that who was Divorced? You OR her? Was She married before and got Divorced OR too khulla OR You was married before got divorced OR khulla?

  6. Hi Muzammil,

    Usually American Express is the courier in Pakistan use by US Embassy to deliver Passport and Package to the Beneficiary. Check your local American Express office location to check if they have it with them OR they can tell you if they receive it yet or not.

  7. Hire a Family Court Lawyer and He/She should be able to process on your behalf and get the Divorce papers you needed.

    Otherwise, find someone in your family OR as suggested by "baqir" in the last response to have your in-laws get it done from Union Council.

    Now a days Union Council are not processing documents as the approval staff is not available due to new Baldia setup issues in Sindh-Karachi. I am not sure about other States in the Country.

  8. Agree with you however Suggest not sending additional documentation unless requested. At this point if you send anything to the NVC center they will have to forward it to the embassy and it will more then likely not make it with your packet... just hold on to it take it with you.. if they ask for the forms then provide it.

    Keep in mind the forms are filled out long time ago, and if everyone started updating the forms it would really make a lot of work for the embassy!

    ONLY submit additional documentation if it will help your case! DO NOT submit additional unnecessary or nonrequested items!

    I was thinking about the questions CO asked in other cases from the beneficiary about where your husband/wife works and what title?

    Now, in this case my wife will answer about the new job title and Employer info which is obviously not going to match what stated on the AOS form they have it. So, I think taking a new AOS form with Current Employer letter will help.

    You are right provide what they asked not more then that :thumbs:

  9. I called NVC today and spoke with the representative. He stated that as long I have a job and making above the poverty line during the waiting process and at the time of the interview I will be ok and I don't have to submit new AOS OR Paycheck OR Letter of Employment to NVC :unsure: .

    I asked him even if my Wife has to take a new AOS and Letter from my new Employer at the time of her Interview at US Embassy in Islamabad and he stated that I am making way above poverty line and my last 3 yrs TAX return are also well above poverty line and I don't need to worry about it and no need to resubmit one unless if I get unemployed :help: .

    Well, for the safe side I still think I will have a new AOS ready and a letter from my new Employer with Current pay stub send with my wife to show CO at the time of her interview to make sure it will not cause AP to submit missing documents.

    Any suggestions?????

  10. Or you could go with this option and get another original Marriage Registration Certificate issued before the interview so the Embassy doesn't use it an excuse to delay your processing.

    I also submitted my Original Nikah nama in English but NVC suggested to have my wife take the Original Nikah nama at the time of the interview with her to the Embassy. For them the Original Nikah nama is the one in Urdu even we made Original Nikah Nama in English but still they want to see the Urdu one Orignal. We do have it and I am having it translate and will have my wife take it with her to the Embassy.

    I also submitted the "Marriage Registration Certificate" Original issued by NADRA to NVC with DS-230.

    So, you are saying here that even I submitted the Original "Marriage Registration Certificate" from NADRA to NVC I need to make another one from NADRA to have my wife take it to the Embassy at the time of her interview??

    Didn't NVC will send the Original documents to the Embassy we submitted with DS-230????

    By the way our case still in final review at NVC since 9/15/12.

    I am not a Senior member OR expert like other VJ's but like to share my point of view in a response to your post.

    It will be a positive effect of your presence during the Interview at the ISL Embassy. It will not guarantee the Visa issuance but it will shows that you are there to provide moral support to your spouse.

    It is not necessary for your presence at the time of the interview, if it is not possible for you to visit again so soon.

    You mentioned, you just visited and get back from Pakistan. How long did you stayed there? You can send the Photo copy of your Passport Entry & Exit stamps on it that will shows that you recently visited to see your spouse in this way it can shows the on going relation to the Counselor Officer at the Embassy.

  12. In our case our Nikah happened on 1-31-12. Our wedding reception from bride (Rukhsati) side happened on 2-1-12 and Groom Reception (Valima) on 2-3-12.

    We did mentioned date of marriage 1-31-12 on I-130(When we signed the marriage certificate AKA Nikah Nama with witnesses signatures from both sides).

    Technically, on I-130 application I stated date 2-1-12 on Question 21 in which you have to give address and dates from - to where you both (husbands & wife) live together. Because Rukhsati (Bride Reception) was happened on 2-1-12 and we all know very well in our culture that Bride don't live with husband until Rukhsati done.

    When we registered our marriage with NADRA (Marriage Registration Certificate) they also stated date of marriage as 1-31-12 the day when we signed the Marriage papers with witnesses signatures.

    In ISL, the US Embassy very well knows the difference between Nikah and Rukhsati and in few cases they did asked in the interview to the beneficiary if the Rukhsati has been done or not.

    In our case we don't have Nikah photos as we don't think about it but we do have photos & video of Wedding ceremony for both receptions.

    Our case still at NVC for a final review and still waiting for the Interview date. Let see what comes out later...

    I am not expert here but I will try to answer your Post as per my personal experience.

    It is not necessary to have her passport name change from her maiden name to her marriage name.

    It would be nice to have your name as her husband on her Passport which will be a positive thing on your case as it will be CR1 case of a US Citizen Spouse.

    I did the same thing with my wife NADRA ID card & Passport. First, I had her changed her NADRA ID card on my name as her husband instead of her father name and also her last name changed to my last name (NADRA always changed last name to husband name once issued ID card after marriage).

    1) You need to have your NADRA ID card as she will need your NADRA ID card copy and Nikah Nama (Marriage Certificate) to have her NADRA ID card change to your name and her last name to your name.

    2) Once she will have her new NADRA ID card issued (make sure you request urgent service and it will cost more then regular service and she will get in a week) then she need to fill Passport application and she need to submit your NADRA ID card copy, Her new NADRA ID card copy, Nikah Nama (Marriage Certificate), her Parents NADRA ID card copies and Your Parents NADRA Card copies (They asked her at Passport office to my wife) and do it urgent and you will get it in 10 to 12 business days.

    My wife passport was never made before so she made it first time. Her Police Certificate (PCC) also made on her marriage name (Pplice verifies info on the Passport of your wife and also from NADRA ID copy of her to make PCC) and both of her addresses before marriage and after marriage were showed in the PCC certificate (No PCC was made on her Maiden name).

    Now,let me tell you that when I was there in Karachi after marriage I made my NICOP card from NADRA. So, in this way I don't have to get Pakistan Visa on a US Passport and I submitted my NADRA ID Card copy and US Passport copy and I did mentioned my US address for NICOP ID card and my NICOP ID card issued on the base of my Original Urdu NADRA ID Card.

    I still have my Original Urdu NADRA ID card and NICOP card as they only asked for the copy of my NADRA ID card and return me back the Original Urdu NADRA ID card.

    So, you are Citizen of Pakistan and US both (Pakistan and US both allow Dual Nationality) and you are born Pakistani so wherever you live you are still Pakistan Citizen and it is wrong that you are no more Pakistan Citizen.

    Now it is up to you how you want to proceed.
