Sure you can petition for your 77 year-old mom. However, in cases like this, the Affidavit of Support will become secondary evidence as the US government will want to make sure that your mom will never become a public charge. Keep in mind she will never be eligible for Medicare.

Can you afford to pay $80,000.00 for your mom's health insurance per year? Wow! High? A simple heart attack will cost OVER $100K, so it's actually pretty reasonable.

Forget it, even if you were willing to risk bankcruptcy and losing everything to worked for your entire life. Don't get her exited only to disappoint her later on.

The chances of taking the oath on the same day are quite slim. More than likely your oath ceremony will be on a different date.

I wanted to follow-up on what happened. We both went to the Miami field office and were both allowed into the agent's office. They had my wife fill out a single page background authorization form. What? Why did we have to get a background check from the Sheriff's Office ourselves then? Oh well, we weren't going to argue. She just filled out the form and we just sucked up the $10 in parking, gas, and time off of work.

So today, we get another NOA that says something to the effect of "Your fingerprint card on file with the U.S. Citizenship and Immigration Services (USCIS) has expired. Blah, blah, blah, come get your fingerprints re-taken". Okay, now we're really getting frustrated here. Let me give you a better idea of the events

- 01/09/2008, USCIS receives our N-400 application. It forces the stuck I-751 which was waiting for over a year. The GC gets sent out the same day. This is really good because traveling with that stupid "extension" letter isn't easy. They tried to keep it in a foreign country we were visiting.

- Date unknown, NOA1 for fingerprints. My wife goes to the appointment as scheduled.

- Date unknown, NOA2 for fingerprints. First set unreadable. My wife goes to the 2nd appointment as scheduled. They tell my wife not to worry, they never ask for fingerprints for a third time.

- 06/13/2008, N-400 Interview. We go as scheduled. The agent says my wife's second set of fingerprints were unreadable. We had to rush out and get a background check from our Sheriff's office. Rush back to immigration. We were told everything looks good, case closed, look forward to a letter about the Oath Ceremony. Awesome!

- 07/11/2008, See original post for reason. Back to the field office. Filled out form. We were told everything looks good, case closed, look forward a letter about the Oath Ceremony. Awesome!

- 07/21/2008, NOA3 for Expired fingerprints. Okay, now we're back to square one.

Is there any way to break out of this ridiculous fingerprint loop?

That sucks! I can only suggest that you get the fingerprints done, and contact your senator/congressman as they might be able to help. Good luck!

I sent my cover letter first, on top of all the other documents, but with the check paper-clipped to it on top. I had the I-751 after the cover letter. I'm not sure if this is right, but it is what I did.

I tried twice at the boston office. but they didnt give me the stamp. i was only going to canada so its worth giving it a shot in your case. i was told they would only give the stamp if i have lost the extention letter.

Look again... are you really really sure you have not misplaced your extension letter?

I understand that if we did not receive the 10 year green card before the expiration of the 1 year extension, we need to get our passport stamp the I-551 for another 6 months. Do we consider out of status if we did not get our passport stamp for another 6 months and the new card not yet arrive after the 1 year expiration date? Is it compulsory to make an appointment to get the passport stamp?

AFAIK you are in legal status as long as USCIS does not take a decision on your petition. So you do not to worry about I-551. Good luck.

My husband and I are gathering our copies and pounding our brains as to where we're going to find nearly $600 but I had a question about the Affidavits. Are they really necessary? Outside of family we have almost no one we can ask for a letter. I understand that we could get them from family members but a part of me feels like that's a little frowned on (and I don't know why). So I just would like to know if those affidavits are really important or if we can exclude them. Here is what we have so far otherwise...

copies of our credit cards (showing 2 joint accounts)

a statement from the bank showing that we have a joint account

a letter from his employer stating me as the beneficiary to his retirement fund and his life insurance

a copy of our son's birth certificate

photos of us together and with other people

copies of our 2007 and 2006 tax return

our letter from the IRS about the stimulus package (hey, it has both our names on it!)

greeting card envelopes with both of our names on them

affidavit letters? can we do without them?

We never had any affidavit letters, and from your evidence list I do not think you need to worry about them. Do make sure your bank and credit card statements cover the time you have been together.

You are joint petitioners for the I-751 so on the back of photographs I would just write the names, including yours, as appropriate, instead of using titles. If you wanted to use titles you could use 'Petitioner Sara" and "Petiitoner [husband's name]".

We included 12 photographs as well. Ours were from trips to visit family members, so I included: a family photo taken one Christmas with all of the extended family - my husband's immediate family (including myself) identified by name, and the rest identified as two groups - 'Joe's sister's A's family' 'Joe's sister B's family"; a photo of me with Joe's parents; a photo of me with Joe's daughter at a re-enactment: a photo of Joe, me, his mother and his 2 sisters at a Memorial service held for his father last year by his Church; two photos of us individually with our grand-children obviously taken the same time (kids wearing the same clothes); a family portrait taken at Christmas with my immediate family (including my brother's cats!), and a photo of Joe with my Dad and brother. We placed these photos in the travel section along with the appropriate proof of travel to the locations where the photos were taken.

We also included a photo of Joe and me in our home; Joe with our cats (the ones I brought from Canada) in our home, and a group photo with some of our on-line friends taken when we hosted a 'gathering' here in our home with everyone identified by name.

We also wrote the date, location and the 'event' on the back of each photograph as well.

We sent about 20 photos from our honeymoon in Hawaii, gatherings with friends, a couple office party snaps. We pretty much did what Kathryn mentioned for descriptions and had tickets and hotel bills with photos taken on vacations.

Got an email yesterday saying application has been approved and new card ordered. Seems like California is taking approx. 3 months to get the newer cases out, which is not anywhere as bad as Nebraska was when I sent my petition. Also, at least for the newer petitions (as opposed to the older petitions that were stalled in NSC and recently transferred), it seems they are being processed more or less in the order received. I base this on my observation of recent approvals.

For the curious we had only one year of joint tax returns (the second was filed after we applied), we did not have any affidavits with our petition either, and we did not even have any joint lease/mortgage documents since the house was purchased before we got married. We did however have lots of joint financial, insurance, medical documents together with evidence of joint travel, hotel receipts, photographs etc.

Just to let you all know (those who received 2 appointment letters, that is) that they took my fingerprints, stamped the first appointment letter, put a big red x through the 2nd appointment letter, stapled them together and gave them back to me to prove that I had been there...people are getting 2 different appointment letters quite frequently, she told me, so no big deal....now I wait.

What happens now, btw?

OK, here's my huge problem:

Right now I have a 10 year green card.

I will meet the requirements to apply for citizenship on July (2008).

Hubby was offered a job in Canada and he is really excited about it, he REALLY wants to take this job. And they want him there ASAP.

We have no kids.

We don't own a house (that's why we need this job in Canada, to actually be able to buy a house)

Dad in law said we can use his house as a permanent residency while we are in Canada.

If everything goes well with hubby's new job we will be out of the US for 2 or 3 years..

How big is my problem and how can it be fixed? is it smart to wait until August , apply for citizenship, move to Canada and then come back for the interview or whatever? will they hold it against me that I am living in another country ?, should I get an immigration lawyer and will it make any difference whatsoever if I do?. please, whatever info you guys can give me I will really appreciate it. From what I understand if you show any intentions of moving permanetly to another country. You will be in trouble.

I remember seeing people in similar sceanrios before so you might want to search a bit..

Since it is your US Citizen husband who is moving for a job I do not think this shows any intention of moving permanently at all. You should get a reentry permit by filing form I-131, Application for Travel Document. and keep filing taxes in the US. Remember you might have to wait a few years to apply for citizenship when you come back because of the residency/physical presence clause.

Also there are certain waivers in this scenario see if you qualify.. this is from the uscis website. Even if you do no qualify for this waiver "I think" the worst that can happen is you may take longer to qualify:

There are also exceptions for lawful permanent residents married to U.S. citizens stationed or employed abroad. Some lawful permanent residents may not have to comply with the residence or physical presence requirements when the U.S. citizen spouse is employed by one of the following:

• the U.S. Government (including the U.S. Armed Forces);
• American research institutes recognized by the Attorney General;
• recognized U.S. religious organizations;
• U.S. research institutions;
• an American firm engaged in the development of foreign trade and commerce of the United States; or
• certain public international organizations involving the United States.

I had my biometrics more than 3 months ago (Feb 7) but my case was never "touched", neither before or after bio, and the USCIS website shows the same info for 4 months: "On January 14, 2008, we received this CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. bla...bla...bla"

Should I worry for this lack of activity? What if my fingerprints/bio were lost/never sent to VSC/etc...?

About the dates, as shown on NOA for I-151 they received my application on Dec 24/07, and the NOA date is Jan 3/08. What is this Jan 14/08 date when they said they received my application (when in fact it was received in Dec)? Does anybody has this kind of mess for the dates?

Same thing here... our case have never been touched even though biometric was a month and half ago. Seems like there is no real rule to the being touched thing so am not going to start worrying.. at least not yet

My wife had her biometrics done about a month ago. I haven't seen a "touch" at all. Maybe I should worry too.
