A couple years ago I received my citizenship, and never had a real need to travel outside of the country but an opportunity came up and me and my wife will be going to Mexico on vacation in September. I just wanted to know a couple of things: 1) Can i fly in and out of the US with my Canadian passport or do I need to get a US passport? 2) If I need a US passport, I see that there are extreme delays getting passports now due to COVID. Is it possible to get a passport before I fly out in September?

  2. I submitted my I-751 in mid March 2016 and received my 1 year extension and following that I received my appointment at the UCSIS to have my biometrics taken. Did that in April. Haven't gotten anything in the mail since. I know it can take a while, but I'm just wondering if I should have heard anything by now?

    When I check the status online I get this:

    "On March 23, 2016, we received your Form CRI-89, Petition to Remove Conditions of Permanent Resident Status Received, Receipt Number ***************, and sent you the receipt notice that describes how we will process your case...."

  3. I went in to the DMV after not hearing back from them for almost 2 months when I mailed in my renewal along with my i751 extension and they renewed it there on the spot. However, it's been about 3weeks and I haven't gotten my physical driver's license in the mail. I only have the temporary paper copy that is good for a couple more months,

  4. I'm having a bit of an issue here with deciding when to put N/A or NONE.

    First off, typing N/A in any of the boxes on the PDF simply doesn't register. It says the slash "/" is not a character and won't let me use it. Should I write it in manually while the rest of the form is typed?

    Secondly, do I really have to put N/A or NONE in any of the boxes I don't need to fill out? Ie. my wife's A-number (she's born in the US and doesn't have one), or my "In Care of Name" or the information about an Interpreter (I don't have/need one). It seems overkill to put N/A about 100x throughout the form.

    There are instances where I don't know if N/A or NONE is the correct answer, for example the boxes about children's info. I have no children. Should I put NONE or N/A and do I have to do it for all 2 page worth of boxes for this section?

  5. I recently received my Permanent Residency Card thanks to a lot of help from VJ. Along with the card that I received in the mail, the letter stated that I could sponsor a relative (or something to that effect). I was wondering who could I sponsor with my PRC?

    My sister (age 20) is in the US under my parent's J (investor) Visa which, from our understanding she can no longer remain when she turns 21. Could I sponsor her being a permanent resident now? What are her options to remain in the country? She's been here for most of elementary, high school and is close to completing college as well. Going back to Canada isn't really an option for her since she'd be alone. Only thing we can think of is having her re-enter under a student visa but as you all know, international student rates at college are insanely expensive.

    Any help would be greatly appreciated.

  6. So my interview is scheduled for next week. I was going over the checklist to make sure I have everything ready to go for my interview and noticed that i MIGHT not have filled out the I-485 Supplement A. To be honest, I might have but I am not sure. It's the only form I don't have a copy of.

    I applied for adjustment of status because I married a US citizen a little while ago. I originally came from Canada as a tourist and been here in the US ever since.

    So far, I've filed the I-130/I-485 checklist, had my biometrics done, a couple of requests for missing information completed and was granted an interview. I've paid the fees for my I-130 ($420) and the fees for my I-485 ($985) and biometrics ($85). Did I need to do the I-485A as well? I would think not since I'm scheduled for my interview but now I'm beginning to 2nd guess myself.

  7. I have everything saved as a PDF. Should I just re-print those? Do they need to be signed and dated like the originals?

    Also, we had a co-sponsor, do we need her original documents as well. ie. Birth Certificate, or can I just bring a copy of that as well?

    Also, NewYork2014, what do you mean by ID? My Passport is my ID. I don't have anything else but an old driver's license from Canada expired in 2009 I think.

    As far as photos, we were planning on bringing 2 photos from our wedding, 1 photo from when I proposed to her and maybe one more recently of us.

  8. So my I-485 AOS interview is next week. I was just wondering if there is anything I should know or prepare for in advance as far as the interview goes? Is it like on TV where they try to find out if our marriage is legitimate or is it something entirely different?

    Also, it asks me to bring a few things such as my I693 medical examination form (unless already submitted), my I-864 and supporting tax documents etc(unless already submitted). Is it recommended I bring these even though I already submitted them?

    The 3rd to last item on the list is "Original and copy of each supporting document that you submitted with your application. Otherwise we may keep your originals for our records". What is this in reference to? I submitted things such as marriage certificate, my wife and co-sponsor's taxes, my wife's birth certificate, my birth certificate. Do I need to bring those and a copy of each as well?

  9. Yes, did you provide a complete copy of the tax return? It must include all forms, schedules, W-2s and/or 1099s. It cannot be just the 1040 by itself. OR you can get a tax return transcript for free from the IRS and not have to worry about if all the forms were provided. The tax transcript is all you need > http://www.irs.gov/Individuals/Get-Transcript

    Perhaps they are asking for proof of her income because in that case the joint sponsor would not be needed. However, it is and they need to know she is not currently earning enough. Provide a statement that your wife currently has no income because she is no longer working at that job. Provide an updated I-864 for your wife that lists her current income as zero, if she is currently unemployed.

    Thanks Jay Kay, I'm on the IRS.gov website now and I see all kinds of transcripts. Which ones do I need? There's Return Transcript, Record of Account Transcript, Account Transcript and Wage & Income Transcript

  10. Thanks for the help Jay Kay. I submitted all the info as requested in the Initivial evidence request in my first post and sent in all the documents for a joint sponsor and in the cover letter i explained that since my wife's income is below that 125% limit that we're filing for a co-sponsor.

    I just got another request for evidence last week and it seems like they accepted my co-sponsor but they are requesting her most recent tax returns, which I provided the previous 3 (2010,2011 and 2012 years. 2013 hasn't been filed yet so 2012 is the most current). So I am not sure why they are asking for it. Is it possible I sent in copies of the wrong page of the tax return? I believe the first 2 years (2010 and 2011) was a copy of of the 1040EZ and the 2012 year was just a 1040 (I couldn't find the co-sponsor's 1040EZ).

    They are also still requesting proof of my wife's income as stated in the initial I864 filing which at the time put her above the 125% threshold. I had explained in the first request for evidence that at the time of filing the I864 she had just accepted that particular job and subsequently quit 2 weeks into it so we have no proof and wouldn't meet the 125% threshold as things are currently.... hence the need to file for a co-sponsor. What should I do here? They obviously accept the co-sponsor so why is my wife's income relevant anymore?

    I have an appointment on Feb 7th to speak to an immigration officer (set up thru info-pass) in downtown LA. Do they generally help?

    I am about to submit these forms in. Should I include in a letter or cover letter a little note about why I am not filing proof of my wifes income and instead I am providing a second joint sponsor (i864) instead or should I simply just send in the co-sponsor i864 attached to the letter they sent me?

  12. thanks so much JayKay. I personally think that providing a joint sponsor would be easiest and would require less question/explanation. If I provided the joint sponsor, would I (should I) still need to do #2?

    Also, for #2 as proof of payment from her previous job, she just got a cheque (no stub with official payroll deductions) once a month. Would a copy of 2-3 of those checks showing monthly pay suffice?

  13. Hi all, I would really appreciate any help on my AOS application.

    I recently received a Rquest for Initial Evidence for my Adjustment of Status application. There are 3 things "missing". Here's what is required as per the letter:

    1. Submit a complete Federal Income Tax Return submitted to the IRS from the petitioner/sponsor on Form I-864, Affidavit of Support for the most recent year

    I thought I submitted my wife's income tax return, but maybe I didn't. Is this request for myself or my wife's tax return? I am the one that needs the AOS, my wife is the American citizen. I don't have a SSN so I can't even file. Should we just send in a copy of my wife's most current tax return?

    2. The petitioner/sponsor's income on the Federal income tax return does not meet or exceed 125% of the poverty guideline. The petitioner/sponsor lists their current income on Form I-864 as an amount to be considered as sufficient; however, no evidence has been submitted as proof of current income (and then there's a list of evidence I could supply as proof of wages).

    So my wife, last year, made less than the 125% required. In July/September she took a job that met that requirement however, she quit that job and took on a new one literally a week ago that also meets that requirement. My application was sent in September so if I submit proof of her income thru a letter of employment, it will be from a different employer than what's listed on the I864. Also, she gets paid quarterly, it's kind of a salary + bonuses she will be making so she doesn't have a check to prove it (yet) and it will be too late by the time she gets her first quarterly pay. What should I do? Should I even bother with that or should I have her mom who is well above that 125% sign an affidavit of support form or would a letter of employment suffice?

    3. Based on the documents submitted with Form I-864, Affidavit of Support, for the petitioner/sponsor, the income did not meet 125% of the federal poverty line for the petitioner/sponsor's household size.

    Submit evidence of assets that meet the standards listed below or obtain a joint sponsor.

    Now, this one I don't understand at all. Is this not the same as #2 or is this something different? Why does my wife (The US citizen) need to show evidence of assets (ie. ownership of stocks, bonds, property etc)?

  14. I'm working on my I-485. I was wondering, as a Canadian who last entered the US as a tourist, what do I put under the "Current USCIS Status" box, and expiration? As a Canadian we're not given I-94s and can enter the US with a simple passport.

    Also, for Part 2, under "I am applying for an adjustment to permanent resident status because:", which box do I tick off?

    I entered the US as a tourist and stayed here for a few years and recently got married to a US citizen. I'm finally working on my AOS I130/I485 paperwork. The wording is kind of confusing but some sample documents I looked at for a similar case had the A box ticked off.

    And what do I put for Place of Last Entry Into the United States? I entered US customs at the Pierre Elliot Trudeau Airport in Montreal and flew into the US. I don't remember if I flew directly to Los Angeles where I currently am or if I stopped over somewhere like Chicago.

It must be filed with USCIS within one calendar year, but provided it is then it will remain valid for as long as it takes USCIS to process the I-485, provided that: (i) you submit the I-693 concurrently with an I-485, and (ii) there are no class A or B medical conditions noted on the I-693 (other than a class B condition listed under "other medical conditions").

    The I-693 is part of my I485 package, so it would all be submitted in the same package. I passed the medical, didn't have to do any re-tests and all my immunization shots were up to date.

    So as long as I file it within the next couple of weeks I should be OK? Is it better that I go take the exam anyways and get a more up to date one (I am scheduled for one on Monday but will cancel if it's not imperative)?

    Thank you! This might be a dumb question but is the affidavit of support something we write up on our own or is the affidavit simply referring to the i864?

    She will use her current annual income that she is earning from her job right now. She proves how much that is with a letter from employer and recent pay stub(s). Read through the I-864 instructions.

    Since her job is so new, using her mom as a joint sponsor is advisable. Her mother will fill out her own separate I-864 and provide her most recent tax transcript, letter from employer and recent pay stub(s) as well. She will also need to include proof of being a USC or LPR.

    One last question about my wife's pay. Right now, at one of her jobs she isn't exactly an employee. They just pay her on a per work basis, kinda like being a sub contractor. Technically she gets a check, but not a stub with deductions and breakdowns and such. Should we just use a copy of the cheques(s) as proof? She just started her other job so her first pay check should be coming in in about 2-3weeks (strange pay schedule).

  17. thanks for the help guys. As of now, she is working but obviously that doesn't reflect on her 2011 tax returns. She just came out of an internship and is beginning a normal paying job through that internship which should give us adequate income. How does this work as far as meeting/exceeding the poverty threshold?

    Her mom on the other hand is more than capable of supporting us. So would it be recommended she file an affidavit of support for us anyways?
