    Melibelle- I have been reading some the topics here and I don't know if you know this question. If filed with the adjustment of status, will i-765 be free?

  3. Yes if she is getting married and adjusting status from within the US. Please see the AOS guide linked above. It has all the forms and information she will need.

    1. She will have to file an i130 and i485 (to adjust status), also an i765 (for an EAD if she wants to work before she gets her green card) and an i131 (Advanced Parole) if she may want to leave the country while the green card is being processed

    2. Once adjustment of status is filed, she will be in a period of authorized stay. Even if her visa expires, she can stay in the US until they decide her case

    3. She can't work until she receives her EAD (from the i765) which takes a few months from filing. I'm not sure about school - probably someone more experienced can answer

    4. If she gets a fiancé visa, she will have to adjust status after that anyway, so if she's in the US and doesn't have to leave anytime soon, marrying and adjusting status here is the fastest way to go. If she has to leave, it's fastest to come back on a fiancé visa, but again, she will still have to go through the AOS process (with the inability to work) even after the fiancé visa is approved. If she has to leave and can wait a little longer, the IR-1/CR-1 spouse visa will allow her to work as soon as her visa is approved but I believe that process takes longer.   5. Hi I need some advise as far as being on a student visa and getting married and adjusting the status. My friend is on a student visa which expires soon. She just found out that she is pregnant. They want to get married and adjust her status. If someone can help me with a few questions I will appreciate it.

    1) Does she need to file a I-130?

    2) does she need to apply for an extension of the visa or will the filing of i130 automatically extend her visa?

    3) can she work or go to school while the petition is pending? Or does she need to file something else?

    4)!in your experience is it easier to file the i-130 or Fiancé visa petition?

  6. I believe they would have let her in had she managed to get to the US. I have heard of cases of some being allowed in with a warning or taken to secondary, having their residence requirements read to them and made to sign an affidavit to that effect, to remain in their files.

    The issue you have is that she must be present to renew her green card and she can't do so for she can't get to the US.

  7. So I made an infopass today regarding the I-130 that I had filed for my mother. My mother was a permanent resident but she has not been in USA for like 4 years. Now that is abandonment of her resident status. She never applied for the re-entry permit either.

    She tried to get a re-entry visa at the embassy but was denied. Anyway, I refilled for her. I moved and changed my address with USCIS in April. USCIS sent me an RFE in May and they sent it to the wrong address. I never received anything. I decided to do an info pass today and I was told something was sent to me in May.

    Anyway, the officer also told me that my mother still has her residence. I told him she has not been in the country for 4 years and he said that doesn't matter that she can still come. Then I told him that her green card expired last year. Then he said that she needed to renew and take her fingerprints.

    I am just confused. Should I assume he gave me wrong info? USCIS clearly states that if you do not come once a year and do not get a entry permit you will lose your residence.

    Wow you are so lucky. I sent mine a day before you and still waiting. Well mine says that it is at the benefits center. Unfortunately online there isn't a timeline so that's why I asked here. I really hope I get something in may, keeping my fingers crossed.

    December 15, 2013 – Sent I-130

    December 18, 2013 – USCIS Received I-130

    March 13, 2013 – Received RFE letter (birth certificate not too clear)

    March 14, 2013 – Sent Reply to RFE letter

    March 20, 2013 – NBC received my Response to RFE

    March 21, 2013 – NOA2 (Approval from USCIS)

    April 9, 2013 – Got the Case Number over the phone from NVC agent.

    April 9, 2013 – Emailed DS3032 to NVC

    April 15, 2013 – Paid AOS fee bill online to NVC

    April 15, 2013 – Sent AOS (I-864)and supporting docs

    April 18, 2013 – Got email reply from NVC regarding the DS3032 (Incorrect year of my bday). Sent another DS3032.

    XXX – Paid IV bill online to NVC and printed Cover sheet

    XXX – Mailed DS 230 and supporting docs

    XXX – Medical Appointment

    XXX – Embassy Interview

    XXX – Received Visa on hand

    I hope mine takes this fast too. Let's see. They received mine Feb 4.

    Hi Alex..my IR5 timeline..

    Dec 12, 2012 - sent I130

    March 1, 2013 - I130 approved

    March 18, 2013- NVC got our case

    March 22, 2013- got our case #

    April 5,2013- paid the AOS

    April 6, 2013- mailed AOS thru UPS

    April 6, 2013- emailed the DS3032

    April 15, 2013- they accept my choice of agent

    April 17, 2013- invoice for DS230

    April 18, 2013- paid my IV fee

    April 19, 2013- false checklist received via email

    April 19, 2013- got an email from NVC they received and accepted my AOS

    April 22, 2013- sent DS230 documents via fedex....

    Hope this helps....I am trying to get my mom's medical @ st. Lukes way ahead just in case if theres something wrong it helps to know early before the interview.

    call uscis.. find out where your file is and get an infopass.. worked for me :)

    I have done one of those info passes and found them to be useless. I guess it depends on the individual. Plus it hasn't been that long for me to do one. I am just curious how long it is taking people to get theirs approved. Thanks

  10. I received my green card a couple of months ago and it was stolen a few days ago. I know I have to fill out I-90 for a replacement but I don't know if I should include the biometric fee since 1)I will apply for citizenship soon and 2)Just a few months ago I received it so I don't see a need.

    I dont know if anyone has gone through this before but I was thinking of sending the I-90 and a letter explaining what happenened and how I plan to file for citizenship soon and a copy of the police report. Do you think that they will reject the application? Or with they ask me to just send them the fee for the biometrics before they do anything.

    My fear is that if I just send the application fee without the biometric fee they will cash the check that I sent them, deny the application and ask me to send another one. Does anyone think this will happen?

  11. Hello,

    I wanted to get some opinions about a decision that I need to make. My mother is trying to bring her mother to US. My mother is a US citizen and so is my grandmother's husband. So technically both my grandmother's husband and daughter (my mother) can apply for her. The issue is that my grandfather which is a US citizen does not live in US. He hasn't lived in US for a long time.

    1ST Question

    Would it be faster and a better option for my mother to do the petition or my grandfather?

    2nd QUESTION

    If my grandfather does it do you think he might encounter a problem since he doesn't live in US or do you think that it would take a longer process?

    So basically I am just trying to decide who would be the best person to do the petition and basically the fastest choice.

  12. So finally they are sending my card..this is what the website says today

    On October 4, 2012, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

    Hopefully everyone will receive something soon.

    So my question is: can I just include a copy of my old green card or do they need a copy of the one that they are sending me? Will the new card have the same A number as the old one?
