  1. My husband went for his interview, he said it was very fast and not too many questions, they saw the pictures, they got all the needed forms. They asked my husband to take oath and sign DS-230 part 2 . then they cancel his B1/B2 visa. after all this the officer hands him a 221(g) asking to submit my domicile proof. He just said to him, just drop it off at the office in your city with your passport and you are good to go. Now I have an checking and saving active bank account in States, state issued ID with an Address and even a job offer letter, are these documents enough to prove my domicile? Thank you for any help you guys can provide.

  2. Keep it simple, and make sure to sign it. Here is what my husband wrote:

    To Whom It May Concern:

I am Mr Penguin, Penguin's husband and petitioning sponsor. I did not file an income tax return for the years 2005, 2006 or 2007 because I have not worked during my 3 year residence within the Republic of Ireland. Once I came to Ireland, I was unable to find work and so used savings; I was maintained by my wife upon her income and savings. Since I made no income for these years of any type, I was not required to file an income tax return with the Internal Revenue Service.

    Sincerely, Mr Penguin.

    Thanks for your help

  3. Hi I had filed for I -130 for my husband, he got reply from the US consulate asking to submit necessary documents. Now i am getting a joint sponsor as i have not worked or paid taxes since I have been living abroad and been a house wife and a mother. SO they have asked me to write a letter explaining the reason why I have not paid taxes for all these years. I was wondering if anyone might have a sample draft of letter that I can get ideas from, as i just want to be sure to write the letter in proper format and also self explanatory as to why i haven't paid taxes. Thanks for any help you can assist me with.

  4. Hi, I am filling I-130 form, just a question about column 15, where it asks about Name and Address of present employer, there am I suppose to write my husband's employers name or my employers name? I am the petitioner and my husband is the beneficiary. Another question I had was in column 13, where it say my citizenship was acquired through-I have checked the box Parents, as I was born outside of US and My dad is an US citizen. He had got a consular certificate of birth abroad, is this the certificate of citizenship and should I write the number for the same in my I-130? Thanks a lot for your help.

  5. Hi!

I'm also living in India with my husband!

We didn't go the Embassy filing route for a multitude of reasons....so I hired a lawyer in the US to handle this situation for us.

I also am not working for the last 3 years that I've been in India. My Parents are also retired, however they're combined retirement income was enough to clear sponsoring my husband.

You might be able to do joint sponsor with your Dad and an Uncle if your Dad doesn't make enough to clear the requirements. You'll also need him to provide you a letter stating that he will provide you a "domicile" (or whomever you plan to stay with in the US) as you will be required to show Domicile proof in the form of rent/ownership. It helps if you've left a bank account in the US and still have your current License. Especially if your license shows the address of the person who you will be staying with (both my bank account and license are with my Dad's address so he supplied the letter giving me domicile).

Hope this helps and GOOD LUCK!

Hi, thank you for your help. U said u hired a lawyer in the states, I was wondering if you and your husband are here, can the lawyer do all the processing from the states? Can i get the contact details of your lawyer, if possible? Thanks

  6. Hi everyone,

I really need some advice about the immigration process for my husband. We have been married for more than 2 years and also have a son(who is a US citizen). Ever since our marriage we have been living in India and I even have a long term visa for India. Now we want to move to the states and are trying to immigrate my husband. From what I understand I need to file I-130 form with the USCIS in the embassy here and after that it goes to NVC and then they send me a packet for all the documents and forms I need to submit.

Now my biggest concern is that I have never worked in the US and have payed no taxes. So i am not sure if I can fill I-864 Affidavit of support. My dad who lives in the states is retired. So I was wondering if I can have one of my uncles or my friend be a sponsor? IF so how should I go about filling the forms I-864 and I-864 a? If you have any other advice for me, I would really appreciate. Thank you.
