the form is pending. if he leaves he will be barred from the us for 10 years. its wierd, but its the way it is. so, file the package ASAP and hang in there. if you read my timeline...its been CRAZY and a long wait, i didnt file my i-130 and i-485 package together like i should have so i had to wait an entire year for a response from the i-130 . JUST sent the i-485 package a weekish ago THANKGOD

i was inspected and let through very much so lawfully. if you have read the instructions, you would know that once you have the i-130 approved and your husband is here you can then apply for adjustment of status. AND once the i-485 package is sent and pending, he is an immediate relative of a US citizen therefore he does not need a visa to be here AND he HAS TO STAY INSIDE THE US while

the BEST and ONLY advice is FOLLOW the instructions PERFECTLY on the instruction sheets of the i-485. to be honest....its VERY simple you just have to read. be 100% sure all is done right and youll be fine. it seems complicated but its not. as for him being here on an overstayed i-94, i have been here since march 5th 2011 without a visa or anything. i crossed the border in montana with my folks
