  1. Hi, I hope this is in the right section.

    I'm currently in AOS from a K1 visa. My husband makes just above the 133% limit for us, by a couple of hundred $, so was able to act as my sponsor. Realistically though, our joint income has gne down by about 70% in the past 2 years, and, whilst he works an honest job, we are struggling.

    Recently we got surprise news that I am pregnant. While we are really happy about the pregnancy, the timing is hard (basically, we had hoped to wait until I had my US teaching license and a job and he was back in school, thus doubling our income). I have my EAD, but am limited in the amount I can work because I have severe morning sickness and typically throw up multiple times a day (the dr prescribed me a drug for it, but the insurance company only agreed to pay for 12 for the month, so I work part time and save my drugs for those days). I have also been having complications that, whilst fine now, have put me back.

    We are looking at our options for when baby is born. We have ok insurance through my husbands work. My biggest issue is that our out of pocket maximum is 4.5k, which for us is a lot. While we diligently save, and have a few k saved, I can't realistically expect to have 5k sitting there when the birth happens, especially as I have student loan payments due. We will absolutely have the 2k left to hit my out of pocket maximum if need be, but I am worried about what happens if baby ends up in the NICU.

    So here are my 2 questions. If baby stays on our insurance, do hospitals usually allow payment plans for the coinsurance portion. For example, if we owed 4.5k, and could pay 3 upfront, are they likely to do a payment plan with us for the other 1.5k? We currently save about $200/ month, so could put that in a payment plan. Otherwise we would look at taking out a loan etc.

    I had some friends say, however, that baby is most likely eligable for medicaid because of our income. If this were the case we would be really interested, because being able to only pay for me and not baby would be a huge help. If we did this and baby were approved, would it count as me baing a public charge because my US citizen baby was on Medicaid? We expect to have our 2 year greencard by the time baby is born. Would having a baby that has been on medicaid be a problem when we apply for my long term greencard, because it indicates that my husband couldn't pay for us?

  2. Hi, I am hoping this is the right forum.

    My husband and I flied for AOS in November. His income is about $24000 - enough to support the 2 of us, according to USCIS (in reality we are living with his parents to save money, as we are hoping to send him to grad school in August, so his income potential is increased). The problem is that recently I found out I was pregnant - a little earlier than I had planned - we were hoping to wait until he was in school and I had my EAD so could work to support us (I'm a teacher by trade). It is a wanted baby though, and we are definitely happy to be welcoming it into our family. DH's work offers good health insurance, so that isn't an issue.

    My question is at what point does the new baby count in our household size. DH earns $1000 less than the poverty line for a household/family of 3. If need be, my in-laws are able to cosponsor (no problems, they are quite advanced in their careers by now). Do we need to refile paperwork to reflect that we now have a family of 3 once baby comes? Now I am pregnant? Not at all?

  3. So, I am a trained teacher, certified in my home country (New Zealand). I am waiting on my EAD and AOS.

    I was wondering if it is legal for me to apply for positions for the next school year. Whilst I can't apply for certification or public school jobs without the EAD, there are some private schools I am interested in that are accepting international certifications. The jobs don't start until the next school year (July - September 2014, depending on school). The problem is, the positions are being advertised now, and I don't want to miss out, based on waiting for my EAD. There is one school in particular that I would love to work at, am qualified for (including the "extras"), likes international teachers and is advertising right now! I don't want to do anything illegal though.

    So, does anybody know, can I apply for jobs that I intend to take up after recieving my EAD before recieving it?

    We ended up calling USCIS, who told us to file for a replacement and pay the $405, with a request to expediate because I need to file AOS. If we haven't recieved it by the end of the month, we plan to send in my AOS documents anyway, knowing we are likely to get a RFE, and book an infopass appointment, as we don't want to become out of status (which we would be late November). We would send it with a copy of our letter and a printout, plus copies of our documentation showing we did apply for a new one. We were married 3 weeks after my arrival, so well within the 90 days.

    It is frustrating - I have tried to keep so on top of things, but, because we didn't recieve any other paperwork, we honestly thought the NVC letter was the NOA2.

  5. It's finally my turn to post here! I am starting my first job in America on November 1st. I'll be working as a client implementation specialist for a British software company! Very Excited! smile.gif My best piece of advice to anybody out there still looking for a job would be to find a place that values your international background. That way you won't have to start from scratch smile.gif I was applying for receptionist positions in the beginning, but was told that I was overqualified (I am about to finish my master degree in communications.

    Is that a Masters degree through Denmark or the US? Were you able to work on it whilst waiting for your AOS?

    I expect that I will be able to go on my Fiance's insurance within a month.

    I also have a preexisting condition that will not be covered by 7 corners. Basically, in my situation, I am about as likely as someone without my condition to find myself hospitalised for it, because I respond extremely well to drugs. As a result, I will not have coverage for it for the month I am without insurance, but my specialist here in Japan is sending me away with a couple of months worth of pills to tide me over,

    I was recently approved for my K1 visa and will be moving in August. I am part way through a Masters degree form my home university in New Zealand, and would like to continue when I get to the US (I am a teacher and am really hoping to be done in time for the next school year). I can't see any reason this would be an issue, but I wouldn't want to do something to compromise my status in any way. So I guess I am just asking - the fact its illegal for me to work pertains specifically to paid employment, and studying via distance from my home country gives no legal problems?

  8. Interview Monday in Tokyo! Approved there. Visa physically arrived Wednesday! I can't believe I finally have it!

    Yay! 7 weeks and I'm there (with a few weeks in New Zealand seeing family on the way :D).

  9. Your question is a little confusing, but just wanted to tell you that if you need a police cert from Japan, that it takes 2 to 2 and a half months.

    Sorry - I know I need one for Japan. What I was meaning is that I am confused why the Tokyo embassy also included forms for getting a police check from Germany, which I thought I didn't need as I only resided in Germany for 8 weeks.

    I recently recieved packet 3? from the Tokyo Embassy. In the packet they gave me form DS-230 and information regarding police checks. I am a New Zealand citizen, and lived there for 24 years, so obviously will be sending that one. What I am confused about is that they included one from Germany. I worked in Germany for 8 weeks in 2009. I thought they didn't need a police check for countries we spent less than 6 months in?

My fiance and I are considering cancelling my K1 visa (likely after NOA2 but before the interview, which we predict will be ina month or so - enough time to see if I make significant improvement or not) as I am having some health difficulties that we feel are best dealt with in my home country (NZ). These are not the sort of health problems that would cause me to be denied, but still we would prefer to be treated in my home system if the problems are likely to persist after I leave Japan. He would move to NZ for a year or 2 at this stage, then we would look at doing a direct consular file for a spouse visa and move to the US together. Imcidentally, I currently live in Japan and we are filing through Tokyo, so this would involve us both moving. We have a couple of questions.

    Firstly, if we were to cancel so we could marry in my country, would this likely cause us difficulty in getting a spouse visa at a later date?

    Secondly, if we chose to do this, we would want to visit the US a couple of times to see family etc. Is there likely going to be an issue at POE on the VWP if I have a previously cancelled fiance visa (to the man who would be my husband by then). I could provide ties etc to New Zealand?

    Third, would any of this change if we had the visa and decided not to use it (including submitting any paperwork as necessary). Because there is a chance my medical condition could improve, we would rather wait until the last moment to decide coountries.

  12. Hi everyone,

    I have done a couple of searches and couldn't find anything, but it seems like a fairly straightforward question.

    My fiancé has no fixed hours at his work. He started a few weeks after we submitted his initial petition (he moved back to the US from Japan and we filed about a week later. It took him a little longer to find a job, so wrote his job as "unemployed". He was employed for four years in Japan)

    He has been there about 3 1/2 months and his job is secure, but his hours vary each week and he has no fixed income. He works full time most weeks, and on the odd week he doesn't he works about 3/4 time. Judging from the last 3 1/2 months, we can expect his annual income to be around $20 - 24000, so enough to be my sponsor, but there isn't a strict "salary" he can write on the form. How should we state this on the form? He can provide pay slips and most likely a letter from his employer, and his parents are happy to act as co sponsors if needed.

    I am currently filling out my biographic data for my K1 visa. There is a gap in my dates, as I moved out of one place, travelled to Turkey for a month, visited my parents, then moved into my new place. What should I out for my address?

    1. The address I had my mail forwarded to?

    2. My parent's address?

    3. State "travelling in Turkey and New Zealand, no fixed address"?
