  1. I am the sponsor of a green card for my mum.

    USCIS sent me a Request for Initial Evidence letter (I-485).

    I don't meet the income requirements (I'm self employed) so I will add the assets of my mum and me.

    It has asked for bank statements for the last 12 months of my mum, evidence of property ownership for my mum and me, recent licensed appraisal and any mortgage/lien release for my mum and me.

    I filed my tax return jointly with my wife.

    For the Total income on page 6 of form I-864, I reported an adjusted gross income of $8,679.

    But since then, my latest tax return was made by a professional and the number increased so I need to add that updated tax return of the documents.

    Because of the new tax return and the new values (higher) from 2 licensed appraisals, I also want to include updated pages 5 and 6 of form I-864, to show the real values and to show that it beats more easily the minimum required.

    The problem as a self-employed filing jointly, I'm not sure what to write for the Total income on page 6 of form I-864.

    Should I write the adjusted gross income (line 37 of form 1040) which is now $10,918, or the total income (line 22 of form 1040) which is $11,748, or the net profit or loss from business (Line 31 of Schedule C) which is $9,948.

    I believe that it should be the net profit because it takes into account my business expenses and it doesn't take into account the money my wife earned. But I'm not sure.

    Even if I take the net profit into account, my mum would easily meet the minimum required (because of good assets in the USA).

    So what income figure should I write?

  2. If you look at the instructions for I-864, section 6.8, it says "You may use the assets of the intending immigrant".

    Yes, my parents have assets in USA.

    It seems that my parents will have to pay for a title search.

    If I knew all the costs for a title search and licensed appraisal, I would have tried harder to find a joint sponsor.

  3. I am a US citizen and my parents are applying for the green card. Because my income is too low right now, my parents need to show that they own a minimum amount of assets.
    They bought a condo in Miami Beach 2 years ago and they paid in full.
    Immigration is asking for documents such as "mortgage/lien or lien release of any real estate".
    My parents never had any mortage and paid right away in full.
    I contacted their real estate agent and she told me that they have to pay for a title search.
    The problem is that we have to pay that also for another apartment in Miami and also licensed appraisal (required by immigration also). So the total for all that is about $1400, in addition to all immigration fees ($5000) for my parents. This is costly.
    Is there a way to avoid paying for a title search and have a document proving that my parents paid in full at the beginning?

  4. Based on the number 4 of the checklist for N-400. Which is a list of documents to attach with the N-400 based on a marriage to a US citizen:

    4. Documents referring to you and your spouse:
    - Tax returns, bank accounts, leases, mortgages, or birth certificates of children, or
    - Internal Revenue Service (IRS)-certified copies of the income tax forms that you both filed for the past three years, or
    - An IRS tax return transcript for the last three years.

    So my question is: is it enough if I only attach the birth certificates of our 2 children ?

    According to mathematical logic, I think so. Because it's either the first line or the second one or the third.

    So if I choose the first line, when I look at the location of the "or", I see that have to attach either "Tax returns, bank accounts, leases, mortgages", either "birth certificates of children".

    But maybe I'm wrong with my logic, you can tell me.

    Anyway, I have joint tax returns but I don't have joint bank accounts and I have no lease or mortgage.

    If I need to provide tax returns, do I need the last one or the 2 last ones ?


  5. Today, I went to a store to get my 2 passport-style color photographs.

    Then I read the requirements for the N-400 application. It says "Head height should measure 1” to 1 3/8” from top of hair to bottom of chin, and eye height is between 1 1/8” to 1 3/8” from bottom of photo".

    I took a ruler to measure my photograph and found out that the head height measures 1 4/8" and the eye height is 1".

    So do I have to go back to the store and request to take new photographs more far and lower ?
