    Yea me and my husband thought a lot about it but then when we spoke to an attorney she said she had seen cases last years so she felt being we have the proof he was here legally the whole time and a matter of sending the original certified copy were going to go the path of refiling.

    Im just curious how come in denial letters they don't tell people they can refile?

  2. Yea so i called tier 2 and they were no help we had someone that just didn't care. She was basically saying its whatever the letter states so and blah blah blah and then went on to say the denial would say to refile if you could which i know isn't true because there not going to tell you that.

    Then when trying to see further into it she hung up on me, real nice.

    So I'm going to continue to put everything together which basically all is and do what you suggested.

  3. Perfect! i didn't even think of the timeline i will definitly type out a timeline to include with the letter we wrote even though it does state all the dates its always good just incase they don't read the letter fully. Should the copy of the denial be included as well?

    Just curious will an info pass and or calling tier 2 change anything with the case? Meaning, can they change something that is marked? or will this just clarify the information provided in the denial notice?

  4. Ok good lol, but the family friend is an immigration attorney we asked her about it and she said the same thing we don't need i-130 because he was admitted under a K1 visa.

    My husband and I's feeling is that they saw we messed up and didn't send the original certified copy and then got "lazy" to check the dates correctly being they all hit in august. We decided to just refile since it can take months possibly to go the other route and if that doesn't work were at refiling anyway.

    Is it right to send a letter stating we submitted the original court record disposition and how the dates are all correct ALONG with a copy of the full denial notice attached to the i-485 and stating in the form please see attachment where it ask's if he had applied for AOS at any other time?

    At first when this happened we were wondering if they confused his previous overstay but he was a MINOR left at 17 so that doesn't account to him and the embassy knew of that when we had our interview and were approved quick and easy, so the only thing we can think of was they didn't check the dates correctly.

    On the other hand will tier 2 really be able to tell me more? I thought they do know more definitely over tier 1 but can they actually give more info on the basis of further looking into it?

    Either way it should be ok this time around with the supporting documents

  5. Hi Everyone, it has been a while since i have been on and after my now husband had received his K1 visa and came to the US, we got married within 90 days and filed for AOS. He did his biometrics successfully, received his EAD/AP card and then after 6 months we received a denial notice for adjustment of status.

    The notice stated that he did not send an original certified copy of his court disposition from when he was 16 (nothing serious just disorderly conduct) we originally had included a copy of the certified copy so accordingly the application was denied. Then the next paragraph stated
    “The evidence of record shows when you filed your application you were present in the US contrary to law because you have violated the terms of your admission.”
    This isn’t correct because our Point of Entry was on May 21st, 90 days from that is August 21. The passport has august 20th written but the i-94 says august 19th.
    Either way we were married within 90 days because we married on august 11th, filed for AOS on august 19th it was received (as stated in the denial notice)
    It all doesn’t make sense other than the part of the copy of disposition. I feel like they say that and didn’t really look into the dates and added that part.
    We have decided to just refile and send everything again and where it states if he has been denied before put yes and put an attachment with a written statement saying how we have included the original court certified copy and the reasons how he was not in the US country to law and list the dates as above.
    Is this the right way to go about this. We just really need some extra feedback on others' opinions. We have gathered everything to submit again.

  6. I use cheapair.com, cheapoair.com, orbitz.com, skyscanner.com and jetsetz.com, whichever one is cheapest depends very much on the date and flight you are looking for.

    I recently bought my fiancee a intra-Europe ticket so we could meet in a third country while we wait and there were no issues at all buying the ticket from the US. The only concern would be to make sure that the name on the reservation matches the name on the passport exactly.

    I will definitely let you guys know when it comes in. I received an email reply from the embassy saying the visa was approved and issued on April 19 (Friday). My fiance called Sedex today and they said they haven't received anything from the embassy yet. The waiting is driving me crazii! I emailed the embassy back asking if they had actual gave the stuff to Sedex yet, lets hope any day now we will receive something and I get reply early tomorrow to calm my mind down and where this stuff is lol. Ill keep you posted =)

    I'll look into Travelocity as well, i haven't been on that website yet. I guess it should be fine then if it the tickets were purchased in the US as long as the right information is on the tickets. If I'm not mistaken i think the shipping part of the visa used to be done in the embassy? but now they have people go to Sedex right next to the embassy and set everything up with them and then bring the paper from Sedex back to the embassy once it is paid for. So now were waiting on the tracking number email from Sedex, they said they send it to us once they receive the visa and everything to be shipped.

  9. Heyy Everyone =)

    So my fiances interview was on April 16th and he was approved and I was just wondering what others experiences were like from Brazil on the amount of time it takes to receive the passport with the visa and all that stuff.

    We asked one of the employees at the embassy and he estimated around last Friday it should be completed and mailed out by Monday and we should possibly receive it on Wednesday (tomorrow), but we haven't received an email confirmation with the tracking number like Sedex said they would once they send out for delivery.

    I sent an email to the embassy today asking if they knew around when he should receive it, I'm just waiting to hear back from them.

    I know it hasn't been THAT long but were extremely anxious for him to receive it so we can book our tickets ASAP especially since the closer it gets to the date we want to leave ticket prices will only go up :wacko:

    Also if any one has any advice on where to purchase tickets at a great price Ill really appreciate it :)

    I was just curious, if i happen to go with a US place to buy tickets for us will it make a difference? Or if i had someone else put it on their credit card does it matter?

    Whenever i traveled to Brazil someone would purchase on their card but my name on the itinerary and tickets and had no issue, I just don't know if its different for my fiance since hes coming from Brazil on a K1 visa

    I would love to hear any advice from anyone, thank you guys so much!! :)

    Its definitely a great feeling to get through this part of the process, now its focusing on getting tickets booked once visa is finally delivered and getting through POE with no issues, I've read that people over work themselves about it more than needed so I'm hoping that's the case :)

  11. My fiance's appointment was on April 16 in Rio and was APPROVEDD!!! =D

    The people there were extremely nice and everything went so smooth. We got there in the morning a little after 6:30 and were the second couple in line. There were about 6 people that day going for the K1 visa. The first person checked my fiance's documents at the desk in the room, then the second guy at the window talked to him a little bit, checked over the documents and we sat and waited for a little while for the big interview. During this time my fiance and I were trying to stay calm by talking and joking around with each other to the point one of the guards in the room passed by us and handed us a post it note saying "behave ourselves" in portuguese :P:innocent:

    After some time we were called in for his interview and the guy just asked three simple questions,

    -How we met

    -why my fiance decided to come back to Brazil

    (he was there as a minor and came back at 17)

    -and then asked me when my first trip to Brazil was

    That was it, then just typed on the computer quietly, at this moment my fiance held my hand and next thing we knew the guy looked at us and said "Well I'm going to approve you guys now" I just had the biggest smile on my face (i had to keep telling myself not to cry loll)

    They didn't even ask for one bit of relationship evidence, nothing, they didn't even ask my fiance of a previous arrest he had as a minor or ask for any court records nothing. His arrest turned out to be just a violation and i believe disorderly conduct, and paid a fine so that's the only reason i can think of why it never came up since he oviously checked 'yes' on the DS form that asks if you have ever been arrested..... We had the certified court papers and disposition of the case just to be prepared but they never asked for them.

    Other than that we went paid the shipping fee and now just waiting for the visa to come in the mail. It feels like forever waiting!! and its only been three days loll. Ill post a more detailed experience plus hotel details on the consulate reviews page if anyone wants to know more.

    I just wanted to say thank you everyone for the help on my previous posts, I truly appreciate it and I wish all of you the best of luck with your processes :D

    I'm putting together a checklist for my brother who is going to be my fiances co sponsor for the K-1 Visa and wanted to know if you guys can look it over to make sure I have everything that will be needed for the embassy.

    -Proof that he is a US citizen (he was born there) such as copy of birth certificate and does he need all pages of his passport as well to prove citizenship?

    -Statement from employer on showing:

    1. Date and nature of employment;

    2. Salary Paid; and

    3. Whether the position is temporary or permanent

    -3 most recent pay stubs from Work

    -Copy of the last three years of taxes (2013,2012,2011)

    *(Do these need to be originals or copies???)

    -Copy of W2 forms from his jobs

    and does he need....

    -Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account:

    1. Date Account Opened;

    2. Total Amount Deposited for the past year; and

    3. Present Balance

    (if he needs this how does he go about getting this, does he just go to one of the desks at the bank and sit down and talk to someone and ask them to write something or does he have to talk with someone higher up in the bank)

    He also has assets such as his condo that he owns and at least three or four motorcycles

    How does he include that stuff, does he just list on the I-134 form or does he need to include proof, if he needs proof what type of proof would that be?

    --I have heard of people getting their co sponsors to fill out both affidents of support the one for k1 visa and one for AOS process to show they are willing to sign again if needed. Will this be necessary, in what circumstances do people do this?

    *I also am currently unemployed but a full time student, do i need to get anything from my college for my fiance to bring to the embassy to show that? If so what should i get?

    As far as the co sponsor my brother is well over poverty level and owns assets, so I'm praying having a co sponsor wont be an issue, from what I've read here on visa journey the American Embassy in Brazil are not hard on people using co sponsors as long as all the proof and paper work is there

    Sorry if it seems confusing lol, after posting I realized that I put so much in one post.I never heard of proving domicile but Its just something that came to mind, I wasn't sure if anyone had any idea about it. I probably am thinking way more into things than I need to but then on the hand you never know with the embassy.

    I have heard some stories where embassy's have been more accepting to people who are full time students who are not employed at the time. I was wondering if i have my co sponsor fill out both of the forms even though the one used for AOS wont mean anything right now, but will show he is willing to support all the way if needed.

    Our I-129F petition was approved a few days short of a month ago and my fiance already got the email confirmation saying his appointment is on April 16th. We definitely are nervous since he still needs to do his medical and were not expecting to get an appointment so soon. Basically we've been doing everything to put things together so we don't have to risk rescheduling.

    I am currently in Brasil with my fiance for almost two years now and my fiance will be using a co sponsor since i am currently unemployed. I have emailed back and forth with the embassy (which to my surprise answers very fast in case anyone from Brazil wanted to know, If i sent an email at night the next day they had replied), and they told me i need to write a letter stating the reason why i am currently unemployed and need to fill out a support form so my side is covered, but i wanted to know if i got everything together for my brother who will be the co sponsor.

    -Proof that we are related and he is a US citizen (he was born there) such as copy of birth certificate and does he need all pages of his passport as well to prove citizenship?

    I had moved in with my father a few months before i came to Brazil but all my mail goes to mothers. Such as bank statements which if i chose to do everything online it would never get sent there but she prefers i get hardcopy of everything , and school information i have listed under my mothers address. I never cared to change it because its my mothers house and with mail issues i feel better having it to go to my mothers. For my college I listed her address from when i registerd and never cared to change it since they barley even send anything. Other than that I don't get any important mail. When i did everything with USCIS i put my dads address for mailing address because i didn't want it to be a confusion.

    Is it necessary for my father to write something saying i live with him and don't pay bills or rent so they wont think money is an issue?

    I also am currently unemployed but a full time student, do i need to get anything from my college for my fiance to bring to the embassy or does that not even matter? If so what should i get?

    My brother works for a company that he said he can get me a job there for when i return with my fiance but i don't know if its worth it for me the us citizen to bring a potential letter stating i have a job offer if I'm back by XX date making XX amount. I'm scared there going to say for me to return home work and then have my fiance return with pay stubs or something. I don't want to return without my fiance when we've come so far and are so close to going back together. . . .he even said he can get a job for my fiance in which he could get a letter written up for him. He speaks perfect English (its better then his Portuguese lol)so getting him a job isn't an issue. I'm just nervous about them thinking hes going there for work, but the job he would get the employer would write he cant work until documents are received and he is legally able to.

    I was doing research on the doctors and found the website for that same doctor, I liked that the information was all listed and it showed he does the immigration examinations. I couldn't find anything on the other doctor.I truly hope my fiance can get an appointment with him otherwise we will try the other doctor. I had sent an email the other night from my personal email and from his website, but after reading your post i will most definitely have my fiance call right away Monday morning since they don't reply to emails quickly. Do you know by any chance if anyone in the office or the doctor speaks English?

    If they do I would like to call for my fiance to ask them about any questions and try booking an appointment.

    Sorry for the million questions lol, but would my fiance go for his medical and then go back home and then go back to Sao Paulo to pick it up or is there a simpler way. He said he'll do whatever needs to be done but if there's a way to save money on gas or taking a bus over there it would be great.

  17. Thank you so much for those links! I was wondering if by any chance if you did the medical in Sao Paulo? I noticed there are two doctors for Sao Paulo on the list and was wondering if you had done it there what doctor you used, or if by any chance know about those doctors if you have any recommendations.

    My fiance lives closer to Sao Paulo and plans on doing the medical exam there.

Thank you everyone for the replies, to my surprise i received an email from the embassy today saying the appointment for my fiance has been made for April 16th, I'm soo excited but soo nervous I truly hope everything is put together by then, its really crunch time now. I never knew it would happen soo fast, i always thought a couple months or some time around that.

    Can the medical be done in time????That's one of my biggest concerns and the Brazilian police records

    I'm just curious and really have no intentions on doing this, but i like to cover all my bases, if for any reason I needed to change appointment date is all I do is email the embassy and they send me the new appointment date or is it more complex than that?

I didn't know i could call DOS about the same thing, if im not mistaken I remember reading a post on something else about DOS and something about them being faster to get in touch with,i guess it depends on the day, but do you know the best number to call for DOS and/or link to website i see the information about them like the times the phone lines are open until and everything.

    So I have emailed NVC about few days away from two weeks asking about the case number on our k-1 process but not have heard back from them. Today I was reading over a few old posts that came up from the search box and figured that this is normal not to hear from them right away being they get hundreds of emails. I was just curious if anyone recently has any update on how fast they reply to emails being the post's Ive read were from quite a while ago. If anyone has read my previous post its pretty hard for me to call NVC from brasil since long distance calling can be ridiculously expensive. I was also wondering if emailing NVC is the only way I can find out the information on the case number?

    Other than that for Brasil filers, how long does it take for the embassy to send the information about the embassy receiving the case? If I'm not mistaken they send the appointment letter with that or does my fiance book his appointment for one of the dates available?

    Any ideas and thoughts will be greatly appreciated =)

I have sent an email last night to NVC, hopefully I'll get a reply today.Its great to have the recommendation for the doctor as I have no idea who's better than others. My fiance wanted to do his in Sao Paulo since he lives closer to there, do you know of any good doctor that is listed for Sao Paulo?

    I dont know if i have this right, but once the appointment is set that is when my fiance should set up his medical or does he do that once the case number is received from NVC?
