  1. Please correct me if I'm wrong, but isn't the DS260 the same for everyone ? If so, on mine I have the option to select *Do not know* next to either the mother or father's DOB. I think it's safer to check this rather than throwing a random DOB on the form. Also, check your spouse's birth certificate, some foreign countries put this information on the child's BC or ask other family members, I mean SOMEONE had to celebrate or at least said Happy Birthday at one point in her life.

I will do a consultation with a lawyer and see what they say. of course, they're going to tell me *NO, you need a lawyer the whole case* - but as I have seen before, at the beginning of the case it's just as basic as it gets, so maybe I will file on my own & then get a lawyer for the waiver.

     

    Will keep looking at everyone's opinion, trying to find someone with a similar case.

     

  3. Hello all,

     

    just looking for some advice, I'm currently getting ready to file I-130 for my husband who is from Nicaragua. Here are some facts to make things clear:

    He entered the US illegally 8 years ago

    He has no criminal records or anything related, just 2 speeding tickets

    We got married a month ago

    I have already visited his country and family

     

    However, I was wondering if using a lawyer is necessary or extremely recommended since we will have to file a waiver later on. Another important point is that I was married before with someone who lived abroad in my country and started a petition for him as well, but we divorced before he even got the interview & I withdrawed the case from NVC, so he never stepped foot in the US. I'm sure this will raise some sort of flag since this will be my second petition for spouse, 4th petition total (1 for my dad & 1 for my sister).

     

    I did my other petitions on my own, have never used a lawyer, my dad's petition was approved with no issues, took one year and he's already in the US, my sister's is awaiting a visa number being that this is the last category for visas, and the previous CR1 visa that I filed was going fine until I got divorced of course.

     

    Do you guys recommend me using a lawyer? can I start my case and then just get a lawyer when it's time for the waiver? Any input will be greatly appreciated.

    Did you submit 2 separate I130 files for your dad and sister ?

    Or did you add your young sister on your dad's form ?

    Hi Stella,

    I submitted different I-130s ... Siblings cant be added to parents petitions unfortunately.

    Also, my sister's case was updated about 10 mins ago saying that the alien registration number has been changed. Not sure what that means but thats what they did to my dads case too. Hopefully I should be getting my NOA2 by the end of day today or tomorrow. :)

    I'm just awaiting for my interview to become a US citizen. I'm planning to bring my parents and sister to the US. Do you know the current processing times for parents and siblings? I read somewhere online that you can bring your siblings in 18 months. Is that true? Is the processing time for siblings being reduced? (My sister is 22-years-old).

    It's all a matter of luck. Some people say they had to wait over 12 years, some say they haven't. I petitioned for my sister and dad on 2/2013 & up to this month both cases were moving together. My dad's case was just approved and forwarded to NVC, and my sister's case I received a RFE and they're reviewing it. Hopefully they will get back to me soon. So as far as USCIS, after my case was transferred they moved pretty quick.

    Now regarding NVC and how long my sister will have to wait for a visa, we will see on that.ClockWatch2.gifClockWatch2.gif Hopefully I'll be lucky since she's only 7 years old.

  6. same as the other reply...find someone to translate it officially and they always send just a copy with the translation. Do not do it on your own.

    You should send them a Copy of the original and find a place to translate and notarized as well. Good Luck!!

    Also, another question. Should I ask my dad to get an extract or full birth certificate ?

    I need help !!

    I just received a RFE for my dad's case asking for MY birth certificate. I was not born in US so I have to ask my dad to get it for me. The letter says to submit a photocopy, should I ? or should I send the original ? It also says to submit a complete English translation. Spanish is my first language, I know how to write, speak and write it, should I translate it myself ? If so, should I get it notarized?

    I need someone who has gone through the same process before. I will really appreciate it!

  8. Your 6 years old sister is not derivative of your father's correct me if im wrong?

    which means if you petition your father and your sister, then you sister will have a longer wait.

    No she is not, they are both different cases.

    Yes, her case is supposed to take longer, however they both have been moving at the same time, same transfer day, updates, for both of them. I'm hoping that maybe because she's only 6 they might speed up her process rofl.gifrofl.gifrofl.gif That would be awesome ! lol

  9. Our petitions getting sent to another service center, where they will sit stagnant is what we I-130 petitioners call "exciting". Well, USCIS set the bar pretty low, so I guess that's how it is now. Still nothing but silence from our transferred files.

    Has it been more than 60 days from your transfer?? If so, call USCIS.

    The Notice that we get in the mail for the transfer says that we should hear from them again within 60 days & if not to contact them to see what's going on. To me, this is better than not getting any notice at all and not even knowing what's going on with my cases.

    USCIS is transfering I-130 cases over to TSC, NSC & CSC. Even tho it says local office, IT WILL NOT BE YOUR LOCAL OFFICE, it is just going to another USCIS office for faster processing, which to me sounds awesome ! they will send you a letter saying where it was transferred to.

    iamwhatiam80, even thought they are saying that only -130, Petition for Alien Relative, filed by U.S. citizens for their eligible immediate relative (spouse, child, or parent) are being transferred they also transferred my petition for my 6 year old sister at the same time as my dad's. smile.png

    Hello,

    I filed my I-130 on February 28, my case was not even touched until Yesterday 10/22. Last night I received an eNotification saying that my case was being moved to another USCIS office, and this morning received another one saying that it has been transferred to my local office. Not sure what this means, but for me it makes me feel better that they at least touched my case after 8 agonizing months.

    Just hang in there, USCIS is really backed up after they had to reduce personnel due to the government shutdown. I'm just hoping that we all get everything done soon. :)

    I sent the petition for my dad and sister on 2/22, I received the confirmation email on 2/28 & the hardcopy on 3/4.

    In may, I changed my address & up to now this is the ONLY update I have seen on the USCIS website!! It's been 6 months and I don't understand why it is taking so long!

    I know for my sister it will take longer, but the one for my dad is the one worrying me, I call USCIS about 3 weeks ago and they sent a inquiry to check why it was taking so long, but I have not received an answer yet. crying.gifcrying.gifcrying.gifcrying.gif

    Has anyone had their interviews scheduled or has been approved in the last couple days?

    I'm new to this forum and currently on the process of filing a petition to bring my father and my 6 yr old sister to the US from the Dominican Republic and I have a couple of questions. I tried looking through the forum but didn't find any answers. I Hope some of you have experience with this and would be able to answer some of my questions.

    Here I go!

    1: On form I-130, Part B & C, question 1, my father, my sister & I all have 2 last names, his ID in the Dom. Rep. shows both last names, My US passport shows both of mine but my SS card only shows First, Middle, Last & my sister's BC shows both. Should I include both of their last names and mines on the form?.

    2: My sister is only 6 yrs old and my dad has her full custody and no one to leave her with in the Dominican Republic, and the mother obviously can't take care of her, hence why my dad has the custody, would this speed up the process for my sister? Since there's no one to leave her with and she's only 6 yrs old.

    3: How do I prepare the package? What should I include in it? Should I mail both forms together, separated with rubber bands or paperclips? or send different packages?

    4: Does VJ has any guides on how to prepare the I-130 Petition for alien relative package?

    I would appreciate the help! :help:

  15. Hello all! I'm new to this forum and new to filing any petitions. I'm currently trying to file a petition to bring my fiance to the USA, we have known each other since 2005 & last time I saw him was last month. Now, this is what I wrote:

    "I, _________ , met _______ in the Dominican Republic on 2005 & started a relationship on 2006.

    The last time we saw each other was on my trip to the Dominican Republic on May, 2012 (flight itinerary & passport stamps attached). I stayed in the country for 7 days on which ______  stayed with me at the _____ Hotel in Santo Domingo. 

    He proposed to me while I was in the country. We spent every day together, went out to restaurants & clubs (pictures attached). We have kept an ongoing relationship for 6 years & plan to keep doing so."

    I was wondering if this would b enough (including the evidence) or if I should write a little more? Also, i see that they ask for form g-325a signed by him and one signed by me, do I have to send those with the I-129F or that's for the interview?
