  1. Not a problem is there is a co-sponsor.

    The co-sponsor should be made aware that he/she is signing a contract with the US government allowing the US government to sue him/her for reimbursement of any means tested public benefit that the immigrant may use.

    This contract lasts for 40 working quarters (at least 10 years), or until he becomes a US citizen, whichever comes first. This financial obligation does not end with divorce.

    It's none of my business, but I'd be weary about signing such a contract in these circumstances.

    Yes there was a co-sponsor because the petitioner (wife) did not have employment, she was a student. The immigrant is not the one applying for temporary government aid, its the US Citizen who has two children and unable to secure a job at this moment. She does not want the needs for her children to jeopardize the legal process but at the same time she don't want to be homeless. I know the immigrant can not apply for government aid because the co-sponsor is his support.

    I hope someone can give me the correct information. I have a friend who petitioned her husband on a CR- 1 visa. During the entire process she did not have a job but was in school. She filled out the affidavit of support and had a joint sponsor. Her husband received his visa but have not came to the US, she has two kids and the husband is not biologically his, she hasn't had any luck with securing a job yet. She wants to know if her applying for government assistance will affect the case? She is unable to pay her rent and do not want to be kicked out. She assures me this is temporary until a job comes through or husband comes to help.

    On September 16, 2013, your Alien Registration Number was changed relating to your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance.

    Does anyone knows what this means... Because it still says initial review ..

    I thought they only took into account the previous year's income.

    Not the years (before 2012) when the person was actually employed.

    Yes, they do take the previous year. I had not worked at all in 2010, 2011, or 2012. Me submitting the years I did work was proof of citizenship. On the form that I had to sign it asks for income. We used a lawyer. I had nothing to hide and wanted things done right the first time. We had no RFE's. And I did speak with a representative at the USCIS and they told me I had to fill out the affidavit of support even though am unemployed. If I didn't then it would raise red flags. Who wants to intentionally raise a red flag? The process is already draining from start to finish.

Let me tell you this...The best option for him is to stay in South Africa, its better he spends 1-2 more months receiving his new resident permit and attend the interview here successfully than be in ha hurry and go to Lagos get scrutinized,get denied and start all over again, thats another 7-10 months process from scratch, think about it....i am talking from the experience that i had with the US embassy in Joburg, first; The US embassy in South Africa does not have backlog of applications because only few people apply for visas here compare to Nigeria where the US embassy attend to over 1000 applicants daily...we where just 12 applicants both immigrant visa and non Immigrant visa on my interview date so there's 100% chance that his interview date will be set on time from NVC..second..the US consular is easier on South Africa resident for interview compare to Lagos. I am just giving you all this tips willingly but the final decision is yours...What's worth doing is worth doing well.

I am also from Nigerian living in pretoria and i got my CR1 visa last august, your husband must have a valid residence permit prior to his interview date, if not, he will be asked to wait until his residence permit is ready before he can go to Joburg for his interview or attend the interview nand get denied. The US embassy requires all temporary residents to have a valid residence permit before they can apply for any type of US visa.

  7. I would like to thank all the VJ family for all the advises & supports from beginning to the end of my filing.

    I got to the US embassy Johannesburg 12:30 pm today for my 1pm visa appointment, there were just 6 people for interview and it was easy and fast. everybody i met at the US embassy from the security staffs to check people in to the visa consular were nice and helpful. I attended the interview today and have my visa on my passport today, i only waited for 3 more hours watching the tv till i have my visa in hand

    My finger print was fast, paper submission process was fast, and the interview was very easy and straight to the point

    1 Who is filing for you?

    2.Where and how did you meet?

    3. Is this your first marriage?

    4. When are you planing to leave for the United States?

    5.What is your occupation? etc.

    The Trick: Please bear this in mind: The embassy staff who will first take your finger print and obtain your visa fee will ask you the same questions twice to see if your answer will change, never extend your answer to avoid curiosity of the CO asking further question. Dont say what they dont ask you about... The CO who will finally make an oath for you will ask you the same set of question twice to see if these questions will contradict.

    MAKE SURE YOU HAVE ALL YOUR PAPERS READY INCLUDING THE ONES YOU THINK YOU MIGHT NOT NEED AT THE EMBASSY BECAUSE DURING AN INTERACTION MIGHT BE REQUIRED YOU SHOW A PROVE FOR A SPECIFIC TOPIC.

    KEEP YOUR EYES ON THE CONSULAR, THEY ARE PSYCHOLOGIST THEY ARE WATCHING YOUR ACTIONS. All these process i have been talking about does not last more than 3-5mins.

    You dont have to worry about meeting and getting married in your first time of meeting your spouse...CO will never use that against you.....different couples with different private reason of doing things..for example in my own case, there was nobody to babysit for our 2 kids when she wanted to visit me for the time and also, we were trying to save some money on flight ticket as we all know the current global economy crisis affecting average family all around the globe. All your spouse needs to do is get all necessary papers and have a reasonable response to the CO. Good luck

  9. That's it. I'm not calling NVC again. Just gonna wait for my case complete email. Just called to see if they had started looking at our corrected AOS and the rep said "you have to wait 20 business days" (fair enough), then I asked "has it been recieved or put onto your system yet?" - and she raised her voice and repeated YOU HAVE TO WAIT 20 BUSINESS DAYS MA'AM".

    Grrrr. So bloody rude. Some of the reps are so great and polite. I'm just stressed and miss my hubby, don't need her attitude sad.png

    I completely understand how you feel about NVC. I feel like this if you can't be polite at a job that clearly deals with customers then leave. Go be a janitor or something. Its already stressful waiting to hear something and then to get yelled at for asking a simple question will make any person blood boil.

    Wow! I've heard of things like this happening to others. I think its rediculous... I had my fingers crossed after I shipped my things...... luckily I didnt have lost paperwork. But good luck........

    But the thing is I sent everything. I mean every original, to every form filled correctly, and etc. I made sure I didn't leave anything out.

    You're most likely experiencing a false checklist.

    Someone reviewed your IV file, and then they automatically put in a checklist stating they need the AoS file even though you sent it.

    It just hasn't been reviewed yet.

    Oh ok. I am taking a deep breath. I will call again today. I heard that if you call NVC so much it will delay processing, have you heard this?
