I am not sure if I am correct but try to go to the SS online stuff- because I've read (I am just recalling) that once a divorcee remarry and divorced again- the pension I think will be based on the marriage of a divorced partner that earns more.. so probably he still can get the amount worth for him because his spouse to be may not earn a lot...but he need to divorced his spouse to be after marriage... well this is VJ and am sharing what I read and remember- but want you to further look into this by reading the SS Laws.

  2. i agree with you guys as well that's why i want to make it clear and show my friend that what they are planning is going to be a big mistake,

    here's the thing, the reason why they won't get married is a completely different issue, which somehow i do understand

    it is not about the visa or whatever, it's about the man's pension,

    its okay if you disregard this, but im still going to explain why they had to think of this kind of decision(not marrying right away)

    the man was previously married to a, well let's just say a wealthy woman before, now since those two got divorced even before the guy met his fiance now,

    he was advised(by people around him, i believe, and people from the SSS, not completely sure where he got the information, anyway..) that he cannot marry until he's retired or else he would lose the part of the pension he will get from his previous wife, and his pension will decrease in amount. the estimation was $3000-$5000 every month(if i remember right, that was the agreement on the divorcement thingy). as i was saying, yeah that big, let's be honest, we cant find money like this anywhere, and this couple arent really that rich. life's hard, and the money would help them for the future expenses, most of all expenses for the baby. ITS ANOTHER ISSUE ABOUT MONEY. (sad to say).

    now, this is why i need your guys help more. i see their point of waiting, but its just hard to convince my friend since a part of this is true.

    if they go back, it would take another 8 years before they can get the approval for re-entry again..

    helpppp. what do i tell my friend. what do you guys think??

    ps: do you guys know anything about that SSS law? or know anything regarding pensions?

    I pity the new spouse to be. Once you divorced a husband or a wife, the husband or the wife will get a divorce pension-and this will be based on the salary of any of the partners who are earning more. So if the divorced wife earns more money, the husband's divorce pension will be based here and he will receive a little bit less as what his wife is receiving. This is the problem with divorced US citizens in the Philippines or elsewhere- they won't get married because if they re marry the divorced pension will disappear-- live- in its possible or bf or gf but not marriage.. why should one re marry if at the end it could not give him more or equivalent amount as to the divorced pension he is going to receive. But if HE TRULY LOVES HER, PLS PUT THE MONEY ASIDE... ..Don't tell me that after retirement he can still get the same amount if he remarries ?? Go SS online and read on topics about divorce and benefits because I believe that once you remarry the divorce pension will disappear..

  3. Your situation is quite difficult. Why not try for a F1, student visa (for graduate schooling) after satisfying the years you are banned in entering the us. Also let your parents in the usa obtain a legal status by all means so i think they have to get a lawyer. There are questions in the application about your relatives in the USA and followed, if they are legal or not-- so to make things not complicated accomplish one thing at a time.. With F1 you may have some bits of freedoms and more opportunities... also if you are deported (are you or is this voluntary departure?), you need to reflect that in your visa application-- Telling a lie does not help. Find a scholarship where you are accepted or any big news to support your student visa..

  4. The position of a tenured track professor is very competitive. Without it, one becomes a temporary worker. In addition, his field is one wherein it is quite difficult to get a job... A long time ago there was this PhD holder in Social Sciences that was homeless. Another big problem there if he applies for a position "lower than what his dissertation is all about" no one will hire him. The best way is to tell a lie. He will get an assistant to.... job but it may lead to a permanent position but salary of course is less. A tenured Asst Prof earns about 122,000+ US dollars per year.

    I don't want to remain stagnant the moment I arrive in the US as an immigrant. It makes me fat and a couch potato. Is there anyone here who applied for a job in advance by informing the employer that he/she will soon be an immigrant and would like to apply for a particular job in a company, institution or university? Some jobs are specifically addressed to an individual like in university research. Any one did it? Was it successful?

  6. Snail mail is regular postal mail. Do you not have this service?

    Ah.. ok.. it's the regular postal mail which is as slow as the snail..We have that. I computed the number of days from the time USCIS received my RFE, and it will be done (processing time) by the week before the last week of May, 2012. So I hope they can already make a decision and send announcement in the case status online dashboard as well as send a postal mail. Wish me luck!

  7. You will see no change after sending the RFE response until they either 1, send another RFE, 2, approve the petition 3, deny the petition.

    If you are not in a rush then just wait until you get notified via snail mail of activity on your case. The online case status checker is not accurate and rarely if ever current on your case status.

    How can i avail of the snail mail? Do i need to register? Where? Is this important?

  8. I sent my RFE to the USCIS center and I received info from USPost that it was claimed and signed by someone from USCIS .I had this photocopied. I monitor my case using the USCIS case status online. Is it ok that I will just be dependent on the output of my case using the USCIS case status online? Will i see a change of status with the correct date soon when I put in my numbers in the uscis case status dashboard? I am not really in a hurry so is it ok to wait? (the process will take more than a month) Will it have a credible result later? Thanks.
