  1. He only needs to sumbit his 2011 1040 and w2s from that year.

    Anything from 2012 onwards is optional. However, if the question even arises if his current employer is different, he should only need to include the last paystub that includes the current gross wage and deductions.

  2. If he works and pay only income taxes from his job and no other source in his 2011 tax return & he made more than $23,862 in 2011,

    He only needs to submit the original 2011 - 1040 that has his signature and all w2 associated with it.

    OK, my follow up question is, he works in his previous company for 1 year and then in May he resigned and moved to another company in June, aside from his job as a PT, he is also an active army reserves, basically he earns two income one from his job as PT and one in the army. My questions are, if the NVC require to send a pay stub,for how many month/s of pay stub is he going to send? our problem is he just started to his new company this June, is he going to send his pay stub from his previous company or do we have to wait for atleast 3 months so he can provide a pay stub from the present company he is working?

    Thank you!! :) By the way maybe you guys can ease with this worry i have in my mind, we have a daughter (1 year and 3 mos) old, i gave birth here in Philippines, and she is now an American Citizen and have her American passport issued by the US embassy here in Manila. My question is, does my husband have to include our daughter in the affidavit of support?

  5. Download and fill the I-864 form http://www.uscis.gov/files/form/i-864.pdf

    Fill and send in with the 1040 with all supporting w-2.

    I used the I-864EZ http://www.uscis.gov/files/form/i-864ez.pdf

    As i only needed to send my current tax return and nothing else.

    In the AOS package,

    1.Receipt of the payment

    2.Generated barcoded cover sheet.

    3.Completed I-864 or I-864 EZ

    The address to mail it should be whats on the barcoded coversheet.

    Also, please write down in pencil on top left the NVC case number incase they misplaced your papers.

    Thank you for the infos, so we are going to use i-864 my husband is my sole sponsor, is that right? Follow question, does he need to send in his W2, Pay Slips at his present job and bank statements? My husband resigned to his previous job on May, and he started to a new job in June and also he is an Active army reserves, If he is going to send in his pay slips, is he going to include his pay slips from his previous company?

  6. I hope someone can advise me on this. I file I 130 for my wife dated 10/6/2011. After 7 months I contacted USCIS thru senator's office and got following reply:

    "A check of USCIS records indicates that this case is currently under extensive background check review and it should be processed within 180 days. We apologize for the delay and inconvenience caused. Thank you and have a wonderful day."

    Neither me or my wife ever broke any law (except speeding tickets). She never been to USA. We have wedding videos, pictures.....anything they can ask for to proof that we are married. They didnt ask for RFE.

    I got my citizenship thru prior marriage which lasted over 5 years. We got divorce in good term, wasn't a massy divorce.

    My questis are:

    1. Did any one of you had similar situation? If yes how long it took you to go thru the process?

    2. Do you advise that I should file I 129f?

    3. I contacted Citizenship and Immigration Services Ombudsman today. Will it help?

    It took us 8 months going 9 mos. to get the NOA2 approval, my husband applied August 2011, received approval from USCIS for i-130 on May 2, 2012. No RFE's requested, non of us broke any laws, USCIS guys took long to review our case for some reason we don know why.

  7. Ok so on May 2 finally we got the NOA2, now we will just wait for the NVC to send us the case number. However hubby will come and visit us here in the Philippines on May 10 and go back to US on May 28, after that he will go to CA for training in the Army for the whole month of June. Our problem is, what if the NVC contact us and send letter to my husband's address in TX. I need your suggestions guys on what to do. We want to start the process at NVC as soon as the NVC gave us a case number, unfortunately husband will be away for 2 months. I heard of electronic visa processing at NVC, is that possible? Any suggestions would be greatly appreciated. Thank you.

  8. well, you mentioned the approval notice on the I-130, but

    what about the approval notice on the I-129F?

    these are two casefiles, each having 2 receipt numbers.

    Ultimately, the I-129F will be administratively closed when it hits NVC office, but for completeness, please find out the status on the I-129F - your husband may have received an approval notice for it and forgot to mention it.

    So, basically, dig out the first I-797-C letters (there are two) - review the receipt numbers, then cross reference those receipt numbers with the 2nd set of I-797-C letters (there will be one or two) and let us know what's what?

    Hi Darnell,

    I just checked the receipt number for i-129F, status is for "initial Review" . While the receipt number for I-130 says "approved and sent to NVC'.

  9. hubby and I agreed to file for K3 visa, so he sent the I-130in August 2011 and on Nov. 2011, after he received the receipt# from USCIS for i-130, he filed the i-129F. we waited for USCIS for approval of the i-129F, but on may 2, 2012, he received letter from USCIS(NOA2) stating USCIS approved the petition and sent the visa application package to NVC. My question is, since they approve the i-130, does that mean K3 visa is cancelled or forfeited? Thanks.
