  1. Don't assume that all embassies and consulates act the same. Manila can be one of the pickier places.

    The OP is asking how to verify current and continuing income. Can't just take a sponsor's word for it.

    Some sort of proof of income claim is going to be needed. $150K was last year. What is needed is assurance of what is being earned presently.

    Statements from clients and bank statements showing corresponding deposits sound like the only thing available to support the income claim.

    Bad advice here. Sponsor has to prove income claim.

In the form I-864 part 1, is she gonna check letter E: i am the the 2nd of two joint sponsor and for my mom is. letter E: i am the 1st of 2 joint sponsor.. i include my mom since I lived with her(shes also going to fill up I-864A) ooorrr... can I just put my mom in I-864A contract between sponsor and household and Just put my AUnt the ONLY joint sponsor therefore she will check I-864 part 1 letter D. :help: :help: :crying: ahh too many question soo sorry.. and also if my aunt has a joint income tax with her husband is going to submit also I-864A for her husband as well? whew! thanks a lot :innocent:

    She should be ok, because they only ask for the last tax transcript, however, as someone pointed out some consulates may be more demanding. In this case, have her send you her last bank statements, if she can't produce pay stubs.

  2. The question the OP posed was about the AOS package and the NVC stage and I was answering to that. I know consulates/embassies differ and some are pickier than others, but the OP didn't ask about the interview part.

    Everywhere I've read in the I-864 instructions though states that pay stubs and employment letters (to prove current income) are just optional for the AOS package. Where in the instructions does it say it's required? Cause I'd like to read it.

    thank you saylin for helping :) i read it myself too.. its optional. it made me happy and relaxed for awhile hehe.. but yup just to make sure maybe ill just ask my aunt to co sponsor and give her latest paystubs. just incase it will be needed in the future interview or worse rfe :)

  3. The lack of a specific requirement does not justify advising people something is optional. In many contexts, one might reasonably interpret lack of specific requirement to indicate "optional". Technically, evidence of current income is not mentioned in the instructions as a "requirement" but as a practical matter, it IS going to be required in nearly all cases where the income stream or source of that stream is not clearly stable over a significant period of time.

    The issue in this case is the switch from employment to self employment. Self employment income is not documented with EITHER pay stubs or employer letters, and (with rare exception) MUST be documented on a tax return. That's why your response was not only misleading in the context of employment but totally irrelevant in the context of self employment. If this were the only potential joint sponsor available to the OP, since the work is essentially the same and significant business expenses are not common in the self employed nursing field, other forms of "revenue" verification MIGHT be accepted instead of waiting for next year's tax return to be filed, particularly if the income has been high and so is the "revenue".

    If there's an employed sponsor available, that would be a better choice.

    This sponsor is in a Catch 22. For the self employed, current income comes from line 22 of the most recently filed tax return, but that tax return, in this case, does not reflect the self employment income. So, the sponsor can't effectively even STATE a current income until they file their 2012 tax return. Again, pay stubs are irrelevant in this case, making whether they are required, irrelevant as well, making Saylin's comforting statement that pay stubs are optional, misleading AND irrelevant.

  4. I am positive your Aunt meets the minimum income requirement to be a JOINT SPONSOR. If so, Your Aunt is more than ENOUGH...you dont have to show any thing about your moms income...On such a situation, I am 100% ( or make it 99.999999%) sure, your petition will not be denied due to AOS.....throw your stress out of Window and have good night sleep..... :dance::dance: :dance:

    thanks for the reply.. if only I can do that so theres no too much of a hassle. only 1 joint sponsor.. but.. im still living with my mom. so I still need to send hers(I-864A) :thumbs: and they might question me how do I support my self and kids w/ no income if I dont put my mom on the same household - shes the one supporting us right now until I can get my husband which is a nurse too..so I really need him badly so we can move out from moms house hehe :)

  5. Ask your AUNT , (if she is willing to do so) to be a JOINT SPONSOR which seems to be the best course of action on my view.

    A joint sponsor can be any U.S. citizen, U.S. national, or lawful permanent resident who is at least 18 years old, domiciled in the United States, or its territories or possessions, and willing to be held jointly liable with the petitioner for the support of the intending immigrant. A joint sponsor does not have to be related to the petitioning sponsor or the intending immigrant

    yeah i think thats what I really have to do.. since my mom is not sure if her employer can give her letter .. and yes my aunt has a goodpaycheck since shes an OR nurse ..now Im praying that my husband will not be denied in the interview even with my moms and aunt AOS..since im unemployed now due to nobody will take care of our baby here with me. ahh soo much stress to think off.. anyway.. thanks again. goodnight! :)

  6. She will need proof of income for this current year' a transcript from the IRS for only:, 2011 will not show current ability to support. If she does not receive current pay stubs due to beng PDN, try getting a letter from her employer, stating date, hours, rate of pay, and copy of her direct deposits from associated employer.

    sigghh.. :cry: i knoww ..thats what I was talkin about.. they will really look for present paystubs and letter from the employer.. if incase the employer will not provide her letter.. can I just send her last years income tax and get another joint sponsor (my aunt, a nurse too) which can provide recent paystubs because shes working in the hospital.. sorry for too many questions and I appreciate much all your help! ^_^

  7. Pay stubs are OPTIONAL in the AOS package. You're fine!

    omg are you sure? because I was thinking that is the major proof that the sponsor is still earning in the present and can support the beneficiary that can be seen in her recent paystubs.. well if thats what you say sooo.. whew! thats a relief! :D:thumbs: i pray now that after sending it w/o paystubs. they wont ask for RFE (paystubs) :blush:

  8. Sned the transcripts of her tax returns instead of a copy of the returns themselves. If she is self employed make a note of the following:

    If you checked box 9(b) (self-employed), you should havecompleted one of the following forms with your Federalincome tax return: Schedule C (Profit or Loss fromBusiness), Schedule D (Capital Gains), Schedule E(Supplemental Income or Loss) or Schedule F (Profit orLoss from Farming). You must include each and everyForm 1040 Schedule, if any, that you filed with yourFederal tax return. Source: http://www.uscis.gov/files/form/i-864ainstr.pdf

    Obtaining Tax Transcripts. You may use InternalRevenue Service (IRS) Form 4506-T to request taxtranscripts from the IRS. Complete IRS Form 4506-Twith the ending date for each of your three most recenttax years listed on line 9. Follow all instructions forcompleting and filing Form 4506-T with the IRS.

    THANKS for replying.. she did not fill up schedule C or any of the forms I think.. because she was not self employed last year.. she was still working in the hospital with paystubs/w-2/1099.. just this year she decided to work as a PDN so she dont have paystubs for this year :( what to do? i think thats the major proof that I need to show to them that she can provide support because she is earning monthly/weekly as seen in the paystubs :(

Hi everybody.. since my income didnt reach the poverty guidelines of 5 family household..since I didnt work fulltime due to staying for so long in the Philippines.. so Im going to get my mom as a secondary joint sponsor ( shes an RN) and she earned $150k last year which is good enough for 5 family household (me,my mom,2kids and for the beneficiary my husband) BUT... if time comes theyll ask for affidavit of supp.. she cannot provide recent paystubs for this year because she decided to work as a PDN(private duty nurse)because the pay is higher but theres no w-2/1099.. she receives her salary now through direct deposit in her bank from the patients funds..

    so my question is.. if we submit the 864 affidavit of supp. form together w/ her last year tax income..do we really need to submit also a recent paystubs or the 2011 tax income of 150K is enough..im afraid they might ask.. and if its really needed. do I have to look for another joint sponsor that has recent paytubs? thank you! hoping someone will help me with this prob of mine. :)

    same here.. pinoy (naturalized american citizen) living here in elmhurst, queens.. feb. 2012 filerrr.. still waiting though.. and hoping we get our approval at the end of this month or atleast early july :whistle:

  11. That's how I did it.. On a Sunday full of frustration. Manually doing it took me a long time lol but it's fully possible to keep track of case numbers right before and right after yours.

    The last three digits of the number is the order in which your petition was received that day. For example, if your case number ends in 391, yours was the 391st case received by VSC that day. So if you happen to find out 389 and 392 were approved, your time is inevitably soon.

    This was extremely helpful to me btw when I got frustrated. Is an interview with a former USCIS adjudicator who later became a member on VJ!

  12. On dashboard.uscis.gov you can check your own case number by typing it in there. if your case number is EAC100000002, then the case number before you would be EAC10000000001. Youc an search any case number as it's freely available information.

    On a side note, my priority date was Feb 6th, and I just got my NOA2 on May 29th! No expedites, no calls, no senators no nothing. Feb filers, your good news is just around the corner!

    thanks a lot! so I have to put manually all the case numbers before mine.right? its just amazing that you predicted your approval by end of May..and glad to know it was really approved at that time. :) anyway I dont how to estimate mine(priority date feb 21).. bit confused but ill try to figure it out. hehe.. thanks again! :)
