  1. Although I TRULY appreciate the feedback and help, I did not post this topic to get opinions on wether I should take this job or not, its a US well known company that pays for everything and it will mean a big step in my career. I just did not want to lose my GC so I was asking dear Vj'ers some help and feedback. so far from what I am understanding I have to wait until my 751 is approved ( or extended GC for a year at least) and then go for the re entry permit?  or just get that 1 year extension and go overseas and just make sure I return within a year, clear proof that I am not abandoning my US GC is that its a US company and my contract is TEMPORARY.

    Thanks again!

    I hadn't noticed you were a CPR.

Unfortunately, a re-entry permit issued to a conditional permanent resident is valid only until the expiration date of your conditional green card (or for two years, whichever comes first), so you aren't going to be able to obtain a re-entry permit with any remaining validity until your I-751 is approved.

So what should I do? and when u say approved do you mean receiving the NOA for my I-751?

A re entry permit is additional evidence that you re maintaining the US as your Permanent Residence.

I am reading the form but Im not understanding which one I should select:

Part 2 box a I am a permanent resident or a conditional resident of the US and I am applying for a reentry permit

box d I am applying for an AP document to allow me to return to the US after a foreign travel

Which one is more suitable in my case?

  4. Hey awesome people,

complicated situation. I received my conditional greencard (May 2015)through K1. I sent out 751 removal of conditions a few days ago, my job wants me to work overseas for 1-3 years approximately. What do I do?  I got confused reading about the n-470 and I-131 I dont know if I should file for both or just one. The company I work for is an outsourcing company, call center globally ( US company). My concern is I dont want to loose my greencard. I can travel every year to the US to make sure I dont lose it, but what do I do and what should I file before leaving the country. I will have a PO box here because the ultimate goal is to come back to the US, im not abandoning my greencard or anything. I am leaving temporarily ( 1-3 years). Please help,  the company expects me to move in a few months.

Doesn't matter if you have been married for 3 or 20 years, you can't skip the ROC and go directly to citizenship. You need to file for ROC first.

Besides, it's not about how long you'rve been married anyway. You have to be married to a US citizen AND be an LPR (ie having a greencard) for three years. I assume you've only had a greencard for two years?

You know what.. as I was reading your answer I realized that! You're totally right.. it's also in the instructions.. you have to have your GC for at least 3 years.. I think I got confused because someone told me that that was not the case anymore and being married for 3 years is sufficient. Thanks though!

  6. Hey Great people,

I am in a BIG Dillemma, I got married ( my wife is a US citizen since birth) on June 13 2014  and my Greencard expires on May 11 2017

I wanted to file for US citizenship instead of a 10year greencard, but the problem is I had to be married for 3 years with a US citizen ( per uscis), but looking at the date of the expiration of the GC that would be 1month too soon.

Should I file for US citizenship or go with the 10year greencard and play it safe?

Does anyone have any experience with this or any good advice, what should I do?

    Regards,

  7. Hey guys !

I have received my GC, but there was a USCIS error and my DOB was wrong.. I already filed i-90 and I already went to the biometric appointment for my fingerprints so my case is pending now.. I am waiting on my CORRECT GC now, but I need to travel abroad to the bahamas..

I can't schedule an INFOPASS appointment, because Im traveling in 3 weeks and there is no infopass available till next month and it is 400 miles away from me ( the closest one ).

So I am wondering now.. GOING to the bahamas is not going to be a problem because I have a European passport.. BUT re-entering the USA might be, would they make a huge problem at the POE ??

I will bring my GC ( with the wrong dob ) with me and the NOA1 for my i-90 proving that my case is pending and that it is an error on USCIS their end..

Would they deny the re -entry ? or would I face challenges ? has anyone gone through the same problems ?

ANY information or past experience is welcome !

    Thanks VJ'ers !

    5. Item Number 11.a. - 11.c. Citizenship/Residency.

Proof of U.S. citizen, national, or permanent resident status is required for joint and substitute sponsors and for

relatives of employment-based immigrants who file this form. Petitioning relatives who have already filed proof of

their citizenship or immigration status with Form I-129F, Form I-130, Form I-600 and Form I-600A do not need to

submit proof of their status with this form.

Proof of U.S. citizen or national status includes a copy of your birth certificate, certificate of naturalization, certificate

of citizenship, consular report of birth abroad to citizen parents, or a copy of the biographic data page of your U.S.

    passport.

Proof of permanent resident status includes a photocopy of both sides of the "green card," Form I-551, Alien

Registration Receipt Card/Permanent Resident Card; or a photocopy of an unexpired temporary I-551 stamp in either a

foreign passport or a DHS Form I-94, Arrival/Departure Document.

Now if I give them what they want is it still possible I get an rfe for something else??

  9. It's clearly indicated in the I-864 instructions that proof of US citizenship or LPR status is required.

He should scan his birth certificate or the biographical page of his US passport and send it to you as a .pdf attachment in an email, something like that.

So you tghink if he would take a picture with his ^phone and send it via email it wont be good enough ?

Owh its in the instructions ?? ! man I read that whole thing I must've misread that line ! :(

  10. Hey guys

So as I said earlier I receives my RFE for aos I485

RFE : the joint sponsor on form I864 aff of support must be a US citizen , United states national or lawful permanent resident of the united states

submit evidence of the joint sponsor status :

    evidence may include :

    birth cert.

    Biographical page of us passport

    cert of naturalization

    certificate of us citizenship

So I have never heard that this was even required ! so weird ! I have never read something like this on VJ !

    but anyway My question is

    Yes he is a us citizen ( duhhh ) I submitted a Tax return of 2013 !!!!

what the easiest way and the quickest way for me is to get his biographical page of his passport.

but is it possible that my joint sponsor takes a picture of his biographical page of his passport and send it to me through email

and I print it out and sumbit this and send it back to them ??

I called the customer service twice and they could not answer this they said we don't know :( :( :(

or do I really need to ask him to copy his biograph page and send it to us by mail ( will take multiple days ) !

he is a busy guy so thats why i need the easiest way but ofcourse they have to accept it !

    i don't want another RFE !!

let me know if you guys know the answer ??

    thanks !
