  1. a visa is only for entry to the country. since you are already in the country, you merely adjusted status from F-1 to H-1B.

    There shouldn't be any issue transferring.

    Problem is, I'm already H1 Status at company A as of Oct 1st 2012. I'm going to transfer to company B maybe less than 2 months.

    That means I do not have 3 pay stubs from company A. I saved pay stubs since the first day I did OPT with company A. I have collected for a year. Will that work?

    However, I will probably get 2 paystubs starting from Oct 1st, 2012 if I transfer to company B.

    My point is, will you be able to transfer in just a month after the change of status?

    Another Question, which documents do I need to show to the new employer during LCA process? i-797C and i-797A? Are they enough to tell company B that I'm legal to work in US?

  2. Hello,

    I have been working for the company A under opt, and they decided to apply h1b for me. I got my h1b approved for october 2012.

    I only received i-797C and i-797A with i-94. I do not see any h1b visa.

    I got a new offer from company B who is willing to do the transfer. I might get transferred in November 2012. That means I only have one month pay stub as h1b worker and few pay stubs from opt before the effective date oct 1st.

    Will there be any issue to transfer?

  3. Thank you. I'm currently on OPT. I'm waiting my h1b to be valid on this coming october.

    The company refuses to pay me prevailing wage, and my h1b is not full time. It's part time.

    Will I have trouble showing my current pay stubs at my home's US embassy?

  4. I don't see any fraud here. Get the fastest, easiest and cheapest route if you can.

    I have seen more nastier issue than this case, where a lawyer also "commits to fraud legally" and finds a loop whole to cheat USCIS.

  5. Worst scenario. I don't think they will send cops to deport you immediately. Most likely, they will give you a notice prior deportation. You need to leave by this date xx.

    Then, if you don't, you will get those so called bars. It means you are banned from entering United States for a certain period.

    There is nothing to lose. Don't get nervous, you will still live with or without the job. It is frustrating to think about it. But that is life. Leave the rest to God as long as you have done what you could do.

    I can't help you but my best bet will be visiting an immigration lawyer. You will get a better answer than just going to a forum.

    Don't get me wrong. Forum is free, and there are many people who might have the same experience as you do now. However, you need that IMMEDIATE assistance before they do something nasty to you. You do not want that.

    Question: I will be going back for business trip during the end of September.

    Is it too risky to get the stamp from my home country?

    Not trying to confuse anyone. I still have my options here. This is the worst scenario that I back up the job offer in Asia. I still have my job here.

    If someone can help me, I will really appreciate.

    I have US degree from accredited university and it's pretty well known.

    I got my h1b 2013 approved, and it has not been effective yet. I recently got a job offer in Asia. I am no longer interested in working in the United States.

    Should I tell USCIS to cancel my H1B? I also have i-130 F4 on file. Would it have a negative impact towards my interview for i-130 in the future?

    I got my h1b approved this year. However, I have been thinking of leaving United States for good mid of 2013. I also have filed i-130 F4 which would be 10-12 years wait.

    I'm going back to polish my engineering skills because I really have no hopes getting sponsored jobs in states at this moment. The current job is not giving what I really want.

    Ok, let's say I leave this country. What are the steps should I do? I also have the intention to come back to states after my i-130 approved.
