  1. My case is the opposite. My husband and I got married in April 2012, I got my GC in September 2012 and found out he was seeing someone else. I was devastated! We got divorced in December 2013. My question is: Do I need a letter from him stating that our marriage was bonafide? I also would like to mention that we have 2 children and my mother is a US Citizen so I had no reason to marry for the GC. Any help would be appreciated.

  2. I'm helping a friend of mine applying for her Adjustment of Status and we have a question about I-864 form. She listed her income on question 24, letter b. Now, which letter should her choose?
    d) The persons listed above have completed Form I-864A. I am filling along with this form all necessary Forms I864A completed by these persons

    OR

    e) The person listed above,(petitioner) does not need to complete Form I-864A because she is the intending immigrant and has no accompanying dependents.

    AlI got now is welcome letter and I-30 approval hard copy...

    I am sooo depressed I thought I can relax after interview... :crying:

    You'll get yours soon! My interview was on 9/13 and I wasn't approved on spot. He said he was recommend my case for approval but it needed to be reviewed first. The next day there was an online update saying that they approved my I-130. On Sept 17 I got an update on I-485, also approved. On Sept 20 - card production, and today an update saying that USPS picked up my Green card and I should receive it in 7 days!

  4. Yes, that behavior will need to stop immediately if he's going to fit in.. :P

    I had my interview today and it went pretty well. The officer was very nice! He started asking us how we met and said it was ok for both of us to speak. Then, he asked my husband what was my name and DOB and the same question for me about my husband. He asked about my husband's job and asked if I had anything else for him. I gave him a few more documents like banks statements, health insurance, tax return for last year. He asked me those "NO" questions and my parents names. Then I asked if he would like to see our photo album and he saw ALL the pictures in it (about 100 pictures). We talked about some of them and he said everything looked good but it just needed to be reviewed to make sure everything was fine and that he was going to recommend our case for an approval. He also said that it could take 30 days for me to receive an approval letter in the mail + 90 days to receive my Green Card even though in most cases it arrives in 2-3 weeks. Hopefully I'll get an approval notice SOON! I didn't have any RFE or anything. We'll see...

  5. Hi Everyone ! We're off to the Detroit offices in September for daniels aos interview. We just got the letter today and most of the items are easy enough to bring.

    1. Interview notice and Gov't issued photo identification (I take this to be his passport)

    2. A completed medical examination(Form I-693) and vaccination supplement in a sealed envelope unless already submitted (for the AOS packet we sent off, we put in his DS 3025 copy, is this alright to bring again? He got all his shots in the UK. Or do I have to bring something else?)

    3. a completed Affidavit of Support I-864 with all evidence from sponsor, this is what I sent off for his AOS packet, I'm just making more copies and bring them in.

    4. All documentation establishing your eligibility for Lawful Permanent Resident Status (say what? do I bring in all his approvals for the I-129F and his approval for his interview?)

    5. Any immigration documentation issued to him, including EAD and AP (he didn't get either of these yet, so if he gets them beforehand, we'll bring them to the interview)

    6. All travel documents used to enter the US (passport, and his I-94) which is still in his passport

    7. His birth certificate

    8. Petitioners birth certificate, and evident of US citizenship (is my drivers license okay to bring as well? or do they want something else?)

    9. No children so this doesn't apply

    10. If your eligibility is based on marriage, spouse has to come (of course), certified copy of marriage document, my birth certificate and evident of citizenship (same as above?)

    11. support evidence of relationship, we have no joint assets or anything, the bank I use here in our city wouldn't allow me to add him to my account because he didn't have a SSN. We went to the SS office 3 times, and was told each time by different people that he couldn't get one because of changes after 9/11. He doesn't have a bank account then, and so he hasn't gotten a drivers license either because of this. I have photos of us after he's gotten here, a trip to chicago together, and cards sent to use for our wedding date. would that be enough?

    12. Original and copy of each support document that you submitted with your application (I just have to find these on the computer)

    13. He hasn't been arrested here, so he has his police report from the UK that we're bringing.

    *sigh* was really hoping we could avoid an interview, but would you say I have pretty much everything alright? Or do I need a letter from my SS office and bank stating why he couldn't get a SSN (so they said) and therefore couldn't get a bank account??

    You're going to be fine! You just have to tell them you are not allowed to add him to your bank account since he doesn't have a Social Security!

  6. hi VJ people.. as what the topic title says, can i seek help from you cause i have no idea about what some of the items in the letter that was sent to me for an interview this coming august 21, in the two items saying that: "Original and copy of each supporting document that you have submitted with your application.", "All documentation establishing your eligibility for Lawful Permanent Resident status." what does it mean? thanks..

    I think you'll have to bring everything (original and copy) of the documents you have submitted with your application.

    In order to be able to file for citizenship an applicant must show that he or she met the residency requirements - meaning physical presence in the USA!!!

    Physically Reside in the US

    You have to physically reside in the US before you file your application for naturalization. The time period is based upon your five- or three-year period, based upon your marital status. If you're:

    • Married to a US citizen, you have to be physically within the US for a total of 18 months out of the three-year period before you filed your application for naturalization
    • Aren't married to a US citizen, You have to be physically present in the US for a total of 30 months out of the five-year period before the date of your application

  8. Hi there! A friend of mine has Green Card and she had to go to Brazil last year because her father was very ill. She stayed there for almost 6 months, came back for a few days and went back to Brazil again. Unfortunately her father died in July and she is trying to get things together for her mom before she returns to US. My question is: is she going to be able to apply for her citizenship after staying there for a little more than a year (entering in the US every 5-6 months)?

  9. Am I the only one who feels somewhat OCD about checking the USCIS website for I-130 approval? I check it about 4-5 times a day every day. Even on days I KNOW they are not open. I want to know if anyone else has the same "problem."

    How often do you check the website?

    I feel like there should be a support group for this. :lol:

    I also check their website all the time (at list once a day). :)

  10. Your mother can cosponsor even if she lives in another house but if you made enough money in the most recent tax year and still do then you don't need a cosponsor.

    Oh ok! He did make enough money in 2011 and 2009 but not in 2010, I guess!

    We will send them what we have and wait to see if they will ask for something else.

  11. My husband's most recent Federal taxes are OK, his second one is NOT and his third one is OK. Can my mother be my co-sponsor even if she does not live with us? She is an American citizen living in the US.

    The other thing is:

    On the I-864 form:

    Part 1. My husband is letter "e", I am the first joint sponsor ?

    my mother would be letter "e", the second of two joint sponsor. ?

    Part 5. Sponsor's household size:

    1. Your Household Size - DO NOT COUNT ANYONE TWICE Persons you are sponsoring in this affidavit:

    a. Enter the number you entered on line 10. 01

    Persons NOT sponsored in this affidavit:

    b. Yourself. 01

    c. If you are currently married, enter "1" for your spouse. (SHOULD HE ENTER 1 FOR ME? THEN HE IS COUNTING ME TWICE)

    d. If you have dependent children, enter the number here. 02 (WE HAVE 2 CHILDREN)

    Which for does my mother need to fill out being my co sponsor? The I-864a? Who is the household member?

  12. For a self employed person the income evaluated is line 22 of his most recent year's form 1040. In your situation that is the 2011 tax return. The extension reason won't be good enough. For immigration purposes it needs to be completed as soon as possible.

    His personal federal tax return is the one that is needed, not the business.

  13. My husband is a self-employed but he asked for an extension this year to file his taxes. Is it ok to send the one for 2010? He did file his personal taxes but I think it's not enough. Should he just send the one for his business (2010) with an explanation of why it wasn't file yet this year? Thank you

    I have! When I was single my mom applied for me but I only have the I-797C notice of action (Approval notice). Should I put the receipt date or the priority date? We did it with a lawyer so I don't know (and he doesn't call me back!). Also, for the place filing should I put the place my case was transferred for? Should I send a copy of my I-797C, Notice of action?
