Hi! It is not illegal to adjust your status. The way in which you attempt to do it  determines whether or not it is illegal. If the reason for getting the tourist visa is to come to States and get married, and in process of getting such visa, he or she lies to immigration about his or her intent in the United States, then that would be considered immigration fraud. When dealing with immigration, you have to be honest because if they find out that you’re lying, the consequences be long.

If you have a bonafide relationship and can prove such, your best bet is the K1 visa.

Thank you so much for the information. Very valuable information.

Well if you're planning on getting married a fiance visa is your only option. Applying for a tourist visa with the intent to adjust status and get married is illegal.

Also, you have to apply for the fiance visa and he would apply for the tourist visa. If he briefly wants to visit then a tourist visa is fine, but he'd need to show ties back home otherwise he'll get denied.

I really didn’t know that it was illegal to adjust status. Thank you for the information.

  3. Hello everyone,

This might seem like a confusing question but I have to make myself clear. I apologize for the long post. Here I go:

Back in 2010, I dated my ex boyfriend from DR for a few years. During that time I lived in DR for a couple years. I am a USC and my parents are Dominican. I returned to the US and the relationship ended a year later.

We still mantain a friendship at the moment but I do admit I care about him very much. Due to being in 2 different parts of the world, we are both aware that it’s difficult to maintain a long distance relationship. Since my return to the US in 2013, I go to DR every year and spend time with him.

He does have a job for a while, Has a vehicle and doesn’t have a criminal back ground.  I do work, have a vehicle and a good job. Whichever application he apples for, he will put me as the petitioner.

My question is, do you think it’s best he applies for a tourist visa? Do you think it’s best to apply for a fiancé visa? What would be easier and less time?

I’m just confused with which one to go for.

Thank you for taking the time to read my post.

  4. Hello All,

How are you today? I haven't been on this site for a little while so I forgot about the process...

My boyfriend is curently in DR so I am thinking of filling out the I-129 being that we are not married. I am not really lear as to what is the best option fo rme at this point. We been dealing with each other for almost 4 years. I am a US citizen, even though my family is Dominican but just want to make the best decision.

I need help in aaaalllll the information I can receive.Prices? how long? The benefits of each? Just everything that might be helpful, lol...

    Graciaaaass :)

  5. I am new to this process and I am learning daily from this site, Thank You guys... I plan on bringing my fiance from our country to the US but can be confused with all the process and etc.

I haven't started this process yet but gathering all my information together... I wanted to know how long does it take if someone enters the US on a K1 visa and wants to work? I am aware of the 90 day marriage process but after getting married how long would it take?

  6. You can put your present address on the application now. You have every right to change your address at any time. USCIS gives you instructions how to change your address.

Thank you. But would it matter that I put one address on my application as to where I live then put a different one for where my partner plans to live? The reason is because I live at one destination but if and when he comes, we will not live where I live now.

  7. Hello All,

So I am planning out filling out the application for the first time sometimes next week. The problem is that the address where I live at the moment is not the address I plan on bringing my significant other to. The application asks for my address and the address I intend to bring him to but they are not the same. Would that affect anything with the process?

Even though, I might fill it out sometime next month (maybe) because I am currently unemployed so I know I have to wait until I do so to make the process more legit. We are not married so I am kind of still contemplating if I should do the K1 or the spousal one, which would mean I have to travel to marry first then come back and start the process.

    Advice please.....

  8. Hello Everyone,

I am new to this site and have a few concerns and questions regarding bringing my fiance to the US on the K1 Visa. I am so unfamiliar with this process, terms and conditions.

I met my SO back in 2006 but been in a relationship with him for a little over 2 years. When we started our relationship we were in a long distance relationship for over 6 months until I decided to move to our country Dominican Republic. We maintained our relationship until I return back to the states after 1 year and a half. I am a little confused as to which visa to apply to but I leaning more towards the K1.

Now I am back to the states and would like to bring him here but not sure under which visa, either the fiance or spouse one. We are not married yet but plan on it just not sure which method is the best one. If I was to apply for the K1 visa, how long will it take for him to be in the US, if approved? What are the requirement? I know we have to marry within 90 days from his entrance to the US.

*What if the petitioner doesn't work at the moment?

*How long does the petitioner have to be employed to be able to apply for the K1 visa?

*To file for the K1, what is required besides pictures?

    *What are the interviews like?

Sorry for so many questions. I am soooo clueless with this process that I need all the help I can receive.

  9. Hello All,

This is my first time posting and I have many questions that need answers...

A lil about me: I been with my SO for the past 2 years but known each other for about 6 years. I am a US citizen (born and raised) but he isn't. We kept a long distance relationship for about a years until I decided to move to Santo Domingo to help my grandmother and worked out for both because he also is from the Dominican Republic.

We have been speaking about getting married and making a life here in the US but I am confused as to what I should do. I love him very much but I want to make the right choice. I am clueless as to this procedure and what are the steps that come after. How long would the process usually take? I need to get all the advice I can to better understand this whole USCIS procedure. What are the benefits for the Fiance or the Spousal visa?

We are not married yet but I am not sure if it's better for me to wait if approved to marry here in the US or I go to Santo Domingo to marry there and do the process when I reach the US... How much money is going to be spend? How long does the petitioner need to work before they try to bring someone to the US?

i NEED ALL THE HELP I CAN... I am so lost regarding this whole process... PLEASE HELP :)
