Hey everyone...it has been years already since I first joined this forum...it is so unfortunate that I am still dealing with this. So I applied in May 2011 for VAWA with i485 I had an RFE in october 2012 because of my "lovely" lawyer. In July 2013 my vawa was approved and apprebtly moved to NBC in august 2013, I checked online and it says that my process on 11.05 2013 is in the local office. I have a congressman helping me but still everything is super slow with me..any words of wisdom? what should i hope for next and how long? I really hope that I have my green card soon in the next 3 months. =( it has been way too long.

Gabrielvawa your lawyer is wrong, you should not wait for any RFE . USCIS can just adjudicate your case based in the documents you submitted before, and they can approve or deny your Vawa. If you have additional documents send to USCIS asap and specified outside the envelop TO:VAWA UNIT.

Send IRS transcript instead just copy of tax return.You can call IRS and they will fax over in 30minutes, do not ask to mail you it will take 4 to 6 weeks.Make sure in your friend's affidavit they put their full name, date of birth,place of birth, present address and phone number.They should mention where, when and how they met you,they should describe what they know about your relationship and the violence you suffered, always specifying dates and places. NOTARIZED AFFIDAVITS ok.

This is exactly the same thing my lawyer said...I wanted to send everything once I found out I needed police clearance she said no. I am so mad. I am wondering what else I need to sned so I have everything completed. I am so upset. How much longer will this take now?? i GOT MY POLICE CLEARANce from brazil when i came with k1 visa. Do I still need to get police clearance from Brazil?

maryhoney 87 why you didn't provide the police certificate when you were waiting your case to be adjudicated? ...well probably they are asking the police certificate, despite they use to do that before issuing the prima facie.

Here is my advice to everyone WHEN YOU SUBMIT THE I-360 you must send the police certificate from USA and the police certificate from your home Country as well, if you are living in the USA more than 3 years.

When I found out that...I told my lawyer, she said dont worry if they need it they will ask for it its not a big deal. I am so tired of these lawyers! I wanted to send it after we sent the I360 because I found out AFTER but she never told me before! She should have known that it is a requirement! I am so mad now! should i start getting it done now? and which police certificates do I need?? I have been here since July 2010. I have lived in New Jersey, aND CT.

I have a question if we dont get the renewal on the prima facie can we get a federal loan for school with the I485 pending or no? I was accepted at my masters program but they want a copy of my renewed prima facie...is there any other way of getting the loan? Should I send the acceptance letter to USCIS to show them my urgency?

I really hope so . Because if it delays vawa longer we are all in big trouble. I dont understand the timeline . The last time that i was able to speak with someone at vsc and the most that i was able to get out of them was ( we still working on previous cases that was submited before my case and the officer told me that it may take up to 5 years in some cases), i really hope i dont have to wait that long.

5 years???? That's insane!!! It has been 15 months for me and I am already losing hope

Vsc is getting more ridiculous by the day with this waiting period how on gods earth can someone that filed for eg in July 2011 with no expedite get an approval before someone that filed in the previous months this is nonsense I think we might have to start protesting about vsc and their #######. Ughhhh

Have u ever gotten a prima facie

Yep I got the first one. It expired my lawyer never looked on it I told her it has expired she applied for second one. My second one it is expiring next month. And my lawyer is in maternity leave, never called me before she left to update my case. I'm tired! And the other lawyer taking care of the case is telling me I don't need a prima facie because I applied for i485. ####### is wrong with people....

What prima facie has to with I-485..NOTHING...ZERO...NADA...It doesn't make sense his information,no provision in Immigration law at all.We have here in the VJ several battered women/men they have a pending I-485 and they got prima facie without any problem.

I am wondering how can I get help with school. I'm not eligible for Fafsa because it's a masters degree. It should be another way... Also don't know what else to do regarding the wait. It has been 15 months since applied no changes since then.

I am on the same boat! I sent my I360 and I485 at the end of May 2011! Not one touch or change in my case. I am redoing my biometrics for the work permit tomorrow! Wwhats going on? How much longer? I sent them a letter in April and never heard back from them! HELP!

I have been waiting for 13 months no changes at all, no RFE, nothing... Its so frustrating...

But i have no choice, my wife is scared on those lawyers and judges after I billed her out for her first DUI charge in 2009. I tried to find one lady attorney in New York, she want to charge me $8000 just re-drafted my self-petition letter. I wrote letter to VSC supervisor, with this $8000, i can let my wife go to rehab for twice.

OMG I really did not think I was gonna wait this long for an approval...it has been more than one year now and no RFE no nothing...

I sent the letter to vermont and got no response...any ideas??? Also I have my EAD and travelo document because i filed with I485.

My boss is wanting me to go to Germany with him for a week..for a very important business trip...is it risky if I go even with travel document?

Hi maryhoney87, read my post. I explained it a couple of months ago on this site.

1. Apply for FAFSA online, REMEMBER, pick the option of eligible non-citizen,

2. take your prima facie to your financial aid officer. Most people have not heard of prima facie for battered immigrants, so I'ld advice you take along with you the 'dear collegue letter.' you can print it out straight for the internet.

3. Insist to them that you qualify. GOODLUCK!

Ok on my case I went to a couple lawyers before I decided what to do...I sent all together I360 PLUS I485 AND EAD. The thing is from what these lawyers told mE: They say if you send everything together it could be risky because they can deny your I485 and than its the whole thing about going to court and convincing the jusge about ur case. But its deft faster than sending your I360. I did it because I am tired of waiting for everything... and you can deft send it now...I heard lots of cases that sent the i360 first and than I485 before vawa approved. And if she suggested you that its because she is confident on your case =) I hope that i helped...

I agree with your lawyer. If they will need it they will ask. Don't send them proactively.

Also I am thinking about sending my police clearence so I dont get a RFE for it but my lawyer said not to, if they need they will ask me. But I dont want to wait for tehm to ask...any suggestions?

Proof of "good moral character" is required so you will need a police report or some type of proof. You will probably receive a RFE but do not send anything until USCIS asks for it.

Because they kept processing my report under the wrong code my attorney and I prepared the response ahead of time.

Ye I sent a bunch of letters from neighbors, professors and friends to show my good moral but that was mainly it...no police clearence... I really dont want a RFE =(

ok now I am worried. My lawyer did not ask me to send the police clearance or anything. I am afraid of them asking me for RFE because of it...what are the chances??? Should I do it and send it to them without them asking or should i wait and see????

My case filed 03/25/11 notice of recived I 797 nothing else ...after many many inquiries today I check my status online n my status has change Request for Evidence (RFE) after a 1 year and 1 month .. can Somebody tell me how long I have to wait for the letter on the mail? Honestly Really wanna see what they need... help please

Ohh noo I cant imagine how you feel...There is no way to know until the letter arrives to you. You will soon get it I believe in one or 2 weeks. I am sure it will be fine...I just cant believe they By the way how did you ask for inquires on your case??? Because they dont give u info by phone or email...
